Home My WebLink AboutORDINANCE - 3889 - 2/11/2025 - PROHIBITS THE SALE OF KRATOMORDINANCE NO.3889 AN ORDINANCE AMENDING CHAPTER 6, ARTICLE B OF TITLE 3, CIGARETTE AND TOBACCO DEALERS, ALTERNATIVE NICOTINE PRODUCTS BY ENACTING A PROHIBITION ON THE SALE OF KRATOM WHEREAS, On March 28, 2023, the Mayor and Board of Trustees enacted Ordinance 3804 which banned the sale by any licensee of any product containing THC as said product is deleterious to the health, safety and welfare of purchasers thereof, and WHEREAS, The Mayor and Board of Trustees have been advised by Village staff that a product identified as Kratom is likewise deleterious to the health, safety and welfare of users thereof and should be similarly banned. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Cook and DuPage Counties, Illinois as follows: Section 1: That Section 3-613-1 Definitions of Chapter 6, Article B of Title 3 be amended by adding thereto the following: KRATOM: Any parts of the plant mitragyna speciosa, whether growing or not, and any compound, manufacture, salt, derivative, mixture, or preparation of that plant, including but not limited to mitragynine and 7-hydroxymitragynine. Section 2: That Section 3-613-4 be amended by redesignating the paragraph banning THC products to 3-613-4 F and amending same to read as follows: F. SALE OF PRODUCTS PROHIBITED: It shall be unlawful for any licensee or any employee or agent of any such licensee to sell, deliver or distribute any illicit THC product or Kratom. Section 3: The Village Clerk is hereby authorized to publish this Ordinance in pamphlet form. Section 4: This ordinance shall be in full force and effect from and after ten (10) days from its passage, approval and publication in pamphlet form according to law.
