A RESOLUTION AUTHORIZING UNTIL OCTOBER 31, 1978 THE CONTINUATION
OF ARTICLES OF AGREEMENT BETWEEN THE VILLAGE OF ELK GROVE VILLAGE
AND THE FOREST VIEW FIRE PROTECTION DISTRICT
WHEREAS, Ordinance No. 1174, adopted September 27, 1977, established a
schedule of rates to be charged for fire and ambulance services to persons
located outside the Corporate Limits of the Village of Elk Grove Village, and
WHEREAS, Resolution No. 71-77, adopted September 27, 1977, authorized
the Village President and Village Clerk to sign a Contract entitled "Articles
of Agreement between the Village of Elk Grove Village and the Forest View Fire
Protection District" which was based on the rate established by Ordinance No.
1174 of $54.00 per dwelling unit for the peroid November 1, 1977 to October
31, 1978, and
WHEREAS, there has existed since 1973 a similar Contract and Articles of
Agreement with the Forest View Fire Protection District for fire and ambulance
services at $42.00 per dwelling unit and containing a clause requiring a notice
to a rate increase 90 -days prior to the end of a Contract period, and
WHEREAS, the required 90 -day notice was not given of the new rates set by
Ordinance No. 1174.
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of
the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois:
Section 1: That Resolution No. 71-77 is hereby rescinded.
Section 2: That the President and Board of Trustees hereby authorize
continuation until October 31, 1978 of the Articles of Agree-
ment executed on August 23, 1973 pursuant to Resolution No.
93-73 which provides fire and ambulance services to the Forest
View Fire Protection District at a rate of $42.00 per dwelling
unit.
Section 3: That said August 23, 1973 Contract and Articles of Agreement
shall cease to be valid as of midnight on October 31, 1978•
Section 4: That after October 31, 1978 any renewal or extension of a
Contract for fire and ambulance services to the Forest View
Fire Protection shall reflect a rate of not less than $54.00
per dwelling unit per year.
Section 5: That the Officer's and Attorney of the Forest View Fire
Protection District shall be furnished certified copies of
this Resolution for the explicit purpose of informing them
of this action and to provide them with more than 90 days
of notice of a pending rate increase for any Contract that
may be executed for the period after October 31, 1978.
Section 6: That this Resolution shall be in full force and effect from
and after its passage and approval according to law.
