ACCOUNTS PAYABLE WARRANT: MAY 26, 2026 $ 4,158,339.02 6. CONSENT AGENDA a. Consideration of a request from the Elk Grove VFW (Elk Grove Village Veterans Club, Inc.) a not-for-profit corporation, to waive the transfer tax in the amount of $20 for the sale of 400 E Devon and 410 E Devon. (It has been past practice of the Village Board to grant waivers to governmental and non- profit organizations. (The Director of Finance recommends approval.) b. Consideration of a request from the Elk Grove Park District, 499 Biesterfield Road, to waive permit fees to replace seven (7) mechanical rooftop units at Rainbow Falls in the amount of $4,875. (It has been past practice of the Village Board to grant fee waivers to governmental and non-profit organizations. (The Director of Community Development recommends approval.) c. Consideration to award a professional service contract to Bayless Communications LLC of Chicago, IL for strategic consulting services to support business retention and Page 2 of 5 recruitment efforts in an amount not to exceed $54,000 from the Busse-Elmhurst Redevelopment Fund. (Bayless Communications provides the Village with strategic communications and public relations consulting services to support ongoing business retention and recruitment efforts. (Over the past seven years, Bayless Communications has provided support in effectively developing and implementing communication plans to increase earned media coverage for the Village's economic development programs and projects. (This contract reflects the same rate as for services for the previous year and provides for a 12-month term through April 30, 2027. (Adequate funds are available in the Busse-Elmhurst Redevelopment Fund. (The Assistant Village Manager recommends approval.) d. Consideration to award a professional service contract to Engineering Enterprises, Inc. of Sugar Grove, IL for the design and construction engineering services for the 2026 sanitary manhole rehabilitation project in the amount of $62,151 from the Water & Sewer Fund. (A proposal was solicited from Engineering Enterprises, Inc. (EEI) of Sugar Grove, IL for the design and construction engineering services for the 2026 sanitary manhole rehabilitation project. (Fifty (50) sanitary manholes were inspected in 2025 and found to be in need of repair to comply with the Metropolitan Water Reclamation District's Inflow and Infiltration Program. (EEI will provide services to prepare contract documents, review post-construction manhole videos, review shop drawings and inspection reports, prepare pay estimates, and oversee all construction observations. (The Director of Public Works recommends approval.) e. Consideration to award a professional service contract to RJN Group of Wheaton, IL for professional engineering services for the 2026 Meacham Road sanitary sewer lining project in the amount of $90,300 from the Water & Sewer Fund. (A proposal was solicited from RJN Group of Wheaton, IL for design of the 2026 Meacham Road sanitary sewer lining project. (The Village has approximately 6,600 linear feet of sanitary sewer ranging in size from 8" to 18" that need to be lined. This sanitary sewer line receives the vast majority of the Village's sanitary flow west of I-290. The line has reached the end of its useful life. (This rehabilitation project will require major bypass pumping along with permitting from both the Cook County Department of Transportation & Highways (CCDOTH) and the Metropolitan Water Reclamation District (MWRD). (The proposed rehabilitation will ensure reliable sewer service to the Village's residential areas now and into the future. (Adequate funds are available in the Water & Sewer Fund. (The Director of Public Works recommends approval.) f. Consideration to waive the formal bidding process and award a contract to JG Uniforms of Chicago, IL for the Police Department's FY2027 uniform services in the amount of $90,500 from the General Fund. (The Police Department has purchased uniforms and equipment from JG Uniforms for the past twelve (12) years. Page 3 of 5 (For the FY2027 budget, JG Uniforms has extended an offer to the Village for a one (1) year contract with a three percent (3%) increase for all items. (The three percent (3%) increase covers JG Uniforms rising operation costs and inflation. (The FY2027 Police Department's Uniform Services contract would be $90,500. (Adequate Funds are available in the FY2027 Police Department General Fund. (The Chief of Police recommends approval.) g. Consideration to waive the formal bidding process and award a purchase contract to EJ USA, Inc., of Pittsburgh, PA for sanitary manhole lids and frames in the amount of $150,000 from the Water & Sewer Fund. (The Village has selected EJ USA Inc. as its only