a.Consideration of a request from Living Hope Church, 777 Meacham Road, to waive permit
fees for a temporary banner advertising their Family Fall Fest in the amount of $25.
(It has been past practice of the Village Board to grant fee waivers to governmental and
non-profit organizations.
(The Director of Community Development recommends approval.)
b.Consideration to award a professional service contract to Engineering Enterprises, Inc. of
Sugar Grove, IL for the evaluation study of the water main under I-290 off of Biesterfield
Road in the amount of $56,545 from the Water and Sewer Fund.
(A proposal was solicited from Engineering Enterprises, Inc. (EEI) of Sugar Grove, IL for
the study of the water main condition underneath I-290.
(The water main beneath I-290 has been out of service for a number of years due to a leak
located under I-290. This study will assess the current condition of the pipe to determine
whether it is suitable for lining or if an alternative rehabilitation or replacement method is
required.
(The Director of Public Works recommends approval.)
c.Consideration to award a professional service contract to the lowest responsive and
responsible bidder, Acino Decorating Corporation, of Elk Grove Village, IL for the bus

shelter sandblasting and painting contract in the amount of $61,875 from the Busse
Elmhurst Redevelopment, Higgins Road Corridor Redevelopment, and Business Leaders
Forum Funds.
(On Tuesday, September 30, 2025, the Village opened sealed bids for the bus shelter
sandblasting and painting project.
(The project consists of sandblasting, surface prepping, and painting 33 Village-
maintained bus shelters.
(A total of four (4) contractors obtained contract documents, with two (2) submitting bids.
(The lowest responsive bid was received by Acino Decorating Corporation, of Elk Grove
Village, IL, in the amount of $61,875.
(Adequate funds are available in the Busse Elmhurst Redevelopment Fund, Higgins Road
Corridor Redevelopment Fund, and BLF Fund.
(The Director of Public Works recommends approval.)
d.Consideration to award a professional service contract to Christopher B. Burke
Engineering, Ltd. of Rosemont, IL for preliminary engineering design services for the
Commonwealth Edison right-of-way multi-use path project in the amount of $246,670
from the Capital Projects Fund.
(A proposal was solicited from Christopher B. Burke Engineering, Ltd. of Rosemont, IL
for preliminary engineering design services to install a new multi-use path in the
Commonwealth Edison right-of-way, from Oakton Street to Landmeier Road and from
Tonne Road to Devon Avenue, in the amount of $246,670.
(The new multi-use path will connect the path at Oakton Street to the new path being
constructed along Tonne Road, and from Tonne Road to Ridge and Devon Avenues,
completing a large section of the Village's Bike Plan.
(Christopher Burke Engineering has successfully completed design engineering services
for the Village, including the Ridge and Devon sidewalk project and the Nicholas
Boulevard Watermain and Roadway Reconstruction project.
(Adequate funds are budgeted and available in the Capital Projects Fund.
(The Director of Public Works has recommended approval.)
e.Consideration to award a professional services contract to ARCON Associates of
Lombard, IL for the architectural and engineering services for the 1650 Howard Street
Renovations Project for a total contract amount not to exceed $258,350 from the Busse-
Elmhurst Redevelopment Fund.
(On Tuesday, September 30, 2025, the Village opened sealed bids for the 1650 Howard
Street Renovation Project.
(The project includes removing and replacing overhead doors, making structural updates
to interior walls and the ceiling, cleaning and painting the interior, replacing exterior main
doors, installing a new epoxy floor, and upgrading the HVAC and electrical systems to
support future operational needs.
(ARCON Associates of Lombard, IL has provided a professional services proposal to
perform full architectural and engineering (A/E) services, site survey, civil engineering,
and landscape design work for the 1650 Howard Street Renovation Project.
(The proposal includes an A/E fee of 7.5% of the total construction cost of $3,132,832,
totaling $234,962, plus $5,390 for the site survey and $18,000 for civil engineering, for a

