HomeMy WebLinkAboutRESOLUTION - 45-80 - 4/8/1980 - AGRMT/EG TOWNHOUSE ASSOCIATION IIRESOLUTION N0, 45-80 A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT TO SIGN THE ELK GROVE TOWNHOUSE ASSOCIATION II, AGREEMENT NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois: Section 1. That the Village President be and is hereby authorized to sign the attached documents marked Elk Grove Townhouse Association II, Agreement. , a copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said documents upon the signature of the Village President. Section 2. That this resolution shall be in full force and effect from and after its passage and approval according to law. PASSED this 8th day of April , 1980 . APPROVED this 8th day of April 1980 . President Attest: Vi1�Clerk A G R E E M E N T WHEREAS, the Elk Crove Estates Townhouse Association II, hereinafter referred to as "T. ASSN. II", is the owner of the streets located in the Village, to wit: Bordeaux, Versailles, Dauphine Court and Burgundy Court, together with all public improvements and utilities l.oca`ed on, under or above said streets, and is responsible for the repair and maintenance; and WHEREAS, T. ASSN. II is desirous of dedicating said streets to the Village of Elk Grove Village, as evidenced by a duly enacted Resolution of said Association, dated October 21, 1977; and WHEREAS, the Village of Elk Grove Village, hereinafter referred to as the "VILLAGE" has reviewed the condition of said public improve- ments and finds same to be in need of certain repairs; and WHEREAS, the VILLAGE is willing to accept dedication of said streets and public improvements if said repairs and additional installation as hereinafter set forth are provided for by payment from T. ASSN. II to the VILLAGE. IT IS HEREBY AGREED by and between the parties as follows: 1) That T. ASSN. II will dedicate and convey by plat of dedication and proper bill of sale(and the VILLAGE will accept)the following streets: Bordeaux, Versailles, Dauphine Court and Burgundy Court, together with all utilities and public improvements, including curbs, gutters, sewer lines, water lines, and such other existing public improvements which are presently contained on, under or above said streets. 2) That T. ASSN. II agrees to pay(to the VILLAGE) Nine Thousand Three Hundred Eight -One ($9,381.00) Dollars representing Six Thousand One Hundred Seventy-six ($6,176.00) Dollars for the cost of the five (5) street lights, receipt of which is hereby acknowledged by the Village, and costs not to exceed Three Thousand Two Hundred Five ($3,205.00) Dollars, representing the cost of necessary improvements rendered to said streets and specified on the attached Exhibit A. T. ASSN. II agrees to reimburse the VILLAGE within thirty (30) days from the receipt of any such bills for the improvements to said / streets. -2- 3) That the five (5) street lights to be installed by the VILI,A(:E shall be of the same design as standard street lights found throughout the Village. 4) All ::osis incurred to prepare and record necessary plats of dedication will be p4!d by T. ASSN. II. 5) T. ASSN. II agrees to execute the Grant of Easement attached as Exhibit B, providing the Village with a permanent easement and the perpetual right of privilege to enter upon said property for the purpose of maintaining water and sewer facilities. 6) That notwithstanding the dedication of said private streets as herein provided, T. ASSN. II has the right to retain the responsibilities of providing snow removal for said streets provided that the individual, firm or corporation which T. ASSN. II hires for said purpose is approved by the Village and provides the Village with a Certificate of Insurance in amounts not less than those specified on attached Exhibit C and naming the Village as an additional insured party. 7) Should the T. ASSN. II require Village snow plowing services in lieu of its responsibility to provide snow removal for said streets, the T. ASSN.II shall provide a minimum of twenty-four (24) hours notice to the Village. It is understood by the T. ASSN. II that the Village will not remove (nor be responsible for the accumulation of) snow on sidewalks, driveways or in private parking stalls.
