Consideration to award a construction contract to the lowest responsive and responsible bidder, RW Collins Co, of Chicago, IL for the Underground Fuel Storage Tank Removals and Abandon in Place project in the amount of $45,045 from the Capital Projects Fund. (On Tuesday, January 27, 2026, the Village opened sealed bids for the Underground Fuel Storage Tank Removals and Abandon in Place project. (The work includes the removal of three (3) 10,000-gallon fiberglass underground fuel storage tanks, obtaining permits for the excavation, removal, demolition, and destruction of the underground storage tanks at 1635 Biesterfield Public Works Fleet Facility. The project will also include the abandoning in place of a 4,000-gallon fiberglass gasoline storage tank, and removal of fuel dispensing equipment at Fire Station 7. (A total of three (3) contractors obtained bid documents with two (2) contractors submitting bids. (The lowest responsive and responsible bid was received from RW Collins Co, of Chicago, IL in the amount of $45,045. (Adequate funds are available in the Capital Projects Fund. (The Director of Public Works recommends approval.) Pagel of 4 b. Consideration to adopt Ordinance No. 3930 authorizing the Mayor and Village Clerk to execute an agreement for the Village of Elk Grove Village to join the Suburban Tree Consortium. (The Suburban Tree Consortium was founded in 1985. (The STC consists of forty-eight (48) members and leverages buying power through economies of scale with area nurseries. (Participation in the consortium will allow the Village to order trees up to five years in advance, while not being contractually locked into purchasing those trees should program needs, budgets, or priorities change. (Membership in the Suburban Tree Consortium requires an annual fee of $575. In order to participate, the Village must adopt an ordinance authorizing membership in the consortium. (The Director of Public Works recommends approval.) c. Consideration to adopt Resolution No. 6-26 accepting a Deed of Conveyance/Bill of Sale and Maintenance Bond No. SBP150539_002, in the amount of $34,130 expiring May 1, 2028, guaranteeing the maintenance of the public improvements for the Prime Data Centers Development. (The public improvements at the Prime Data Centers development were completed in October of 2025. (The maintenance bond guarantees the watermain and sidewalk improvements for a period of two (2) years. (The Director of Community Development recommends approval.) d. Consideration to adopt Resolution No. 7-26 authorizing the Mayor and Village Clerk to execute an Intergovernmental Agreement between the Northwest Water Commission and the Village of Elk Grove Village. (The Village and Northwest Water Commission (NWC) wish to enter into an intergovernmental agreement to determine the feasibility of an emergency water supply connection between Elk Grove Village and NWC. (The Village currently receives Lake Michigan water as its primary source from Northwest Suburban Municipal Joint Action Water Agency (NSMJAWA). This emergency water supply connection to NWC would serve as a redundant supply of Lake Michigan water. (The Village will pay a lump sum fee of $65,000 that will include all costs, fees, and expenses associated with the technical feasibility study performed by NWC's hydraulic modeling firm Burns & McDonnell. (The Director of Public Works recommends approval.) e. Consideration to adopt the following: • Resolution No. 8-26 designating an area as blighted and in need of renewal for the Real Property commonly known as 610-620 Meacham and 1630 Biesterfield Roads. r Resolution No. 9-26 authorizing the Mayor to execute a Letter of Receipt stipulating the terms of an agreement for an application seeking a Cook County Class 7B Property Tax Exemption status pursuant to the Cook County Real Page 2 of 4 Property Classification Ordinance as amended July 27, 2018 for certain real estate located at 610 Meacham, 620 Meacham, and 1630 Biesterfield Roads. (The Law Offices of Verros Berkshire, on behalf of SC Elk Grove, LLC, (Applicant) is seeking a Cook County Class 7B property tax exemption for property located at 610-620 Meacham Road, and 1630 Biesterfield Road. (The Applicant