approved manufacturer of sanitary manhole lids. (Recent sanitary manhole hole inspections have identified 500 defective manhole lids and frames that are in need of replacement. (This purchase is a direct buy from EJ USA Inc. and they have previously provided sanitary manhole lids and frames for the Village. (Funds are available in the Water & Sewer Fund. (The Director of Public Works recommends approval.) h. Consideration to award a professional service contract to Hampton, Lenzini and Renwick, Inc. of Elgin, IL for the Business Park ditch maintenance program in the amount of $1,050,000 from the Business Leaders Forum Fund, Busse-Elmhurst Redevelopment Fund and Higgins Road Corridor Redevelopment Fund. (A proposal for professional design-build services was solicited from Hampton, Lenzini and Renwick, Inc. of Elgin, IL for analysis, vegetation management, engineering, permitting, and construction to manage the Village’s Business Park ditch system. (Hampton, Lenzini and Renwick began the ditch maintenance program in FY2025 and were very successful. (Adequate funds are available in the Business Leaders Forum Fund, Busse-Elmhurst Redevelopment Fund and Higgins Road Corridor Redevelopment Fund. (The Director of Public Works recommends approval.) i. Consideration to adopt Ordinance No. 3941 amending Title 3, Chapter 3, of the Village Code related to Liquor Control. (The Village Code establishes certain regulations regarding liquor control within the Village. (Title 3, Chapter 3, Section 10 of the Village Code needs amending for the best interest of the Village and its residents.) j. Consideration to adopt Resolution No. 37-26 amending Resolution No. 62-25 and authorizing the Mayor and Village Clerk to execute an Amendment to the Loan Agreement between the Village of Elk Grove Village and SG Elk Grove, LLC (600 Meacham). (The Village Board approved the loan agreement with SG Elk Grove, LLC on November 18, 2025. (SG Elk Grove in in the process of constructing the hockey facility at 600 Meacham. (Due to an oversight by those preparing the documents, the loan repayment was scheduled to start before completion of the development. Page 4 of 5 (This amendment corrects the loan repayment schedule to start on December 1, 2026. (The Village Manager recommends approval.) k. Consideration to adopt Resolution No. 38-26 authorizing the Mayor to execute a Letter of Receipt stipulating the terms of an agreement for an application seeking a Cook County Class 6B Property Tax Exemption status pursuant to the Cook County Real Property Classification Ordinance, as amended from time to time, for certain real estate located at 1949-1951 Arthur Avenue. (The Law Offices of Liston & Tsantilis, on behalf of their client AG - MVP Arthur Avenue Owner, LLC (Applicant) is seeking a Cook County Class 6B property tax exemption for property located at 1949-1951 Arthur. (The Applicant intends to purchase the 104,394 square foot industrial facility and will plan to lease out the space to suitable industrial tenants in the warehousing/distribution/manufacturing sectors. (Depending on the type of user, it is estimated that the tenant will employ about 25-100 full-time employees at this facility. (Matterhorn Venture Partners, who is purchasing the property, is a Chicago-based real estate investment firm focused on the acquisition, improvement, and long-term stewardship of commercial real estate assets throughout the United States.) (The Applicant will refurbish the building to increase its functionality and improve the building at an estimated cost of over $1 million. (Improvements will include replacement of the western loading dock, removal and replacement of landscaping, reconstruction of both parking lots, clean out of the rear detention pond and back overgrowth, new EIFS paneling, and new canopies. (The eligibility requirements for 6B status are new construction, substantial rehabilitation or buildings that have been vacant for a period of time. This site qualifies based on the Reoccupation of Abandoned Property with less than 12 months vacancy with a Purchase for Value, Special Circumstances, and Substantial Rehabilitation. (Property approved for Class 6B status allows the owner of the property to have the assessment level lowered for a period of twelve years. The assessment schedule is 10% of fair market value for ten years, then 15% in the eleventh year and 20% in the twelfth year. Industrial property is currently assessed at 25% of fair market value in Cook County. (Upon approval, the Director of Business Development & Marketing will issue a Letter of Receipt to the Applicant. The Letter of Receipt will allow the Applicant to file an application with Cook County. Final approval is at the discretion of the Village Board