total proposal amount of $258,350. ARCON Associates has a strong reputation in the
Chicagoland area for architectural and engineering services.
(The Public Works Director recommends approval.)
f.Consideration to award a professional services contract to Nicholas & Associates, Inc. of
Mt. Prospect, IL to act as Construction Manager and Constructor for design, construction
management, and administration of trade packages for the 1650 Howard St Renovations
Project for a total contract amount not to exceed $3,252,833 from the Busse-Elmhurst
Redevelopment Fund, in the amounts designated as follows:
•4% of the actual construction cost for Construction Management ($111,582);
•A fixed General Conditions budget ($184,560);
•Bonds & Insurance ($47,144);
•Administer various construction contracts with the lowest responsive and
responsible bidder in each of three (3) trade packages ($2,789,547); and
•Reimbursable expenses ($120,000).
(On February 28, 2017, the Village Board approved an agreement with Nicholas &
Associates, Inc. of Mt. Prospect, IL to perform professional services where the
construction manager is the constructor.
(On Tuesday, September 30, 2025, the Village opened sealed bids for the 1650 Howard
Street Renovation Project.
(The project includes removing and replacing overhead doors, making structural updates
to interior walls and the ceiling, cleaning and painting the interior, replacing exterior main
doors, installing a new epoxy floor, and upgrading the HVAC and electrical systems to
support future operational needs.
(A total of twenty-one (21) contractors submitted bids.
(Nicholas & Associates recommends to award the contract to Tor Construction of South
Elgin, IL in the amount of $1,660,400 for Bid Package #1 - General Trades, Hartwig
Mechanical of Harvard, IL for $648,600 for Bid Package #2 - HVAC, McWilliams
Electric Co. of Schaumburg, IL in the amount of $480,547 for Bid Package #3 - Electrical.
(The overall project cost of $3,511,183 is 14.7% below the original project estimate of
$4,118,333.
(The Public Works Director recommends approval.)
g.Consideration to adopt Ordinance No. 3914 rescinding the Municipal Code of the Village
of Elk Grove Village adopted on May 12, 1992, and adopting the 2025 Official Code of
the Village of Elk Grove Village.
(The Village has been in the process of updating our Village Code for the last few years.
(The Village Code was originally drafted in the 1960s. While a major update was
completed in 1992, many original provisions remained that were no longer applicable or
fully in accordance with current State and Federal statutes. (Instead of updating limited
provisions throughout the Code, Village staff took the opportunity to conduct an in-depth
review of the entire Code to ensure it meets modern standards and practices.
(Most updates reflected in the proposed 2025 Village Code are straightforward and
intended to simplify processes and remove outdated language.
(The most notable proposed change to existing practice is moving the start of the licensing

year for general business licenses to August 1 and for crime-free housing licenses to
January 1, effective in 2026.
(As part of the transition to the new licensing year, current licenses will be extended to
remain active until the start of the new licensing year.
(The change to these licensing years will allow the Finance Department to manage its
workload more evenly throughout the year.
(The Village Attorney recommends approval.
(A copy of the 2025 Village Code is available upon request at the Village Clerk's Office.)
h.Consideration to adopt Ordinance No. 3915 establishing a list of street signage previously
adopted by ordinance to be maintained on file in the office of the Village Clerk.
(Section 6-4-7 of the newly adopted 2025 Village Code provides for a list of street signs
and regulations to be placed on file in the Office of the Village Clerk.
(Prior to this, changes to street signage regulating vehicular traffic required an amendment
to the Village Code.
(The new process establishes a list maintained in the Office of the Village Clerk, which
can be amended by ordinance without requiring codification.
(The Village Attorney recommends approval.)
i.Consideration to adopt Resolution No. 59-25 authorizing the Mayor and Village Clerk to
execute an Intergovernmental Agreement between Elk Grove Township and the Village of
Elk Grove Village.
(The Village and Township entered an Intergovernmental Agreement in 2022 for snow and
ice removal on the Township's roadways.
(The Village provides snow and ice removal for the Township's roadways within the
Village's corporate limits.
(Due to various annexations to the Village, the miles of Township roadways have
decreased from 3.66 miles to 2.78 miles.
(Elk Grove Township Road District agrees to pay the Village a seasonal rate of $14,438.65,
reduced from the previous rate of $19,009.20.
(The agreement includes an "Excessive Snowfall Fee," which allows for an additional
charge of $613.26 for each additional snowfall above and beyond 55 inches of seasonal
snow. The amount of this additional charge is reduced from the previous fee of $767.08.
(The Director of Public Works recommends approval.)
j.Consideration to adopt Resolution No. 60-25 authorizing the Village of Elk Grove to apply
for funding assistance through the Illinois Safe Routes to School Program administered by
Illinois Department of Transportation (IDOT), providing local assurance for the Oakton
Street Resurfacing Project (Arlington Heights Road to Shadywood Lane).
(The Village plans to apply to IDOT for funding assistance through the Illinois Safe Routes
to School Program for the Oakton Street Resurfacing Project (Arlington Heights Road to
Shadywood Lane).
(The Village is requesting funding of $250,000 toward the construction of shortened
pedestrian crosswalks, installation of accessible pedestrian signals, traffic-calming
measures, and an eight-foot wide sidepath along Oakton Street from Arlington Heights
Road to Shadywood Lane, which would complete a large section of the Village's planned

