A RESOLUTION ACCEPTING FOR PERMANENT MAINTENANCE AND OWNERSHIP ALL PUBLIC
STREETS IN THE ELK GROVE INDUSTRIAL PARK AND ACCEPTING A DEED OF CONVEYANCE
AND A TWO YEAR MAINTENANCE BOND FOR STREETS AND PUBLIC IMPROVEMENTS
WHEREAS, the developer of the Elk Grove Industrial Park has submitted a
Bill of Sale and a Maintenance Bond in the amount of $28,000.00 from the North
River Insurance Company, expiring on May 1, 1981, to the Village of Elk Grove
Village as required by the Subdivision Control Ordinance and has fully complied
with all provisions of any and all ordinance appertaining; and
WHEREAS, the developer has installed all public improvements as required
by the Village, has made full payment of fees, and has submitted required As -
Built -Engineering Plans.
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of
the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois:
Section 1. That the Village of Elk Grove Village does hereby accept a Bill
of Sale and Maintenance Bond No. 6100091973 for public improvements as shown on
Elk Grove Engineering Company Plan No. 6174 Sheets 1 through 10, dated August 5,
1971, Plan No. 6174-3, sheets 1 through 7 dated December 14, 1971, and Plan No.
6174-4 sheets 1 through 5, dated August 9, 1972 and otherwise described as Elk
Grove Industrial Park.
Section 2. That this resolution shall be in full force and effect from
and after its passage and approval according to law.

THIS INDENTURE WITNESSETH: THAT LASALLE NATIONAL BANK, a
national banking association, not personally, but as Trustee under the provisions of a
Trust Agreement dated March 14, 1969 and known as Trust No. 39270 (hereinafter some-
times referred to as the "Trustee"), for andin consideration of the sum of Ten Dollars
($10.00) and other good and valuable consideration in hand paid, the receipt and sufficiency
of which are hereby acknowledged, does hereby grant, bargain, sell, transfer, set over,
assign, convey and deliver unto THE VILLAGE OF ELK GROVE VILLAGE, Cook and
DuPage Counties, Illinois, a municipal corporation (hereinafter sometimes referred to as
the "Village"), the following:
Street paving, curbs, gutters, public sidewalks, water mains, sanitary sewer,
and storm mains and drains and equipment, all of said improvements having been
installed in accordance with engineering plans prepared by Elk Grove Engineering
identified as Plan Number 6174, Sheets 1 through 10, dated August 5, 1971 (original
date July 12, 1969), plans prepared by Elk Grove Engineering identified as Plan
Number 6174-3, Sheets I through 7, dated December 14, 1971 (original date
February 27, 1970), and plans prepared by Elk Grove Engineering identified as
Plan Number 6174-4, Sheets 1 through 5, dated August 9, 1972, such work having
been installed on streets or easements having been dedicated or granted to the
Village of Elk Grove Village on one or more of the following recorded plats;
1. Elk Grove Industrial Park Unit 1, recorded on January 2, 1970, as Document
No. R70-98 (Lively Boulevard),
2. Elk Grove Industrial Park Unit 2, recorded on April 19, 1971, as Document
No. R71-15196 (Mark Street west of Lively Boulevard),
3. Elk Grove Industrial Park Unit 3, recorded on June 15, 1972, as Document No.
R72-32543 (Mark Street east of Lively Boulevard),
4. Elk Grove Industrial Park Unit 4, recorded on August 22, 1972, as Document
No. R72-50014 (Section Kirk Street),
5. Elk Grove Industrial Park Unit 5, recorded on December 12, 1972, as Document
No. R72-75879 (Sections Kirk Street and Katherine Way),
6. Elk Grove Industrial Park, Unit 6, recorded on June 29, 1973, as Document No.
R73-39167 (Devon Avenue),
7. Plat of Dedication of Public Street, recorded on July 20, 1973, as Document No.
R73-44866 (Mark Street Extension west of Lively Boulevard),

No. R73-64926 (Mark Street Extension east of Katherine Way),
9. Elk Grove Industrial Park Unit 9, recorded on December 6, 1973, as Document

Street Cul-de-sac),

12. Plat of Dedication for Easement Purposes, recorded January 22, 1976, as
Document No. R76-04728,
which plans are incorporated by reference and made a part hereof, and any additions
thereto and improvements thereon and easements for construction, re -construction, and
maintenance as are necessary to operate and maintain the aforesaid streets, curbs,
sidewalks, mains, drains and equipment.
TO HAVE AND TO HOLD all of the property hereby granted, bargained, sold,
transferred, set over, assigned, conveyed, and delivered unto the Village, its successors

That we, ELK GROVE VILLAGE INDUSTRIAL PARK, LTD., as Principal, and
THE NORTH RIVER INSURANCE COMPANY,
as Surety, are held and firmly bound unto the VILLAGE OF ELK GROVE VILLAGE, ILLTNTOIS,
as Obligee, in the sum of TWENTY-EIGHT THOUSAND AND NO/100 DOLLARS ($28,000.00)
lawful money of the United States, for the payment of which sum well and truly to be made,
we hereby bind ourselves, our successors and assigns, jointly and severally, firmly by these
presents.
WHEREAS, the Principal has constructed in the Elk Grove Industrial Park, Elk
Grove Village, Illinois, street paving, curbs, gutters, public sidewalks, water
mains, sanitary sewer, and storm mains and drains and equipment, all of said
improvements having been installed in accordance with engineering plans prepared
by Elk Grove Engineering identified as Plan Number 6174, Sheets 1 through 10,
dated August 5, 1971 (original date July 12, 1969), plans prepared by Elk Grove
Engineering identified as Plan Number 6174-3, Sheets 1 through 7, dated December
14, 1971 (original date February 27, 1970), and plans prepared by Elk Grove
Engineering identified as Plan Number 6174-4, Sheets 1 through 5, dated August 9,
1972, such work having been installed on streets and easements having been
dedicated or granted to the Village of Elk Grove Village.
WHEREAS, said Obligee requires that the Principal shall furnish a bond conditioned to
guarantee against all defects, workmanship and materials during a period of two years
from the effective date of this bond, and, the said Principal shall maintain, repair or
replace any of the said public improvements which deteriorate or fail to meet performance
or operating standards during the bond term ending May 1, 1981 and further, shall pay
any penalties which may be incurred as a result thereof.
NOW, THEREFORE, the condition of the foregoing obligation is such that if the Principal
shall indemnify the Obligee for all loss that the Obligee may sustain by reason of the
Principal's failure to comply with any of the conditions of this guarantee, then this
obligation shall be void; otherwise it shall remain in force.