and contingent on the Applicant completing the improvements stated in their application. This sanitary sewer line receives the vast majority of the Village's sanitary flow west of I-290. The line has reached the end of its useful life. This rehabilitation project will require major bypass pumping along with permitting from both Cook County Department of Transportation and Highways (CCDOTH) and Metropolitan Water Reclamation District (MWRD). The proposed rehabilitation will ensure reliable sewer service to the Village's residential areas now and into the future. The RJN Group is a civil engineering and field services firm that specializes in inspecting, studying, analyzing, and designing sewer collection systems. They have worked with hundreds of communities and have evaluated over a quarter-billion feet of sewer in their 42-year company history. I recommend that a professional service contract be awarded to RJN Group of Wheaton, IL for professional engineering services in the amount of $90,300. Over the years, standardizing critical components, such as fire hydrants, storm grates, and manholes, has ensured uniform compatibility with our existing system while increasing staff efficiency and familiarity during repairs. This purchase is a direct buy from EJ USA Inc., allowing the Village to source the materials directly from the manufacturer. Sourcing directly bypasses third-party vendors and eliminates additional markups, ensuring the Village receives the best possible pricing. In FY2025, Hampton, Lenzini and Renwick, Inc. performed a comprehensive site inspection and assessment, which determined that the Business Park ditch system has six micro- watersheds within the Business Park. The scope of services performed included field inspection and assessment, vegetation management (clearing, weeding, herbicide treatments, and seeding), and a dormant mow in late fall, winter, and early spring to remove built-up vegetation, prevent the growth of non-native species, and promote early seed germination of native plants. Hampton, Lenzini and Renwick, Inc. created a database which was utilized to address areas of erosion concern, and remove invasive tree and brush to assist in the management of the Village’s Business Park ditch system. For FY2027, Hampton, Lenzini and Renwick, Inc. will continue the program established in FY2025, with three (3) herbicide treatments targeting invasive vegetation throughout all drainage swales during the growing season (April through October), removal of non-native species, tree removals and seeding. It is anticipated that the ditch maintenance program will take three to four years of vegetation management, tree clearing and grass establishment, which will then be followed by smaller ongoing annual maintenance. I recommend a professional design-build service contract to be executed with Hampton, Lenzini and Renwick, of Elgin, IL for the Business Park Ditch Maintenance Program for the amount of $1,050,000. Exposes their genitals, pubic hair, buttocks, perineum, anal region or pubic hair region; or 2. Exposes any device, costume or covering which gives the appearance of or simulates genitals, pubic hair, buttocks, perineum, anal region or pubic hair region; or 3. Exposes any portion of the female breast at or below the areola thereof. C. Manager’s attendance required. An owner, partner, corporate officer or approved manager meeting the same requirements must be present on the premises licensed under this chapter during all business hours. In addition to any other penalty imposed for violations of this chapter, a minimum fine of $250.00 and a maximum fine of $750.00 shall be imposed for violations of this section. D. Over-service prohibited. It shall be unlawful for any holder of a retail liquor dealer’s license to sell, deliver or give any alcoholic liquor to any intoxicated person. In addition to any other penalty imposed for violations of this chapter, a minimum fine of $250.00 and a maximum fine of $750.00 shall be imposed for violations of this section. 3 E. Disorderly conduct/breach of the peace. (a) No person licensed under this Chapter shall permit any violation of this Chapter and Disorderly Conduct as described in Section 6-6-1-1 or violation of any law or ordinance on or about the licensed premises. (b) The licensee, his, her or its agents or employees shall immediately report to the Elk Grove Village Police Department any disorderly conduct and/or breach of the peace or other criminal activity being conducted or occurring on the licensed premises and shall in all ways cooperate with the Elk Grove Village Police Department in any investigation arising from those activities. (c) In addition to any other penalty imposed for violations of this chapter, a minimum