HomeMy WebLinkAboutORDINANCE - 3934 - 3/24/2026 - Short Term RentalsORDINANCE NO.3934 AN ORDINANCE AMENDING SECTION 2-2 DEFINITIONS OF THE ELK GROVE VILLAGE ZONING CODE TO REVISE THE DEFINITION OF SHORT-TERM RENTAL FOR RESIDENTIAL WHEREAS, the Village of Elk Grove Village (the "Village") is an Illinois home rule municipal corporation organized and operating under the Constitution and laws of the State of Illinois; and WHEREAS, pursuant to its home rule authority and the Illinois Municipal Code, the Village has adopted the Elk Grove Village Zoning Code (the "Zoning Code"), including Section 2-2 setting forth definitions applicable to land uses within the Village; and WHEREAS, the Mayor and Board of Trustees of the Village (the "Corporate Authorities") have determined that it is necessary and appropriate to amend the definition of "Short -Term Rental" in Section 2-2 of the Zoning Code; and WHEREAS, the Corporate Authorities have determined that this amendment promotes the public health, safety, and welfare of Village residents and preserves the character and integrity of residential neighborhoods; and WHEREAS, on February 9, 2026, the Plan Commission held a duly noticed public hearing on the proposed text amendment and thereafter recommended approval of the amendment to the Corporate Authorities; NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section I: Incorporation of Recitals. The recitals set forth above are incorporated into this Ordinance as findings of the Corporate Authorities as if fully set forth herein. Section 2: Amendment to Section 2-2 — Definitions. Section 2-2 of the Zoning Code is amended by revising the Definition of "Short -Term Rental" as follows (deletions stfieken and additions underlined): SHORT TERM RENTAL: A residential structure, offered for rent for a period which does not exceed thii4y=(30) .ninety (90) consecutive days. The term Short -Term Rental shall not include hotels. All other provisions of Section 2-2 shall remain unchanged. Section 3: Publication. The Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form in accordance with law. Section 4: Conflicts. In the event of a conflict between the provisions of this Ordinance and any other ordinance, resolution, or portion thereof, the provisions of this Ordinance shall govern. Section 5: Severability. This Ordinance and every provision thereof shall be considered severable. If any word, phrase, clause, sentence, paragraph, provision, section, or part of this Ordinance is found by a court of competent jurisdiction to be void, unconstitutional, or otherwise unenforceable, all remaining portions of this Ordinance not so declared void, unconstitutional, or unenforceable shall remain in full force and effect. Section 6: Effective Date. This Ordinance shall be in effect immediately from and after its passage and approval in the manner provided by law. The Section 2-2 of the Zoning Code amended herein shall be reprinted with the changes. VOTE: AYES: 6 NAYS:0 ABSENT:0 PASSED this loth day of March 2026. APPROVED this loth day of March 2026.