intends to construct an 86,000 square foot two-story ice hockey arena consisting of two NHL -sized rinks, 16 locker rooms, study area, gym, a restaurant, a physical therapy clinic, and a "grab and go" market. Phase Two of the development will include retail food businesses in the two outlots located at 620 Meacham Road and 1630 Biesterfield Road. (The Applicant plans to invest over $34.8 million to construct the Elk Grove Ice Arena and two outlots, and the development as a whole is projected to create 42 full-time and 80 part- time positions. (The eligibility requirements for 7B status are new construction, substantial rehabilitation, or buildings that have been vacant for a period of time. This site qualifies as it is new construction. (The subject area has been determined to satisfy the five statutory eligibility factors required to establish that the area is in need of commercial development and qualifies for the inclusion of commercial projects with total development costs, exclusive of land acquisition, in excess of $2 million. (Property approved for Class 7B status allows the owner of the property to have the assessment level lowered for a period of twelve years. The assessment schedule is 10% of fair market value for ten years, then 15% in the eleventh year and 20% in the twelfth year. Industrial property is currently assessed at 25% of fair market value in Cook County. (Upon approval, the Director of Business Development and Marketing will issue a Letter of Receipt to the Applicant. The Letter of Receipt will allow the Applicant to file an application with Cook County. Final approval is at the discretion of the Village Board and contingent on the Applicant completing the improvements stated in their application. (The Director of Business Development and Marketing recommends issuing a Letter of Receipt.) 7. REGULAR AGENDA 8. PLAN COMMISSION - Village Manager Roan a. Page 4 of 4 ORDINANCE NO: AN ORDINANCE AUTHORIZING THE ACCEPTANCE OF THE CONTRACTS AND BY-LAWS FOR THE PARTICIPATION IN THE SUBURBAN TREE CONSORTIUM WHEREAS, the Village of Elk Grove Village has pursued a vigorous tree replacement program and promoted the forestation of vacant parkways, recognizing the aesthetic and environmental importance of trees in the community; and WHEREAS, Chapter 65 of ILCS 511 1-73.1-1 entitled "Municipal and Joint Municipal Tree Planting Programs", authorizes municipalities to jointly enter into long term contracts for the purchase and delivery of trees; and WHEREAS, the Village of Elk Grove Village has a concern about the diminishing supply of adequate and varied tree stock available at reasonable prices in the Metropolitan Chicago area; and WHEREAS, the Suburban Tree Consortium Agreement and the Suburban Tree Consortium Act is a long-term plan for the planting of trees on property located within the municipality; NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Illinois as follows: SECTION 1. That the Mayor and Village Clerk are hereby authorized to accept on behalf of the municipality the contracts and bylaws of the Suburban Tree Consortium. A copy of the contracts and bylaws as currently amended are appended to and made part of this Ordinance for Membership as Exhibit A. SECTION 2. The participation of this governmental entity, as a member of the association, shall commence on the date membership of this community is accepted by the Board of Directors of the Suburban Tree Consortium. The municipality shall appoint a representative to the STC Board. SECTION 3. This ordinance shall be in full force and effect from and after its passage and approval as by Statute in such case made and provided. A RESOLUTION ACCEPTING A CERTIFICATE OF APPROVAL AND INITIAL ACCEPTANCE, A DEED OF CONVEYANCEBILL OF SALE FOR PUBLIC IMPROVEMENTS, AND A MAINTENANCE BOND FOR CERTAIN PUBLIC IMPROVEMENTS CONSTRUCTED IN CONNECTION WITH THE PRIME DATA CENTERS ORD-1- PHASE 1 DEVELOPMENT WHEREAS, Elk Grove Village Property, LLC (the "Developer") has constructed certain public improvements in connection with the Prime Data Centers ORD-1 - Phase 1 development, located within the Village of Elk Grove Village, Illinois (the "Village"); and WHEREAS, the public improvements constructed by the