A RESOLUTION AMENDING A PRE -ANNEXATION AGREEMENT
PREVIOUSLY APPROVED BY RESOLUTION NO. 59-79

WHEREAS, the President and Board of Trustees of the
Village of Elk Grove Village, pursuant to Resolution No. 59-79
approved a Pre -Annexation Agreement between the Village
and O'Hare International Bank, as Trustee under Trust No.
71L148, which Agreement provided inter alia for the installa-
tion of sidewalks along tandmeier Road and'the connection
of certain property to the Village sanitary sewer system
by July 24, 1981; and
WHEREAS, the owner of said annexed property has
petitioned the Village for an extension of time for the
installation of said improvements due to certain economic
conditions which presently exist and which were not
readily foreseeable at the time of the adoption of said
Resolution; and
WHEREAS, the President and Board of Trustees of the
Village of Elk Grove Village are of the opinion that the
granting of said extensions are not contrary to the intent
of the parties in the drafting of the Annexation Agreement
above described;
NOW, THEREFORE, BE IT RESOLVED by the President and
Board of Trustees of the Village of Elk Grove Village, Counties
of Cook and DuPage, Illinois as follows:
Section 1: That the Annexation Agreement dated the
24th day of July,.1979, by and between the Village of Elk
Grove Village and the O'Hare International Bank as Trustee
under Trust No. 71L148, which Annexation Agreement was approved
by Resolution No. 59-79, be and the same is hereby amended
as follows:
A) That paragraph 8. Sanitary Sewer, be amended
by extending the time wherein the owner shall connect the
Kearn engineering lot to the existing Village sewer main
from July 24, 1981 to July 24, 1982.
B) That paragraph 12., Sidewalks, wherein the owner
agreed to install sidewalks on Landmeier Road in conformance
with Village regulations, be modified by permitting said
sidewalks to be installed no later than July 24, 1982.
Section 2: That this Resolution shall be in full
force and effect from and after its passage and approval
according to law.
