A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT TO SIGN AN AGREEMENT
WITH THE STATE OF ILLINOIS, ACTING BY AND THROUGH ITS DEPARTMENT OF
TRANSPORTATION, FOR SHARING IN THE COST OF UPGRADING,OPERATING, AND
MAINTAINING THE EXISTING TRAFFIC CONTROL SIGNALS AT THE INTERSECTION
OF ILLINOIS ROUTE 83 AT LANDMEIER ROAD, GREENLEAF AVENUE, PRATT
BOULEVARD, AND DEVON AVENUE
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, State
of Illinois:
Section 1. That the Village President be and is hereby authorized to
sign the attached documents marked Route 83 Traffic Signal
Agreement, a copy of which is attached hereto and made a
part hereof as if fully set forth and the Village Clerk is
authorized to attest said documents upon the signature of
the Village President.
Section 2. That this resolution shall be in full force and effect from
and after its passage and approval according to law.
PASSED this 13th day of May 1980.

Signal Agreanent
This agreement entered into this 1--3t11 day of 7/i -",J_ A.D., 19 /�/l ,
by and between the STATE OF ILLINOIS, acting by and through it's Department of Transportation,
hereinafter called the STATE, and the VILLAGE OF ELK GROVE VILLAGE, of Cook County, of the
State of Illinois, hereinafter called the VILLAGE.
WITNESSETH:
WHEREAS, the STATE, in order to facilitate the free flow of traffic and insure safety
to the motoring public, is desirous of improving the intersections of Illinois Route 83
(FAP Route 872) at Landmeder Road, Greenleaf Avenue, Pratt Boulevard, and Devon Avenue by
modernizing the existing traffic control signals (to be known as STATE Section 1979 -112 -TS
and as VILLAGE Section 80 -00020 -00 -TL), and by performing all other work necessary to complete
the imorovement in accordance with the plans and specifications; and,
WHEREAS, the VILLAGE is desirous of said improvements, in that same will be of immediate
benefit to the residents of the VILLAGE, and permanent in nature; and,
NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties
hereto agree as follows:
1. The STATE agrees to prepare plans and specifications, receive bids, award the contract,
furnish engineering inspection during construction,..and cause the improvement to be
built in accordance with the plans, specifications, and contract. The STATE also agrees
to pay all construction and engineering costs subject to reimbursement by the VILLAGE
as hereinafter stipulated.
2. The VILLAGE agrees to approve the plans and specifications by letter or resolution prior
to the STATE advertising for the work to be performed hereunder.
3. It is mutually agreed that the proportional participation for the construction costs
and engineering costs of these improvements shall be as follows:

4. It is mutually agreed that the estimated construction costs of these improvements
are as follows:

6. It is mutually agreed that the VILLAGE will reimburse the STATE in an amount equal
to the VILLAGE'S share of the actual cost as determined in accordance with Item 3
above. It is mutually agreed that upon award of the contract for this improvement,
the VILLAGE will pay to the Department of Transportation of the State of Illinois,
in a lump sum from any funds allotted to the VILLAGE, i2ittier Hie Meter _nein ___ __..,
an amount equal to'•95% of its obligation incurred under this agreement, and will
pay to the said Department the remainder of its obligation (including any non-
participating costs for FA projects) in a lump sum, upon completion of the project
based upon final costs.
7. The VILLAGE has passed a resolution appropriating sufficient funds to pay its share
of the cost of these improvements, a copy of which is attached hereto as "Exhibit A"
and made a part hereof.
8. It is mutually agreed that the maintenance and the financial responsibility for the
maintenance of the modernized traffic signals shall be borne entirely by the STATE.

9. It is mutually agreed that the financial responsibility for the energy charges for
the operation of the modernized traffic signals shall be divided as follows:

10. The STATE agrees to make arrangements with the local power company to furnish
electrical energy for the operation of the traffic signals and to bill the
VILLF.GE for its proportional share of the energy charges.
11. The STATE retains the right to control the sequence and timing of the traffic
signals.
12. The VILLAGE has adopted and will put into effect, prior to advertising for the
work to be performed hereunder,. an ordinance requiring that parking be prohibited
adjacent to these improvements on the approaches lying within the corporate limits
of the VILLAGE, a copy of which is attached hereto as "Exhibit B" and will, in the
future, prohibit parking at such locations on or immediately adjacent to these
improvements as may be determined to be necessary by the STATE from traffic capacity
studies.
13. The VILLAGE agrees to exercise its franchise right to cause private utilities to be
relocated at no expense to the STATE.
14. The STATE agrees to comply with all applicable Executive Orders and Federal Highway
Acts pursuant to the Equal Employment Opportunity and Nondiscrimination Regulations
required by the U.S. Department of Transportation.
15. This agreement and the covenants contained herein shall become null and void in the
event the contract covering the construction work contemplated herein is not awarded
by June 30, 1983.
16. This agreement shall be binding upon and inure to the benefit of the parties hereto,
their successors and assigns.