bicycle network.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: The Municipal Code of the Village of Elk Grove Village as adopted
by the Mayor and Board of Trustees on May 12, 1992 is hereby rescinded.
Section 2: That the Mayor and Board of Trustees hereby adopt the 2025 Official
Code of the Village of Elk Grove Village, copies of which are available in the office of
the Village Clerk.
Section 3: That the Village Clerk is hereby directed to publish this Ordinance in
pamphlet form.
Section 4: That this Ordinance shall be in full force and effect from and after its
passage and approval according to law.

AN ORDINANCE ESTABLISHING A LIST OF STREET SIGNAGE
PREVIOUSLY ADOPTED BY ORDINANCE TO BE MAINTAINED ON FILE IN
THE OFFICE OF THE VILLAGE CLERK
WHEREAS, The Village Code adopted on May 12, 1992, and all amendments
thereto pertaining to street signage for vehicular traffic identified each street location as
well as the vehicular movement to be regulated in Chapter 4 of Title 6 of said Code: and
WHEREAS, Section 6-4-7 of the newly adopted 2025 Village Code provides for
all of the streets and regulations set forth in the 1992 Code to be on file in the office of the
Village Clerk and further makes it unlawful to operate a vehicle in violation of any sign
listed with the Village Clerk.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: That all of the identified street locations and the specific signage for
listed traffic movement set forth in Chapter 4 of Title 6 as amended from time to time be
set forth on a list to be filed and permanently maintained in the office of the Village Clerk,
a copy of which is attached hereto as Exhibit A, entitled, Identified Street Locations and
Specific Signage for Listed Traffic Movements.
Section 2: That any person who operates a vehicle in violation of any of the
regulatory signs set forth in the above stated list shall be in violation of Section 6-4-7 of
the 2025 Village Code.
Section 3: That the Village Clerk is hereby directed to publish this Ordinance in
pamphlet form.
Section 4: That this Ordinance shall be in full force and effect from and after its

