HomeMy WebLinkAboutRESOLUTION - 67-81 - 11/24/1981 - DEED OF CONVEY FROM CENTEX TO EGV RESOLUTION NO. 67-81 A RESOLUTION ACCEPTING A DEE OF CONVEYANCE FROM CENTEX HQ�ES MIDWEST, INC. wHEREM, the Village of Elk Grove Village has recently adopted an amend-,ent to its Zoning Ordinance thereby establishing an A-3 Ccmbined Muti-Family Recreational District; and WHEREAS, said District requires the conveyance of property to a Municipal entity, which property must consist of a ndnir.m of fifty-five (55%) percent of the total initial area in any newly established A-3 Zoned District; and WHEREAS, the Village of Elk Grove Village has recently granted A-3 Zoning to property owned by Centex Homes Midwest, Inc. , and in accordance with the provisions of the A-3 Zoned District, Centex will convey to the Village a parcel of property legally described on Exhibit A attached hereto, in such form and manner as shall be approved by the Village Attorney and Village Manager; N(m, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: section 1: That the Village of Elk Grove Village hereby accepts the conveyance of a parcel of property legally described on Exhibit A, said conveyance to be in a fonn and manner approved by the Village Attorney and the Village Manager. Failure of such a municipal corporation to either commence construction within three (3) years or to substantially complete same with seven (7) years from the date hereof shall , except as hereafter provided , constitute a breach of this restriction and the Grantor, upon the occurrence of such breach, shall have the right to cause title to the real estate hereby conveyed to REVERT TO THE GRANTOR IN THE FOLLOWING MANNER : (a) Grantor shall , by certified mail , to such grantee at its address as indicated on the deed to such grantee, give notice that this restriction has been breached and shall specify the legal description of the land affected; (b) That if golf course construction has not commenced , or is not substantially completed , as applicable, within ninety (90) days after the date of mailing of said notice, Grantor may at its election record a Declaration of Breach of Restriction with the Recorder of Deeds of the County or Counties in which the property hereby conveyed is located ; (c) That upon the recordation of such Declaration, title to the property hereby conveyed shall revert to Grantor . Notwithstanding anything to the contrary herein contained , in the event that construction of the golf course shall not commence within three (3) years nor be substantially completed within seven (7 ) years and such delay in commencement or substantial completion of construction is attributable to matters reasonably beyond the control of the person or entity owning the property hereby conveyed at the expiration of such three (3) year and seven (7) year periods, respectively , including but not limited to an injunction or injunctions preventing commencement or continuation of improvement or development of the real estate hereby conveyed for golf course purposes, labor shortages, work stoppages, lockouts, strikes, lawsuits, court orders or decrees, tornadoes, hurricanes, floods, lightning , draught , pestilence, famine, war, insurrec- tion, invasion, civil strife, disaster, local or national emergency , or Act of God , then the said three (3) year period and seven (7) year period shall be extended for a period of time equal to the existence of such injunction, strike, or other stoppage or reasonably necessary to overcome the effects of such catastrophe or disaster in the exercise of due diligence and reasonable efforts, it being expressly deemed for all purposes hereof that in the event of such occurrence no breach will have occurred nor may any breach be deemed to have occurred until after the expiration of such extended period of time.
