A RESOLUTION APPROVING THE FINAL PLAT
OF SUBDIVISION FOR THE SCHMIDT ANNEXATION
AS TO FORM
WHEREAS, the Village of Elk Grove Village has by Ordinance No.
1240 approved the annexation of the 120-acre Schmidt farm with an
effective date of October 31, 1978 ; and
WHEREAS, the owner/developer is further requesting an extension
of the effective date of that Ordinance up to and including November 15 ,
1978; and
WHEREAS, in order for the developer to close his transaction with
the present owner and, thus , obtain all necessary signatures on the
Annexation Agreement, it is necessary that the developer give evidence
to the bank of the Village' s approval as to form of the developer' s
Plat of Subdivision; and
WHEREAS, it is understood that an approval as to form is not a
formal approval as such is not possible when the property is not
formally annexed, but does bind the Village to formally accept the
same Plat of Subdivision once the Annexation Agreement is executed and
all ordinances of the Village have been complied with;
NOW, THEREFORE, BE IT RESOLVED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
Du Page Counties, Illinois, as follows:
Section 1 : That the final Plat of Subdivision attached hereto as
Exhibit A and made a part hereof is approved as to form only.
Section 2 : That at such time as the Annexation Agreement with the
owner and developer is fully executed and all applicable Village
ordinances have been complied with, the President and Board of Trustees
will formally accept said Plat of Subdivision and authorize the President
and Village Clerk to sign the Plat and attach the Corporate Seal.
Section 3 : That this Resolution shall be in full force and
effect from and after its passage and approval according to law.
