HomeMy WebLinkAboutRESOLUTION - 11-77 - 2/22/1977 - THOMPSON ELEVATOR INSPECTION SERVICERESOLUTION NO. 11-77 A RESOLUTION AUTHORIZING THE VILLAGE PRESIDENT AND VILLAGE CLERK TO SIGN A CONTRACT FOR INSPECTION BETWEEN THE VILLAGE OF ELK GROVE VILLAGE AND THOMPSON ELEVATOR INSPECTION SERVICE TO PROVIDE FOR INSPECTION OF DUMBWAITERS PASSENGER AND FREIGHT ELEVATORS NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois: Section l: That the Village President be and is hereby authorized to sign the attached document marked "Contract for Inspection" between Thompson Elevator Inspection Service, 1302 East Thayer, Mount Prospect, Illinois and the Village of Elk Grove Village,to provide for mechanical and electrical inspection of all safety devices and equipment on dumbwaiters, passenger and freight elevators for the Village of Elk Grove Village as set forth in said "Contract for Inspection", a copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said document upon the signature of the Village President . Section 2: That this resolution shall be in full force and effect from and after its passage and approval according to law. PASSED this 22nd day of February , 1977. APPROVED this 22nd day ATTEST: Village C erk CONTRACT FOR INSPECTION Thompson Elevator Inspection Service, 1302 East Thayer, Mount Prospect, Illinois 60056, will perform a mechanical and electrical inspection of all safety devices and equipment on dumbwaiters, man lifts; moving stairways, passenger and freight elevators, for the Village of Elk Grove Village. The number of inspections will be determined by the Village. Inspection will be made in accordance with the Municipal of County Code or Ordinance covering operation of said elevators at the addresses provided by the Code Enforcement Official of this Village. Fees to be charged would be in accordance with the Fee Schedule attached to and made a part of the Agreement; it being understood and agreed that the Schedule as shown applies to each elevator inspected. Thompson Elevator Inspection Service will provide all insurance necessary to cover its employees who are performing under the terms of this Agreement. Thompson Elevator Inspection Service agrees to hold harmless and indemnify the Village or City for any and all acts of neglect performed by it which in anyway result in liability to said Village or City. Thompson Elevator Service shall furnish a liability insurance policy in the amount of -$1,500,000 insuring it with this contract, including indemnification agreement. At conclusion of inspection services, report will immediately be made to the Code Enforcement Official of the results of such inspection upon the Inspection Sheet hereto attached and made a part hereof, and the responsibility for taking action for the repair, replacement, alterations, or any other work indicated as necessary under said Inspection Report shall be the whole responsibility of the Code Enforcement Official. Receipt for such report shall be given to Thompson Elevator Inspection Service. It is agreed that Thompson Elevator Inspection Service does not assume possession or control of any part of the equipment inspected but such remains that of the owner thereof. Thompson Elevator Inspection Service repre- sents that it has made no examination of the equipment other than that necessary to do the work described hereinbefore and assumes no responsibility for any part of the equipment insofar as its mechanical functioning or use is concerned. Nothing in this agreement should be construed to mean that Thompson Elevator Inspection Service assumes any liability for loss or damage because of bodily injury (including death) or property damage arising under this agreement except loss or damage directly resulting from the negligent acts or omissions of Thompson Elevator Inspection Service, or its employees in performing the services to be provided under the terms of this Agreement. Under no circumstances shall Thompson Elevator Inspection Service be liable for consequen- tial damages or for damages caused by the negligence of others - whether arising under contract or tort. 2. M It is understood and agreed that completion of inspection services by Thompson Elevator Inspection Service hereunder, and submission of its Inspection Report will con- stitute complete and full performance by said Thompson Elevator Inspection Service under the terms of this Agreement, and it shall have no responsibility or obligation thereafter for the performance or doing of any necessary repairs, altera- tions, installations, or other work indicated as necessary by such Inspection Report.
