HomeMy WebLinkAboutRESOLUTION - 16-22 - 2/22/2022 - 1301 JARVIS AVENUE 6BRESOLUTION NO. 16-22 A RESOLUTION DETERMINING THE APPROPRIATENESS FOR CLASS 6B STATUS PURSUANT TO THE COOK COUNTY REAL PROPERTY CLASSIFICATION ORDINANCE AS AMENDED JULY 27, 2018 FOR CERTAIN REAL ESTATE LOCATED AT 1301 JARVIS AVENUE, ELK GROVE VILLAGE, ILLINOIS WHEREAS, the Village of Elk Grove Village desires to promote the development of industry in the Village of Elk Grove; and WHEREAS, the Cook County Assessor is operating under an ordinance enacted by the Cook County Board of Commissioners, and amended from time to time, the most recent amendment becoming effective as of July 27, 2018, which has instituted a program to encourage industrial and commercial development in Cook County known as the Cook County Real Property Classification Ordinance; and WHEREAS, in the case of abandoned property, if the municipality or the Mayor and Board of Trustees, finds that special circumstances justify finding that the property is "abandoned" for purpose of Class 613, even though it has been vacant and unused for less than 24 months, that finding, along with the specification of the circumstances, shall be included in the resolution or ordinance supporting and consenting to the Class 6B application. Such resolution or ordinance shall be filed with the eligibility application. If the ordinance or resolution is that of a municipality, the approval of the Board of Commissioners of Cook County is required to validate such shortened period of qualifying abandonment, and a resolution to that effect shall be included with the Class 6B eligibility application filed with the Assessor; and WHEREAS, the Petitioner has applied for or is applying for Class 6B property status pursuant to said aforementioned ordinance for certain real estate located at 1301 Jarvis Avenue, in the Village of Elk Grove Village, Cook County, Illinois, with the Property Index Number 08-27-400-073-0000, and has proven to this Board that such incentive provided for in said ordinance is necessary for development to occur on this specific real estate. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois: Section 1: That the request of the Petitioner to have certain real estate located at 1301 Jarvis Avenue, Elk Grove Village, Cook County, Illinois, identified by Property Index Number 08-27-400-073-0000, declared eligible for Class 6B special circumstances status pursuant to the Cook County Real Property Classification Ordinance as amended July 27, 2018, is hereby granted in that this Board and the Village of Elk Grove Village, Illinois, has determined that the incentive provided by the said Class 6B Tax Incentive Ordinance is necessary for the said development to occur on the subject property, legally described as follows: THAT PART OF THE WEST 1/2 OF THE NORTH WEST 1/4 OF SECTION 32, TOWNSHIP 41 NORTH, RANGE 11 EAST OF THE THIRD PRINCIPAL MERIDIAN, COMMENCING AT THE INTERSECTION OF THE CENTER LINE OF THE STATE ROAD AND SOUTH STREET, THENCE SOUTH ON THE CENTER LINE OF THE STATE ROAD 2 1/2 CHAINS, THENCE WEST 2 CHAINS; THENCE NORTH 2 1/2 CHAINS TO THE CENTER LINE OF THE STATE ROAD AND SOUTH STREET, THENCE EAST ON THE CENTER LINE OF SOUTH STREET 2 CHAINS TO THE PLACE OF BEGINNING ALL IN COOK COUNTY, ILLINOIS. Section 2: That the Special Circumstances as outlined by the petitioner are attached hereto as Exhibit "A" and made a part thereof. Section 3: That the Village of Elk Grove Village, Illinois hereby supports and consents to the Class 6B Application and approves the classification of the subject property as Class 6B property pursuant to the Cook County Real Property Classification Ordinance and the Class 6B tax incentives shall apply to the property identified as Permanent Real Estate Index Number 08-27-400-073-0000. Elk Grove Village is in receipt of an economic disclosure statement that is required with the application packet. Section 4: That the Mayor and Village Clerk are hereby authorized to sign any necessary documents to implement this Resolution subject to the petitioner completing the following conditions within twelve months of closing: a. Upgrade the fagade; b. Update landscaping; c. Interior/exterior build out; d. Reconstruct the dock drive and apron per Village standards as needed; e. Resurface and seal coat the parking lot and drive as necessary; f. Installation of metal or composite panels over existing brick, and various other renovations. Potential Occupant & Emolovment The Applicant plans lease the property to a related entity, the Brian Allendorfer Company, Inc. ("BAC" or the "Occupant") a fifth generation roofing and contracting company. The company was originally founded in 1885 in Chicago by German Native, Philip