Developer include watermain and related appurtenances and sidewalks, as more particularly described in the As -Built Engineering Plans prepared by V3 Companies, LTD, Woodridge, Illinois (collectively, the "Public Improvements"); and WHEREAS, the Developer has submitted to the Village a Certificate of Approval and Initial Acceptance, the As -Built Engineering Plans on file with the Village, and a Deed of Conveyance/Bill of Sale conveying the Public Improvements to the Village; and WHEREAS, the Developer has further submitted a Maintenance Bond (Bond No. SBP150539_002), in the amount of Thirty -Four Thousand One Hundred Thirty Dollars and No/100 ($34,130.00), issued by Pennsylvania Insurance Company, guaranteeing the maintenance of the Public Improvements for a two-year period (the "Maintenance Bond"); and WHEREAS, the Village Engineer and Village staff have reviewed the foregoing documents and recommend acceptance of the Public Improvements and the Maintenance Bond; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois as follows: Section 1: The Mayor and Board of Trustees hereby accept the Certificate of Approval and Initial Acceptance and Deed of Conveyance/Bill of Sale conveying the Public Improvements to the Village, as more particularly described in the As Built Engineering Plans prepared by V3 Companies, Woodridge, Illinois, and on file with the Village. Mahon, Village Clerk INTERGOVERNMENTAL AGREEMENT BETWEEN ELK GROVE VILLAGE AND THE NORTHWEST WATER COMMISSION TO AUTHORIZE A SERVICES AGREEMENT WITH BURNS & MCDONNELL FOR A FEASIBILITY STUDY FOR NWC SUPPLY TO ELK GROVE VILLAGE (ST-18) This Intergovernmental Agreement ("Agreement") entered into this day of , 2026 ("Effective Date"), by and between the Village of Elk Grove Village, Illinois, a municipal corporation ("Village") and the Northwest Water Commission, a municipal corporation ("NWC") (collectively referred to as the "Parties"). RECITALS: WHEREAS, Article VII, Section 10 of the Constitution of the State of Illinois, provides that in furtherance of the exercise of their powers, units of local government may contract among themselves in any manner not by law or ordinance, and WHEREAS, the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq., authorizes public agencies in Illinois to exercise jointly with any other public agency any power or powers, privileges, functions or authority which may be exercised by a public agency individually, and to enter into contracts for the performance of governmental services, activities, and undertakings; and WHEREAS, the NWC operates a waterworks system to transport Lake Michigan water purchased from the City of Evanston to the water system of its members and customers; and WHEREAS, the Village owns, and operates a waterworks system that normally and customarily receives its drinking water supply from Northwest Suburban Municipal Joint Action Water Agency ("NSMJAWA"); and WHEREAS, the NWC and the Village believe it would be beneficial to conduct a high- level feasibility study regarding a water system interconnection by and between NWC and the Village (the "Work").; and WHEREAS, the NWC and Village find it in their best interests to enter into an agreement setting forth their understanding for sharing the costs and expenses and other obligations related to the Work. NOW, THEREFORE, BE IT RESOLVED in consideration of the promises, covenants, terms and conditions set forth in this Agreement, the Parties hereto agree as follows: SECTION ONE: Incorporation of Recitals. The above recitals are hereby incorporated herein and made a part of this Agreement as if fully forth herein. SECTION TWO: Scope of Work. The Parties agree that the general purpose of the Work shall be to determine the feasibility on a high-level for NWC emergency water supply to the Village and associated supply costs of a potential interconnection. The Scope of Work is attached hereto and incorporated herein as Exhibit A, which is the Burns & McDonnell proposal for said feasibility study. This work shall be performed, and this Agreement is entered into with no obligation of either party to enter into any further agreements or understandings with regard to the work identified in Exhibit A and does