Home My WebLink AboutRESOLUTION - 81-78 - 10/10/1978 - WINDY CITY GARDEN SUB/LOC RESOLUTION NO. 81-78 A RESOLUTION ACCEPTING A LETTER OF CREDIT IN LIEU OF A PERFORMANCE BOND FROM THE BANK OF LINCOLNWOOD, GUARANTEEING THE CONSTRUCTION OF PUBLIC IMPROVEMENTS AND SURFACE COURSE REQUIREMENTS FOR WINDY CITY GARDENS SUBDIVISION, LOCATED ON THE WEST SIDE OF ARLINGTON HEIGHTS ROAD NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois: Section 1 . That the President and Board of Trustees do hereby authorize the acceptance of a Letter of Credit in the amount of $97,858.00 from the Bank of Lincolnwood, guaranteeing the construction of public improvements at Windy City Gardens Subdivision, said improvements as shown on Exhibit "A" attached hereto and made a part hereof. Said property located on the west side of Arlington Heights Road and north of Parkchester Road. Section 2. In the event the improvements are not completed by September 11 , 1979, said funds will be released for the purpose of completing the improvements specified in Exhibit "A". Section 3. That this resolution shall be in full force and effect from and after its passage and approval according to law.- PASSED aw.PASSED this loth day of October 1978. In the event the improvements are not completed by May 11, 1979, we will, at your demand, release said funds to you for the purpose of completing the improvements specified in Exhibit A attached hereto, upon submission by you of appro- priate contractor's sworn statements and mechanic's lien waivers indicat- ing that the costs of improvements for which such statements and waivers have been submitted equal the amount of funds requested by you to be released. Drafts drawn under and in compliance with the aforementioned terms and provisions of this Letter of Credit will be duly honored if presented to the Bank of Lincolnwood before September 15, 1979.
