Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting
of the Mayor and Board of Trustees on January 10, 2023, this Executive Session was called to
consider review of Land Disposition.

The vacation and sale of the of Howard Street right of way, east of Busse Road, was ready to
move forward, but has been placed on hold by the purchaser, who owns the surrounding
properties. The owner's attorney advised to hold off on the purchase, as the owner may want to
consider going in a different direction. The original sale price the Village agreed to for the
Howard Street vacation was $2 million dollars during discussions over a year and a half ago. At
the time, the property owner was refusing very high offers to sell his land to a data center, and
insisted that he wanted to develop the properties himself and would not sell. As such, the
Village put a clause in the draft sale arrangement which would require an additional payment of
$1 million if the owners sold within 10 years. The owner is now considering selling the land to a
data center as the market conditions have changed. The consensus of the Board was to review the
sale price of the right of way when the owner provides a signed contract for the sale of their
property to a data center.
The meeting was adjourned at 6:31 pm.