EXHIBIT A: IDENTIFIED STREET LOCATIONS AND
SPECIFIC SIGNAGE FOR LISTED TRAFFIC MOVEMENTS
I. TURNING MOVEMENTS:
A. No U-Turn Streets:
Busse Road at its intersection with Mark, Devon (northbound only), Jarvis, 400
Busse, or Oakton (northbound only) Street.
B. No Left Turns:
1. No operator of any vehicle traveling southbound on Randall Street shall make a
left turn from Randall Street into Route 72 or proceed southbound across Route 72
into the Park And Shop Shopping Center.
2. No operator of any motor vehicle traveling northbound from the east driveway of
the Park And Shop Shopping Center shall make a left turn from said east driveway
into Route 72 or northbound across Route 72 into Randall Street.
3. No operator of any motor vehicle traveling eastbound on Higgins Road
(Frontage) shall make a left turn from Higgins Road (Frontage) into Route 72.
4. No operator of any motor vehicle shall make a left turn from the southeast
corner of Forest Preserve exit road at Beisner Road onto northbound Beisner Road.
5. No operator of a motor vehicle shall make a left hand turn from the Elk Grove
High School west exit onto Arlington Heights Road.
6. No operator of any motor vehicle shall make a left turn from southbound West
Glenn Trail onto Borman Court (north intersection) Monday through Friday, between
the hours of eight o'clock (8:00) A.M. to nine thirty o'clock (9:30) A.M., and two thirty
o'clock (2:30) P.M. to four o'clock (4:00) P.M., on school days.
7. No operator of any motor vehicle shall make a left turn from southbound West
Glenn Trail onto Christa Court Monday through Friday, on school days, between the
hours of eight o'clock (8:00) A.M. to nine thirty o'clock (9:30) A.M., and two thirty
o'clock (2:30) P.M. to four o'clock (4:00) P.M. (except Christa Court residents).
8. No operator of any motor vehicle shall make a left turn from northbound
Winston Drive onto westbound Cosman Road.
9. No operator of any motor vehicle shall make a left hand turn from the south exit
of the Rupley School Parking Lot onto Crest Avenue.

C. Right Turn Only: The operator of any motor vehicle approaching any of the
intersections listed below shall be required to make a right hand turn at said
intersection:
Vehicles traveling eastbound on Touhy Avenue at its intersection with Route 83.
Vehicles traveling westbound on Touhy Avenue at its intersection with Route 83.
Vehicles traveling northbound on the east driveway of the Vue Shopping Center at
its intersection with Higgins Road (Little Higgins/Frontage) and Route 72.
Vehicles traveling northbound on the west driveway of the Vue Shopping Center at
its intersection with Higgins Road (Little Higgins/Frontage) and Route 72.
Vehicles traveling eastbound on Halo Drive at its intersection with Busse Road
between the hours of three o'clock (3:00) P.M. and five o'clock (5:00) P.M.
D. No Right Turn: It shall be unlawful for the operator of any motor vehicle to turn right
at any of the following locations:
Westbound on Higgins Road (Little Higgins/Frontage) at the intersection of Higgins
Road (Little Higgins/Frontage) and the east driveway of the Park And Shop Shopping
Center.
Northbound on West Glenn Trail onto Christa Court between the hours of eight

E. No Right Turn On Red Traffic Signal When Pedestrians Are Present: It shall be

INTERGOVERNMENTAL AGREEMENT
Between the Elk Grove Township and the
Village of Elk Grove Village
This Intergovernmental Agreement (the “Agreement”) is made and entered into this day
of , 2025 by and between the Village of Elk Grove Village (the “Village”), a body politic and corporate of the
State of Illinois and Elk Grove Township, a unit of local government (hereinafter referred to as “EGT”). The
Village and EGT are sometimes collectively referred to as the “Parties.”
RECITALS
WHEREAS, the Constitution of the State of Illinois, 1970, Article VII, Section 10,
authorizes units of local government to contract or otherwise associate among themselves in any
manner not prohibited by law or ordinance; and
WHEREAS, the Village and EGT are units of government within the meaning of the
Constitution of the State of Illinois, 1970, Article VII, Section 10, having the power and authority
to enter into an intergovernmental agreement; and
WHEREAS, EGT has maintained certain portions of North Parkway Road, Center Street,
Lincoln Lane, Martha Street, Forest View Avenue, Crest Avenue, Thorndale Avenue, Woodview
Avenue, and Howard Street the “EGT Roads,” as outlined in the attached maps (Exhibit A); and
WHEREAS, the Village and EGT find it is in their interests to enter into an agreement
whereby Village shall provide snow removal and ice removal and mitigation measures to the EGT
Roads; and
WHEREAS, the Village and EGT desire by this Agreement to set forth their respective
obligations and responsibilities concerning the snow removal and ice removal and mitigation
measures necessary for the maintenance of the EGT Roads;
NOW, THEREFORE, in consideration of the promises, covenants, terms and conditions
set forth in this Agreement, the Parties hereto agree as follows:
Section 1. Incorporation of Recitals. The above recitals are incorporated into this
Agreement as if fully set forth herein.
Section 2. Term of the Agreement. This Agreement, which is a legal, valid and binding
contract enforceable against both the Village and EGT, shall be for a three (3) consecutive, one (1)
year terms, beginning at the date when both Parties have approved and executed the Agreement.
The Agreement shall be automatically renewable for additional three (3) year terms unless either
Party terminates the Agreement by giving written notice at least six (6) months in advance of the
termination date.

