HomeMy WebLinkAboutRESOLUTION - 63-80 - 6/24/1980 - AMENDED & RESTATED ITASCA EG AGRMT RESOLUTION 63-8o AMENDED AND RESTATED ITASCA-ELK GROVE AGREEMENT JURISDICTIONAL COMMON BOUNDARY LINE AGREEMENT WHEREAS, the Village of Elk Grove Village and the Village of Itasca, by their respective Boards of Trustees have agreed in principal concerning the unincorporated territory lying between the two Villages, with respect to future development, annexation, construction of public works, and the like, and WHEREAS, with respect to this agreement the boundaries of Elk Grove Village are entirely North of the center line of Devon Avenue in Cook County, Illinois, and WHEREAS, Itasca has its Northerly boundary at varying distances South of the center line of Devon Avenue all in DuPage County, Illinois, and WHEREAS, the territory referred to in this agreement, lying between the two Villages, is confined on the East by the right-of-way of the Commonwealth Edison high tension lines and confined on the West by Meacham Road, and WHEREAS , the center line of Devon Avenue is the County Line dividing Cook County to the North and DuPage County to the South, divides two grade school districts, two high school districts, two Congressional districts, two State Representative districts, two State Senatorial districts, and otherwise is a natural boundary line in the development of community in- terests, shopping areas, and churches, and WHEREAS, Itasca has adopted several years ago an official map and plan, the Northerly limits of which are the center line of Devon Avenue, and Elk Grove Village is in the process actively of revising an offical map and plan, and WHEREAS, both Villages desire to provide for orderly and planned growth and development and the installation and providing of municipal services and facilities by each within the respective Village limits and the unincorporated territory surrounding each Village, and WHEREAS, each Village believes it to be the best interest of each Village and of both Villages collectively to enter into this agreement whereby each Village can project and plan to attain the objectives both desire, and WHEREAS, the two Villages executed an agreement for the purposes set forth above which was amended and restated on April 6, 1971 , and WHEREAS, the Villages desire to amend and restate the afore- said agreement by the adoption, execution and delivery of this agreement. WHEREAS, after prior notification of the Village of Elk Grove Village, the Village of Itasca previously rezoned the south of said boundary line, north of Thorndale Avenue and east of Interstate Route 290, pursuant to the Village of Itasca Ordinance 79- 4954,excepting the Restricted Area ( as hereinafter defined ) for regional office center use. NOW, THEREFORE, in consideration of the mutual benefits, commitments, promises, and forebearances, the parties agree: 1 . That the center line of Devon Avenue west of its intersection with the Commonwealth Edison right-of-way and east of Meacham Road is hereby established as the boundary line of jurisdiction of the respective Plan Commissions of the Villages who are parties to this agreement, subject to the conditions hereof, and is intended to operate pursuant to the provisions of Chapter 24, Section 11-12-9 of the Illinois Revised Statutes (1965 Edition) . 2. That neither Village shall cross said line with respect to annexation, subdivision, public works, development or similar endeavor involving the respective Villages or requiring the approval and consent of either without first notifying the other and without first having a joint meeting of the corporate authorities of both Villages on the subject matter involved. Said joint meeting shall be conducted with the spirit and intent with which this agreement is entered into and the objectives it intends to accomplish. _ 2 3. (a) The area from 300 feet south of the center line of Devon Avenue north to the center line of Devon Avenue, and east of Interstate Route 290to Arlington Heights Road (the "Restricted Area") may, at the election of the Village of Itasca, continue to be zoned residential or be rezoned for a regional office center, provided however, that if the Restricted Area is zoned for a regional office center the Village of Itasca shall not approve any So�nstruction within the Restricted Area except in accordance with the site plans attached to this agreement as Exhibits ''A" and "B", without the prior notification of the Village of Elk Grove Village. it is understood and agreed that during the course of planning and construction pursuant to said site plans, the Village of Itasca may approve changes in the site plans without the prior notification of the Village of Elk Grove Village provided that no such changes permit: 1 . Buildings of heights more than fifty (50) feet over grade level in the case of Exhibit "A". 2. Buildings of heights more than twenty-five (25) feetover grade level in the case of Exhibit "B". 3. New access to Devon Avenue except as shown on Exhibits "N' and "B" at any intersection of any street in the Village of Elk Grove Village with Devon Avenue, or; 4. Any building closer to the center line of Devon Avenue than shown on Exhibits ''A" and "B". (b) It is further agreed that the Village of Itasca shall not plan, zone or agree to plan or zone any area south of said boundary line, north of Thorndale Avenue and west of Interstate Route 290 other than residential or light industrial uses. Violation of any of these provisions shall render this agreement null and void. 4. This agreement shall be executed in duplicate upon the approval by the respective Board of Trustees of each Village and thereafter each Village Clerk shall , furnish two copies of this agree- ment to the other Village, properly certified. Certified copies of this agreement shall be recorded in the office of the Recorder of Deeds of DuPage County and Cook County, and each clerk shall furnish the other with recording dates and numbers. 5. That the official Map of the Village of Itasca is attached to this agreement and that the official Map of the Village of Elk Grove Village will be attached to this agreement when revised and adopted. 3 IN WITNESS WHEREOF the two Villages, have executed this amended 1566 agreement by the respective Presidents of the Board of Trustees and have caused the corporate seals of each village to be and amended by Resolution No. 27-71 Amendment to Resolution No. 91-66 indicated by underscoring, PASSE and A !BOVED tj)�+s 24th day of June 98 0, AIL WESIDENT E Gr e I g I ] .
