Pursuant to a duly made and approved motion and a majority vote at a regularly scheduled meeting
of the Mayor and Board of Trustees on March 28, 2023, this Executive Session was called to
consider review of Litigation.

The closing for the Cook County portion of Midway Court is scheduled for April 6. IDOT has
just made the Village aware that the auction process was changed effective January 1 and the
property should be offered to the municipality prior to auction. The Village will be able to skip
the auction, although IDOT is working out the next steps with the new regulations.
Authorization for the purchase of the IDOT parcels will be included on the next agenda.
A court hearing has been scheduled on May 23 for the Vulcan law suit. At this time there is no
update on closing and Prime is unable to secure the plan to close with their lender.
