HomeMy WebLinkAboutRESOLUTION - 98-80A - 10/28/1980 - OPPOSING COOK COUNTY REZONING RESOLUTION NO. 98A-80 A RESOLUTION DIRECTED TO THE COOK COUNTY BOARD OF COMMISSIONERS , COOK COUNTY BOARD OF APPEALS, AND THE COUNTY CLERK FOR TRANSMITTAL TO COOK COUNTY BOARD OF COMMISSIONERS PROTESTING THE RE-ZONING OF PROPERTY ON THE NORTH SIDE OF DEVON AVENUE, APPROXIMATELY 1 ,234 FEET WEST OF RIDGE AVENUE WHEREAS, the Petitioners and Owner, George Conlon, of the property legally described as follows: Lots 2.3, and part of 4 in Wm. Lumpp' s Devon Ave. Farms sub. in Section 33, Township 41 North, POB on N. line of Lot 4, 35.2 ft. E. of N.W. of Lot 4, thence Southerly 618. 12 ft. to new N. line of Devon Ave. thence Westerly 305. 14 ft.thence northerly along W. line of Lot 2 to N. line of Lot 2, thence E. 378.2 ft to POB E. of 3rd PM. have petitioned for re-zoning of same from R-4, Single Family Resident District to 1 -1 , Restricted Industrial District, to permit the,_ use of the property as a Contractor' s Yard; and WHEREAS, said case has been docketed as Docket Number 3577 by the Cook County Zoning Board of Appeals; and WHEREAS, the Village of Elk Grove Village is contiguous to this property on the north side. NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois. Section 1 . That the Village of Elk Grove Village does hereby register objections to the petitioner' s request for the re-zoning of the subject property described above for the following reasons: a. The Elk Grove Village Comprehensive Plan and Official Map adopted on October 22, 1968 and duly filed with the Cook County Clerk declares said land to be within our future annexation plans and for it to be within the corporate limits of Elk Grove Village, with an R-3 Zoning classification. The proposed industrial use is inconsistant with the Official Map. b. That the Village of Elk Grove Village and the City of Wood Dale adopted a jurisdictional common boundary line agreement on May 8, 1973 that requires the subject property to be zoned residential unless otherwise agreed upon by both municipalities. A true and correct copy of this agreement was presented as evidence at the Public Hearing by the Cook County Zoning Board of Appeals held on October 17, 1980. C. If developed as an unincorporated area, the subject property would not be adequately served by essential urban services such as Police protection, Fire Protection, Ambulance service, Water supply and Street services. - 1 - d. That the best and most suitable use of the property is that of single family residence, the development of which has not even been enter- tained by the owner; that the Village therefore requests the denial of the application. Section 2. That this resolution shall be in full force and effect from and after its passage and approval according to law. Section 3. That the Village Clerk' s Office is hereby directed to submit the foregoing resolution to all governmental bodies have jurisdiction and an interest in the development of the premises as set forth above and as set forth in the caption thereto.