not obligate either party to take or provide water to the other party. SECTION THREE: Payment of the costs, fees, and expenses of the Work. The Village will pay all costs, fees, and expenses (including any cost, fee or expense overruns) of the Work set forth in the technical proposal and cost proposal prepared by Burns & McDonnell, included in Exhibit A. NWC will contract with Burns & McDonnell, and the Village shall reimburse NWC within 30 days after receipt of written notice that NWC has made payment to Burns & McDonnell and that reimbursement is required pursuant to this Agreement SECTION FOUR: Insurance. The NWC and the Village shall each procure and maintain, at their sole cost and expense , during the Work, a policy or policies of insurance with a company or companies authorized to do business in Illinois that insure each Party against general liability, fire, casualty, theft, and property damage caused by the entity retained to do the Work, along with its employees and contractors. The coverage amounts for the insurance policy or policies for each Party shall be $1,000,0000.00 per occurrence and $2000,000.00 in the aggregate. The NWC and the Village shall be named as primary insured on the insurance policies. The NWC and the Village will provide each other Certificates of Insurance, demonstrating coverage as required by this Section SECTION FIVE: General Provisions. 5.1 Governing Law and Venue — This Agreement shall be interpreted under, and governed by, the laws of the State of Illinois. Any claim, suit, action, or proceed in brought in connection with this agreement shall be in the Circuit Court of Cook County, Illinois, and both NWC and the Village consent to the personal and subject matter jurisdiction of said Circuit Court and waive any claim that venue therein is not proper. 5.2 Modification of the Agreement — This Agreement shall not be modified, assigned, altered, or amended in any way except in writing agreed upon by both NWC and the Village. 5.3 Notices —All written notices made pursuant to this Agreement shall be directed to the specified individuals at the addresses below by any of the following means: personal service, overnight courier or first-class mail, postage pre -paid. A RESOLUTION DESIGNATING AN AREA AS BLIGHTED AND IN NEED OF RENEWAL FOR THE REAL PROPERTY COMMONLY KNOWN AS 610-620 MEACHAM ROAD, ELK GROVE VILLAGE, ILLINOIS 60007 AND 1630 BIESTERFIELD ROAD, ELK GROVE VILLAGE, ILLINOIS 60007 PIN: 07-25-300-61-0000; 07-25 300-62-0000; 07-25-300-63-0000 WHEREAS, the Village of Elk Grove Village is a home rule municipality pursuant to Section 6(a), Article VII of the 1970 Constitution of the State of Illinois, and as such may exercise any power and perform any function pertaining to its government and affairs ("Home Rule Powers"); and WHEREAS, Cook County Board of Commissioners has amended the Cook County Real Property Classification Ordinance to provide real estate tax incentives to property owners who build, rehabilitate, enhance and occupy property which is located within Cook County and which is used for industrial and/or commercial purposes; and WHEREAS, the Village, consistent with the Cook County Real Property Classification Ordinance, as amended, wishes to induce industrial and commercial enterprises to locate and expand in the Village by offering financial incentives in the form of property tax relief, and WHEREAS, SG Elk Grove, LLC (the "Applicant") is the contract purchaser of property located 610-620 Meacham Road, Elk Grove Village, Illinois 60007 and 1630 Biesterfield Road, Elk Grove Village, Illinois 60007 delineated by Property Index Numbers 07-25-300-6 1 -0000; 07- 25-300-62-0000; and 07-25-300-63-0000, and legally described on Exhibit "A" attached hereto and made a part hereof; (the "Redevelopment Project Area"); and WHEREAS, pursuant to Section 11-74.2-2(b) of the Commercial Renewal and Redevelopment Areas Act, 65 ILCS 5/11-74.2-2-1 et seq, ("Renewal Act") a blighted area includes the presence of a combination of at least five (5) of the following fourteen (14) factors: 1) age; 2) dilapidation; 3) obsolescence; 4) deterioration; 5) illegal use of individual structures; 6) presence of structures below minimum code