HomeMy WebLinkAboutRESOLUTION - 121-80 - 12/16/1980 - UTILIZATION OF MINORITY BUS ENTERPRISERESOLUTION NO. 121_80 A RESOLUTION REGARDING UTILIZATION OF MINORITY BUSINESS ENTERPRISE NOW, TEEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois: Section 1. That the Village President be and is hereby authorized to sign the attached documents marked, a Resolution Regarding Utilization of Minority Business Enterprise, a copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said documents upon the signature of the Village President. Section 2. That this resolution shall be in full force and effect from and after its passage and approval according to law. PASSED this 16th day of December , 1980. APPROVED this 16th day of December , 1980, Attest: Villagef'Clerk Village of Whereas, the Elk Grove Village ii 3s applied for a Federal grant to fund in part the Step I Facilities Plan and Whereas, as a condition of the grant off^r, the Cti'1`;;X (Village) of Elk =rove Villaneintends to comply with the regulations contained in 40 CFR 35.91including the use of Minority Bus;noss Enterprises 35.937 and 35.939 and Whereas, as a condition of the grant offer, the 9111 (Village) of Elk Grove Villageintends to implement. the USEPA Region V goal of 10 percent to 15 -percent of the total dollar amounts for consultant services to be expend id for Minority business Enterprise> in accordance with the December 26, 1973 Federal Register. Therefore, be it resolved that each subagriement for consulting service for EPA funded projects contain the following section: 1. Tho (Xi4Ky (Village) herein agrees that a minimum of 10 percent of the contract shall be for services of qualified Minor itAusiness Enterprisa in accordance with the DecemUr 26, 1978 Federal Reqister. 2. To achieve the MBE goal, Engineer shall provide maximum opportunities for MBE participation, notwithstanding the fact that the firm may have the capability to complete the project without the use of subcontractors. 3. The consultant shall submit to the owner the information regarding MBE's in the following format: Name of MBE firm: Address: Phone: Type of A & E Consulting: Arount of Subcontract: 4. Where. the Engineer fails to achieve the MOE goal, it shall provide documentation of its good faith attempts to solicit MBE participation. This documentation shall be presented to the owner, who in turn will forward it to EPA. The documented evidence of good frith must include at least the following: a. Documentation of efforts to solicit the participation of MO E firm;. Such documentation should include, but is not limited to: list of firms contacted, copies of solicitation letters, de`cripfjors of hcw Contact wa4 made, l.e,, by mail, telegram, phone, personal visit, etc. b. Dor: rmer,:a ion cf whether any offer; were received from MBE firms. c. Documentation of negotiation with r3E firms from whom offers were received. Page 2 d. In each subcontract specialty area in which an MBE proposal was received, documentation of whether the subcontract was awarded to the MBF firm, including the dollar amount, of the subcontract. e. If the subcontract was not awarded to an MBE firm, an explanation of why the contract could not he awarded to the MBE firm. f. Any additional documentation supporting the Engineer's adherence with the MBE positive efforts requirements. Resolved this 16th day of December 1980.