fine of $250.00 and a maximum fine of $750.00 shall be imposed for violations of this section. Section 3: That the Village Clerk is authorized to publish this Ordinance in pamphlet form. Section 4: In the event a conflict exists between the terms of this Ordinance and any other ordinance or resolution of the Village, the terms of this Ordinance shall govern. The eligibility requirements for 6B status are new construction, substantial rehabilitation, or buildings that have been vacant for a period of time. Property approved for Class 6B status allows the owner of the property to have the assessment level lowered for a period of twelve years. The former occupant, Libra Industries had been winding down operations since May 2025, with the site being over 75% vacant and unused by August 2025. The site went 100% vacant and unused as of April 2, and the property will also be 100% vacant and unused for a number of months post-closing for buildout and tenant identification. The circumstances here are special in that the site has been in a long wind-down period in which the property was only operating at ¼ or less capacity, but to take it out of the ‘Special Circumstances’ arm of the 6b program, the Applicant would need to wait for the property to sit vacant for an additional ~10 months or so from the date of full vacancy before the purchase, work, or reoccupation can occur. The site is currently under contract with Matterhorn, who plans to significantly renovate the site for future leasing. Projected Jobs, Improvements & Fiscal Impact The Applicant does not yet have a tenant for the space, but after renovations, plans to market the site to suitable industrial tenants in the warehousing/distribution/manufacturing sector. Depending on the type of user, the Applicant expects employment of around 25– 100 individuals. The Applicant expects these employees to frequent Village restaurants, gas stations, stores and more. The Applicant also expects the eventual Occupant to attract customers who will also frequent nearby establishments. Based on the Employee Economic Impact Charts below, 25 – 100 full time employees could generate between $105,938 to $423,750 in additional Village revenue. Among other things, this investment includes over $700,000+ on parking lot work, $60,000+ in new paneling, $50,000+ on a new awning and finish carpentry, $40,000+ on landscaping and over $80,000 on glazing. See enclosed budget for a full breakdown. After the proposed improvements and subsequent reoccupation, the Applicant expects the property to have a stabilized market value of around $8,000,000, which would generate approximately $2,873,793 in taxes over the life of the incentive (or approx. $212,874 per year). Without the incentive, the Applicant will not purchase the site, leaving the facility vacant and unused. With full vacancy relief, the Subject Property would generate only $1,609,118 in taxes over the life of the incentive (or approx. $134,093 per year). Therefore, should the Class 6b tax incentive be approved, the Subject Property would generate between $1,264,675 in additional real estate taxes over the life of the Class 6b. Please see the attached “12 Year Tax Comparison Chart.” “But-For” Condition Statement Without assistance from the Class 6b Tax Incentive, the Applicant will neither purchase or improve the site, leaving it vacant and unused. The Applicant has determined that without the incentive, the heavy Cook County property tax burden (26.609% Effective Tax Rate) will make the proposed project infeasible. In the event that the Applicant does not purchase/renovate the property it will remain vacant thereby lowering its total taxes. Conclusion Based on the foregoing, the Applicant requests that Elk Grove Village review its Class 6b Tax Incentive request and approve a Resolution supporting and consenting to a Class 6b Tax Incentive for the Subject Property based on Re-Occupation of Abandoned Property with Less than 12 Months Vacancy with a Purchase for Value, Special Circumstances and Substantial Rehabilitation. The Letter of Receipt is not a guarantee of final approval and the Applicant may move ahead with their project at their own risk. The Letter of Receipt will serve as official notice that the APPLICANT is eligible for the incentive; however, final approval is not complete until there is an official Resolution passed by the Village. The Resolution will not be executed until such time all proposed work is complete. The APPLICANT has 365 days from the execution of this Agreement to complete all proposed alterations and submit a full accounting of costs. If costs are not consistent with promises made in the original application, the APPLICANT may not be granted a final resolution of 6B approval.