Section 3. Scope of Agreement. It is the intention of this Agreement to authorize the
Village to provide snow and ice control measures for certain EGT roadways including those
identified above and shown in Exhibit A. All snow and ice removal work shall be provided on an
as-needed basis as determined by the Village. The Village will provide the requisite personnel,
equipment, and salt necessary to maintain the safety of EGT Roads during snow and ice control
events.
Section 4. Payment of Fees. The formula used to compute the annual Payment of Fees
shall be as follows:
Operational Cost Per Mile x Centerline Miles to be Maintained = Avg. Operational Cost
Average Operational Cost x 26 Estimated Annual Operations = Annual Cost
A summary of the cost breakdown appears in Exhibit B. As such, EGT shall pay the
Village the following rates for snow removal and ice removal and mitigation on the EGT Roads:
Snow Removal Season Seasonal Rate
2025-2026 $14,438.65
The payment is due in full no later than the first day of November each calendar year the
Agreement is in effect. There will be no refunds of the Seasonal Rate. The Seasonal Rate shall
include an annual adjustment that captures the rate of inflation as reflected by the consumer price
index for this region (as of October 1st of each applicable year). Under no circumstance shall the
Seasonal Rate be adjusted downward. The Seasonal Rate adjustment shall be determined no later than
the first day of October each calendar year the Agreement is in effect. Additionally, when
cumulative snowfall for a season exceeds 55” as recorded at O’Hare Airport, the Village shall
charge EGT an additional fee of $613.26 for each additional snow or ice control event during the
season (“Excessive Snowfall Fee”). The Excessive Snowfall Fee shall be adjusted annually for
inflation as reflected by the consumer price index for this region on the same date as the Seasonal
Rate adjustment is determined. A “Season” shall be defined as the period of time between
November 1 and April 30 each year that this Agreement is in effect.
Section 5. Indemnification. The Village shall defend, indemnify and hold harmless EGT,
and its officers, agents and employees, from all and any liability, losses, costs, damage or expense,
or injury to person or property, including reasonable attorneys’ fees, arising out of the execution
of this Agreement, the Village’s failure to perform any provisions of this Agreement, or the
termination of this Agreement with its terms, with the exception of any liability, losses, costs,
damage or expense, or injury to person or property arising out of or resulting from (1) the sole
action, negligence, malfeasance, or misfeasance of EGT, or its officers, agents and employees in
the performance or non-performance of any act pursuant to this Agreement; or (2) any claim by an
employee, agent, or subcontractor of EGT.
EGT shall defend, indemnify and hold harmless the Village, and its officers, agents and
employees, from all and any liability, losses, costs, damage or expense, or injury to person or
property, including reasonable attorneys’ fees, arising out of or resulting from (1) the sole action,
negligence, malfeasance, misfeasance, of EGT or its officers, agents or employees in the

performance or non-performance of any act pursuant to this Agreement; or (2) any claim by an
employee, agent or subcontractor of EGT.
The Village and EGT acknowledge that each party shall, if requested by the other party,
furnish the other with a current certificate of insurance or self-insurance evidencing their respective
existing public liability, property damage and workmen’s compensation insurance coverages at the
time of the signing of this Agreement, and that during the term of this Agreement, each party will
maintain not less than the same level of insurance coverage.
Section 6. Notices. All notices, requests, demands, and other communications
(collectively, “Notices”) hereunder shall be in writing and given by (i) established express delivery
service which maintains delivery records, (ii) hand delivery, or (iii) certified or registered mail,
postage prepaid, return receipt requested, to the parties at the following addresses, or at such other
address as the Parties may designate by Notice in the above manner:

