HomeMy WebLinkAboutORDINANCE - 3933 - 3/10/2026 - Special Permit Schaumburg Bank and TrustORDINANCE NO.3933 AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO SCHAUMBURG BANK & TRUST COMPANY, N.A., OPERATING AS WINTRUST COMMUNITY BANK, TO OPERATE A FINANCIAL INSTITUTION WITH A DRIVE-THRU AT THE REAL PROPERTY LOCATED AT 900 EAST HIGGINS ROAD, ELK GROVE VILLAGE, ILLINOIS WHEREAS, the Village of Elk Grove Village (the "Village") is a home rule unit of local government pursuant to Article VII, Section 6 of the Illinois Constitution of 1970, and as such may exercise any power and perform any function pertaining to its government and affairs, including, but not limited to, the regulation of land use and zoning within its corporate limits; and WHEREAS, pursuant to its home rule authority and the Illinois Municipal Code, the Village has adopted and amended from time to time the Elk Grove Village Zoning Code (the "Zoning Code") to regulate and restrict the location and use of buildings, structures, and land within the Village; and WHEREAS, Section 8-3-E of the Zoning Code authorizes the Mayor and Board of Trustees of the Village (collectively, the "Village Board"), following a public hearing before the Plan Commission of the Village (the "Plan Commission") and receipt of its recommendation, to grant Special Use Permits for certain uses identified in the Zoning Code when the applicable standards are satisfied; and WHEREAS, the real property commonly known as 900 East Higgins Road, Elk Grove Village, Illinois (the "Property"), legally described in Exhibit A attached hereto and made a part hereof, is located within the B-3 Automotive Oriented Business District; and WHEREAS, Schaumburg Bank & Trust Company, N.A., a national banking association operating as Wintrust Community Bank (the "Petitioner"), filed an application pursuant to Section 8-3-E of the Zoning Code requesting approval of a Special Use Permit to operate a financial institution with a drive-thru at the Property; and WHEREAS, the Plan Commission conducted a duly noticed public hearing on February 9, 2026, considered the Petition and related materials, and thereafter forwarded a favorable recommendation to the Village Board; and WHEREAS, the Village Board has reviewed the record of proceedings before the Plan Commission and has determined that approval of the Special Use Permit is consistent with the Zoning Code and in the best interests of the Village and its residents; NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois, as follows: Section 1: Incorporation of Recitals. The foregoing recitals are hereby incorporated into this Ordinance as findings of fact of the Mayor and Board of Trustees. Section 2: Findings Pursuant to Section 8-3-E (4). The Village Board has reviewed the record of proceedings before the Plan Commission, including its findings and recommendation. Based upon the evidence presented at the public hearing, the record of proceedings, and the standards set forth in Section 8-3-E(4) of the Zoning Code, the Mayor and Board of Trustees makes the following findings: A. The proposed financial institution with a drive-thru is compatible with surrounding commercial uses within the B-3 Automotive Oriented Business District. The Property has historically been used as a banking facility and contains an existing drive-thru canopy. The proposed use will not adversely affect adjacent properties or the public health, safety, or welfare. B. The use is low intensity with predictable traffic patterns. Proposed site modifications, including widening of the south driveway to allow two-way ingress and egress access and installation of an ATM within an existing concrete island, will improve on -site circulation without increasing curb cuts or materially increasing traffic volumes. C. Adequate public utilities, stormwater infrastructure, and public safety services, are available to serve the Property. D. The Special Use is consistent with the Village's Comprehensive Plan and the established commercial development pattern along the Higgins Road corridor. Based upon the foregoing, the Village Board finds that the standards for approval of a Special Use Permit under Section 8-3-E of the Zoning Code have been satisfied. Section 3: Grant of Special Use Permit. Pursuant to Section 8-3-E of the Zoning Code, a Special Use Permit is hereby granted to the Petitioner to allow the operation of a financial institution with a drive-thru at the Property legally described in ExhibitA and generally depicted in Exhibit B, subject to the conditions set forth herein. Section 4: Conditions of Approval. The Special Use Permit granted herein is subject to the following conditions: 1. The financial institution shall be operated in substantial compliance with the application and representations made to the Plan Commission and Village Board. 2. All required building permits, inspections, and certificates of occupancy shall be obtained prior to operation. 3. The Property shall remain in compliance with all applicable provisions of the Village Code. 4. The Special Use shall be subject to the limitations, expiration, extension, and revocation provisions set forth in Section 8-3-E(6) of the Zoning Code. Section 5: Publication. The Village Clerk is authorized and directed to publish this Ordinance in pamphlet form as provided by law. Section 6: Effective Date. This Ordinance shall be in full force and effect from and after its passage, approval, and publication in pamphlet form according to law.