standards; 7) excessive vacancies; 8) overcrowding of structures and community facilities; 9) lack of ventilation, light or sanitary facilities; 10) inadequate utilities; 11) excessive land coverage; 12) deleterious land use or layout; 13) depreciation or lack of physical maintenance; and 14) lack of community planning; and WHEREAS, the Mayor and the Board of Trustees of the Village (collectively, the "Corporate Authorities") have reviewed the Blight Analysis prepared by the Applicant & Counsel, and attached hereto as Exhibit "B" (the "Blight Analysis"); and WHEREAS, the Village finds that at least five (5) of the Renewal Act blight factors are present within the Redevelopment Project Area including: 1) obsolescence; 2) deterioration; 3) excessive vacancies; 4) the declination/stagnation of the equalized assessed value; and 5) Dilapidation, as specifically set forth in the Blight Analysis; and WHEREAS, the Village finds that because the Redevelopment Project Area contains at least five or more of the factors used to establish blight under the Renewal Act, the Redevelopment Project Area is found to be a blighted area; and WHEREAS, the Village finds that unless corrected, the blighted condition of the Redevelopment Project Area will persist and continue to delay any future economic development within the area; and WHEREAS, the Village finds that the Redevelopment Project Area is therefore in need of redevelopment and renewal to prevent the spread of blight; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois, as follows: Section 1. The recitals set forth above are incorporated herein and made a part hereof. Section 2. That commercial buildings and improvements within the Redevelopment Project Area are detrimental to the public safety, health, or welfare because of a presence, as documented, of the following Renewal Act factors: 1) obsolescence; 2) deterioration; 3) excessive vacancies; 4) the declination/stagnation of the equalized assessed value; and 5) dilapidation. Section 3. Based on the findings set forth in Section 2 of this Resolution, the corporate authorities find that: A. The Redevelopment Project Area is a blighted area; B. Unless corrected, the blighted condition of the Redevelopment Project Area will persist and continue to delay any future economic development within the area; and C. The Redevelopment Project Area is therefore in need of redevelopment and renewal to prevent the spread of blight. Section 4. This Resolution shall be in full force and effect from and after its passage and approval according to law. A RESOLUTION DETERMINING THE APPROPRIATENESS FOR CLASS 711 STATUS PURSUANT TO THE COOK COUNTY REAL PROPERTY CLASSIFICATION ORDINANCE AS AMENDED SEPTEMBER 19, 2024 FOR CERTAIN REAL ESTATE LOCATED AT 610-620 MEACHAM ROAD, ELK GROVE VILLAGE, ILLINOIS AND 1630 WESTERFIELD ROAD, ELK GROVE VILLAGE, ILLINOIS 60007 WHEREAS, the Village of Elk Grove Village desires to promote the development of industry in the Village of Elk Grove; and WHEREAS, the Cook County Assessor is operating under an ordinance enacted by the Cook County Board of Commissioners, and amended from time to time, the most recent amendment becoming effective as of September 19, 2024, which has instituted a program to encourage industrial and commercial development in Cook County known as the Cook County Real Property Classification Ordinance; and WHEREAS, the Petitioner has applied for or is applying for Class 7B property status pursuant to said aforementioned ordinance for certain real estate located at 610-620 Meacham Road and 1630 Biesterfield Road in the Village of Elk Grove Village, Cook County, Illinois, has proven to this Board that such incentive provided for in said ordinance is necessary for development to occur on this specific real estate. WHEREAS, The Subject Property is vacant and remains unimproved. The Applicant has proposed constructing a new owner -occupied ice arena with an on -site restaurant. The planned two-story ice arena will have two (2) NHL -sized ice rinks, eight (8) general team locker rooms and eight (8) dedicated team locker rooms, an on -site restaurant, a "grab -and -go" concept, study area, physical therapy clinic, and gym. The Applicant has proposed