Notices also may be given by fax or email provided the Notice is concurrently given by
one of the above methods. Notices are effective upon receipt or upon attempted delivery if
delivery is refused or impossible because of failure to provide a reasonable means for
accomplishing delivery.
Section 7. General Provisions.
A.Governing Law and Venue. This Agreement shall be interpreted under, and
governed by, the laws of the State of Illinois. Any claim, suit, action or proceeding brought in
connection with this Agreement shall be in the Circuit Court of Cook County and both the Village
and EGT hereby irrevocably consent to the personal and subject matter jurisdiction of such court
and waive any claim that such court does not constitute a convenient and appropriate venue for
such claims, suits, actions or proceedings.
B.Modification. This Agreement may not be altered, modified or amended except
by a written instrument signed by both Parties. Provided, however, the Village and EGT agree
that provisions required to be inserted in this Agreement by laws, ordinances, rules, regulations
or executive orders are deemed inserted whether they appear in this Agreement and that in no
event will the failure to insert such provisions prevent the enforcement of this Agreement.
C.Force Majeure. Neither the Village nor EGT shall be liable for failing to fulfill
any obligation under this Agreement to the extent any such failure is caused by any event beyond
EGT’s or the Village’s control and which event is not caused by EGT’s or the Village’s fault or
negligence. Such events shall include, but are not limited to, acts of God, acts of war or terrorism,
fires, lightning, floods, epidemics or riots.

D.Entire Agreement. This Agreement constitutes the entire agreement between the
Village and EGT, merges all discussion between them and supersedes and replaces any and every
other prior or contemporaneous agreement, negotiation, understanding, or any other commitments
and writings with respect to such subject matter hereof.
E.Severability. If any provision of this Agreement shall be declared invalid for any
reason, such invalidation shall not affect any other provisions of this Agreement which can be
given effect without the invalid provision and to that extent, the provisions of this Agreement are severable.

A RESOLUTION PLEDGING FINANCIAL COMMITMENT AND SUPPORT IN
CONJUNCTION WITH THE VILLAGE’S REQUEST FOR FUNDING ASSISTANCE
THROUGH THE ILLINOIS SAFE ROUTES TO SCHOOL PROGRAM REGARDING
THE VILLAGE’S OAKTON STREET RESURFACING PROJECT___________________
WHEREAS; the Mayor and Board of Trustees of the Village of Elk Grove Village are
desirous of improving and enhancing transportation corridors within the Village, including
projects improving bicycle and pedestrian safe access to schools; and
WHEREAS; The Village is considering adopting the Oakton Street Resurfacing Project
which will provide for the addition of safe pedestrian crosswalks, an eight foot wide shared use
path and traffic calming connecting Arlington Heights Road to Shadywood Lane along Oakton
Street to access Rupley Elementary School; and
WHEREAS; the Illinois Department of Transportation (IDOT) is accepting grant
applications for their Safe Routes To School Program, which applications require the Village to
provide and pledge financial commitment and support for the project; and
WHEREAS; the Mayor and Board of Trustees find and believe it to be in the best
interests of the Village to pledge financial commitment and support as required.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the
Village of Elk Grove Village, Cook and DuPage Counties, Illinois, as follows:
Section 1: That the Village is willing and able to manage, maintain and operate the
herein stated project.
Section 2: That the Village possesses the legal authority to finance and construct the
project and affirm that the project will commence within the timeline outlined in the grant
application.
Section 3: That the Village fully supports the Oakton Street Resurfacing Project and
hereby requests funding assistance for said project pursuant to IDOT’s Illinois Safe Routes To
School Program.
