AN AGREEMENT FOR INTERIM BACK-UP FIRE
PROTECTION AND EMERGENCY SERVICE ASSISTANCE
WHEREAS, The ELK GROVE RURAL FIRE PROTECTION DISTRICT, a municipal
corporation organized under the laws of the State of Illinois (hereinafter
referred to as the "District") , is in the process of establishing its own
fire department (hereinafter referred to as the (District's Department")
by contract or otherwise; and
WHEREAS , the acquisition of equipment, facilities, and manpower by
the District will take time; and
WHEREAS, the District is desirous of establishing and maintaining its
own professional fire fighting capability to the end that the residents in
the District can be assured of adequate protection; and
WHEREAS , the VILLAGE OF ELK GROVE VILLAGE, a municipal corporation of
the State of Illinois (hereinafter referred to as the "Village'') , is desir-
ous of cooperating with the District in an affort to aid the District, on an
interim basis, to achieve its goals.
NOW, THEREFORE, IT IS AGREED BY AND BETWEEN THE VILLAGE AND THE DISTRICT
AS FOLLOWS:
1 . That for the period beginning October 1st, 1979 through November 30, -1979,
the Village and the Elk Grove Village Fire Department, (hereinafter referred
to as the "Village's Department") will furnish initial and back up fire fighting
and emergency ambulance service to the District and the District's Department
pursuant to the following conditions and stipulations:
A. That the District will not object to any annexation of the lands
' or territories or parts thereof lying within the District by the
Village, which lands and territories are delineated on Exhibit A,
attached hereto and made a part hereof.
B. That the District's Department and the District will be solely
responsible for all fire fighting and other emergency services
including emergency ambulance service within the corporate limits
of the District, subject to the following:
1) Upon receipt of notification (whether from the District's
Department or elsewhere,) the Village' s Department will
make automatic and initial response to those areas delineated
by diagonal hatching on Exhibit A, attached hereto subject
to the following:
a) It is understood, however, that in the event the Village' s
Department is committed to other emergencies, the Village
(at the discretion of the Village' s Officer in Charge)
shall not be responsible to provide the services con-
templated to be rendered under the terms of this agreement.
b) The Village is authorized to dispatch such equipment and
manpower as is dedmed necessary, in the discretion of the
Village, to handle any such response or call for aid.
c) That the Village will be paid on a per call bssis at the
rate of One Hundred Dollars ($100.00) per apparatus or
ambulance per hour or portion thereof. Time shall be
measured from receipt of alarm to the return of the
equipment to its station. The District shall pay the
Village within thirty days of the receipt of the Village's
invoice therefor. Failure to make such timely payment
will result in the automatic cancellation of this agree-
ment and notice of such cancellation shall be provided to
the District no later than 5-days prior to the effective
date of such cancellation.
2) With respect to all areas of the District other than those areas
described in 8. 1) above, the Village's Department is not respon-
sible for initial and automatic response to such areas but will
provide such back-up apparatus and equipment as is requested by
the District' s Department subject to the following:
` a) It is understood, however, that in the event the Village's
Department is committed to other emergencies, the Village
(at the discretion of the Village's Officer in Charge)
shall not be responsible to provide the services con-
templated to be rendered under the terms of this agreement.
b) That upon arrival of any equipment of the Village at the
scene of any given emergency, the Senior Officer of the
Village' s Department at the scene or his representative
shall have the sole and exclusive authority and respons-
ibility to direct and control the members of. the Village's
Department in its firefighting, fire protection, and other
emergency operation carried on at the scene of any alarm

or emergency. That upon the arrival of any such equip-
ment of the Village's Department at any such scene of
any alarm or emergency within the said territory of the
District, the Village' s Department will provide fire
fighting and other emergency services in accordance
with this agreement and the procedures and regulations of
the Village's Department
c) The Village' s Department will provide emergency ambulance
service to the nearest hospital , provided the unit is
available.
d) The Village will be paid on a per call basis at the
rate of Two Hundred Dollars ($200.00) per apparatus o:r
ambulance per hour or portion thereof. Time shall be
measured from receipt of alarm to the return of equipment.

thirty days of the receipt of the Village's invoice therefor.
Failure to make such timely payment will result in the
automatic cancellation of this agreement and notice of such
cancellation shall be provided to the District no later than

C. That the District shall hold harmless the Village and the Village's
Department as well as all of the Officers, agents and/or employees
of the Village from and against any and all losses and damages, suits,
liabilities and/or payments or expenses resulting from or in respect
to the aforesaid fire fighting and other emergency services except for
claims based on intentional Tortious conduct by Village, the Village's
Department, its Officers, agents and/or employees under this agreement.
2. That the District and the Village will make all reasonable efforts to
record all calls for aid by means of an automated system which shall include the time
such calls were received by the respective fire department of each.
3. The District will provide the Village and the Village's Department
current maps of the corporate limits of the District.
4. That within seven (7) days of receipt of any notice of annexation by
any municipality of land and territory within its district, the District shall
forward a copy of said notice to the Village by addressing same to the attention
of the

5. This contract and the services called for herein will terminate
at 12:01 a.m.December 1 ,, 1979, without further notice.
IN WITNESS WHEREOF, the parties hereto have caused this agreement to
be executed by their respective Officers this 2Sth day of September-
1979.
