HomeMy WebLinkAboutRESOLUTION - 67-78 - 8/29/1978 - MAYFAIR IND PARK/PUBLIC IMPROVEMENTS RESOLUTION No. 67-78 A RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS IN THE MAYFAIR INDUSTRIAL PARK WHEREAS , all required public improvements have been constructed according to Village standards and approved engineering plans in the Mayfair Industrial Park; and WHEREAS, the developer has repaired and maintained said improvements since 1972, and, in 1977 installed a third lift of asphalt surface course on the streets according to Village requirements. NOW, THEREFORE , BE IT RESOLVED, that the President and Board of Trustees, do hereby: Section 1 . Accept for Village ownership and maintenance through a Bill of Sale, dated August 24, 1978, for the following public improvements as shown on Engineering Plans dated December 6, 1968, prepared by Elk Grove Engineering Company and located in dedicated rights-of-way: A. Water mains, Valves and Hydrants; B. Sanitary sewers and manholes; C. Storm sewer mains, inlets and manholes; D. Street base, paving and curbing; E. Public sidewalks. Section 2. Waive the Village Subdivision requirement for a two year maintenance bond. Section 3. Authorize the release and return of a $20,000.00 Letter of Credit dated November 26, 1973 for a third lift of pavement, to the First Arlington National Bank, Arlington Heights, Illinois, said instrument was received pursuant to Village Resolution No. 132-73 on November 27, 1973. Section 4. Declare null and void and release and return a $100,000.00 Letter of Credit dated November 26, 1973 for the completion of public improvements to the First Arlington National Bank, Arlington Heights, Illinois, received pursuant to Village Resolution No. 131-73. Section 5. Authorize the release and return of a $173,000-00 Performance Bond P12-0120-1136-70 dated February 25, 1970 for the installation of public improvements to the United States Fidelity and Guaranty Company, Chicago, Illinois, said instrument was received pursuant to Village Resolution No. 40-70 on April 14, 1970. Section 6. This resolution shall be effective and valid upon passage and approval by the President and Board of Trustees, Village of Elk Grove Village, Illinois. PASSED this— 29th day of August 1978. A"I", Vil lage �.�es are t ATTEST: Viflage f.Aerk i�' 2 DEED OF CONVEYANCE AND BILL OF SALE THIS INDENTURE WITNESSETH: FIRST ARLINGTON NATIONAL BANK, a National Banking Association, not personally but as a Land Trustee under the provisions of a Deed or Deeds in Trust duly recorded and delivered to said Bank in pursuance of a Land Trust Agreement dated May 1 , 1973, and known a.s Land Trust No. A-338 (hereinafter sometimes referred to as "Seller") , for and in consideration of the sum of Ten Dollars ($10. 00) and other good and valuable consideration in hand paid, the receipt and suffi- ciency of which are hereby acknowledged, does hereby grant, bar- gain, sell, transfer, set over, assign, convey and deliver unto THE VILLAGE OF ELK GROVE VILLAGE, Cook and DuPage Counties , Illi- nois , a Municipal Corporation (hereinafter sometimes referred to as the "Village" ) the following: Mayfair Industrial Park improvements, according to the engineering drawings prepared by Elk Grove Engineering , dated December 6, 1968. TO HAVE AND TO HOLD all of the property hereby granted, bargained, sold, transferred, set over, assigned, conveyed, and delivered unto the Village, its successors and assigns , to and for its own use forever; AND the Seller does hereby covenant with the Village that it is the lawful owner of and has good and marketable title to said properties hereby granted, bargained, sold, transferred, set over, assigned, conveyed and delivered, that said property is free from all encumbrances; that the Seller has good right to sell the same as aforesaid; that it will warrant and defend said property against the lawful claims and demands of all persons; 2 that the representations as made herein are not made personally but as the Land Trustee under the Land Trust Agreement as herein- above stated. This conveyance is made by the Seller pursuant to a Letter of Direction duly executed bv the beneficiary of said Land Trust as hereinabove set forth.