developing a 4,500 square foot building on the "North Outlot" (Pin 07-25-300-062-0000) and a 950 square foot building on the "South Outlot" (PIN 07-25-300-062-0000) for the purposes of leasing to retail and food tenants. This project has a development cost of approximately $32,532,952.00. WHEREAS, the Mayor and the Board of Trustees of the Village (collectively, the "Corporate Authorities") find that it is in the best interests of the Village to approve and accept the Agreement and the temporary easement rights granted therein, and to authorize the execution and recording of (i) the Agreement, together with all exhibits attached thereto; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois, as follows: Section 1. That the request of the Petitioner to have certain real estate located at 610-620 Meacham Road, Elk Grove Village, Cook County, Illinois and 1630 Biesterfield Road, Elk Grove Village, Cook County, Illinois declared eligible for Class 7B status pursuant to the Cook County Real Property Classification Ordinance as amended September 19, 2024, is hereby granted in that this Board and the Village of Elk Grove Village, Illinois, has determined that the incentive provided by the said Class 7B Tax Incentive Ordinance is necessary for the said development to occur on the subject property, legally described as follows: LOT 2 IN HOME DEPOT - ELK GROVE VILLAGE RESUBDIVISION NO. 1, BEING A RESUBDIVISION OF LOT1B IN SUPER KMART CENTER RESUBDIVISION NO. 2, IN THE WEST 1/2 OF THE SOUTHWEST 1/4 OF SECTION 25 TOWNSHIP 41 NORTH, RANGE 10 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS. LOT 3 IN HOME DEPOT- ELK GROVE VILLAGE RESUBDIVISION NUMBER 1 BEING A RESUBDIVISION OF LOT 113 IN SUPER KMART CENTER RESUBDIVISION NUMBER 2 IN THE WEST 1/2 OF THE SOUTHWEST 1/4 OF SECTION 25 TOWNSHIP 41 NORTH, RANGE 10 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS. LOT 4 IN HOME DEPOT - ELK GROVE VILLAGE RESUBDIVISION NUMBER 1, BEING A RESUBDIVISION OF LOT 113 IN SUPER KMART CENTER RESUBDIVISION NUMBER 2 IN THE WEST 1/2 OF THE SOUTHWEST 1/4 OF SECTION 25 TOWNSHIP 41 NORTH, RANGE 10 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS. Section 2. That the Village of Elk Grove Village, Illinois hereby supports and consents to the Class 7B Application and approves the classification of the subject property as Class 7B property pursuant to the Cook County Real Property Classification Ordinance and the Class 7B tax incentives shall apply to the designated property located at 610-620 Meacham Road, specifically: 1. The area containing the Subject Property is within a redevelopment area as designated by the Village of Elk Grove Village commonly known as 610-620 Meacham Road, Elk Grove Village, Illinois 60007 and 1630 Biesterfield Road, Elk Grove Village, Illinois 60007; and 2. The assessed value of the Subject Property and real estate taxes generated by the Subject Property have remained stagnant and shows a decrease for the last six years; and 3. With the Class 7B incentive, the project is both viable and likely to proceed on a reasonably timely basis, thereby contributing to the economic enhancement of the Subject Property and surrounding area; and 4. But for the 7B incentive, the Ice Arena Project would not go forward; and at the conclusion of the twelve year Class 7B incentive period, the Hotel Project should be viable and economically feasible for the foreseeable future; and 5. The Class 7B incentive is reasonably expected to ultimately result in a substantial increase in real estate tax revenue and new employment opportunities on the Subject Property. Elk Grove Village is in receipt of an economic disclosure statement that is included with the application packet. Section 3. The Mayor and Village Clerk are hereby authorized to sign any necessary documents to implement this Resolution including the Elk Grove Village Class 713 Property Tax Incentive Terms and Agreement subject to the petitioner completing new construction of a new hotel development, in substantial conformance with the Applicant completing the improvements stated in their application. Section 4. This Resolution shall be in full force and effect from and after its passage and approval according to law.