Allendorfer. Beginning initially as a moonlighting activity, the trade soon a career that would be passed down for the next five (5) generations. Brian Allendorfer Company, Inc. is a licensed, bonded and insured roofing contractor with experience in residential, commercial and industrial roofing installation. The company is a member of the National Roofing Contractor Association as well as the Chicago Roofing Contractors Association, and is consistently "A" rated with the Better Business Bureau each year. BAC staffs each project with highly responsive, knowledgeable professionals who are current with the latest technology and installation techniques in the field. In addition to roofing services, the company's general contractors are well equipped to handle various other projects such as masonry, tuck -pointing, concrete, doors, windows, HVAC, drywall, windows, and flooring. The company not only specializes in residential work, but also commercial and industrial work of varying scope and size. BAC currents has 5-6 office workers and 4-5 warehouse workers, with plans to expand. Depending on continued growth and based on the current parking situation, the Applicant intends on hiring five (5) new full time employees to the property of the life of the incentive. The Applicant expects BAC's employees and will frequent Village restaurants, gas stations, stores and more. The company will also attract both new and returning customers who will frequent nearby establishments. According to the attached employee economic impact chart, 10-15 full time individuals arc cstimated to spend between $42,000 — $63,000 per year in the Village on gas, entertainment, groceries, etc. The Applicant also expects the proposed improvements described below to result in approximately 10-20 temporary construction jobs. Subject Property Improvements The Applicant is still in the progress of receiving estimates, but plans to spend upwards of $250,000 to $300,000 to make various improvements and repairs to the Subject Property. As part of these improvements, the Applicant plans to do significant interior, exterior and landscaping work. The Applicant plans to install a new concrete drive aprons, a new metal or composite panels over the existing brick, a new metal awning, new second story with storefront fagade, matching non-structural columns, new front double - doors, new accessible walkway, and infill the existing dock. Inside the property, the Applicant is planning rehabilitate or install new utility systems and significantly upgrade the existing office area. Please see the enclosed survey, property renderings, landscaping plan with proposed improvement annotations. Real Estate Tax and Economic Analysis After the purchase of the property and completion of improvements, the Subject Property is projected to have a market value of approximately $815,000, which would generate an estimated $294,221 in total taxes over the life of the Class 6b Tax Incentive (approximately $21,794 per year). Without the renewal and with full vacancy relief, the property would generate a total of $188,623 (or approximately $15,719 per year) over 12 years. Overall, should the incentive be approved, the Subject Properly is expected to generate over $100,000 more in property tax revenue than if it becomes vacant. As mentioned above, in addition to the increased property tax revenues the Brian Allendorfer Company's presence will significantly benefit the local community. In total, the purchase, rehabilitation and reoccupation of the Subject will generate approximately $600,000 in additional revenue over the life of the incentive. "But -For" Condition Statement Without the assistance from the Class 6b Tax Incentive, the Applicant will not purchase nor improve the Subject Property. The Applicant has determined that without the incentive, the heavy Cook County property tax burden (26%+ Effective Tax Rate) will force the Applicant to consider neighboring county or state for the project. In the event that the Applicant does not purchase the Subject Property, it will remain vacant and unused, thereby lowering its total taxes. Conclusion Based on the foregoing, the Applicant requests that Elk Grove Village review its Class 6b Tax Incentive request and approve a Resolution supporting and consenting to a Class 6b Tax Incentive for the TEM LAW amem or LISTON & TBANTIMS Subject Property based on Re -Occupation of Abandoned Property with a Purchase for Value, Special Circumstances and Substantial Rehabilitation. As such, the Village supports the use of the Cook County Class 6B Tax Abatement in cases where it is established that a tax disparity exists and is detrimental to tenancy and where the project presents a clear benefit to the community. The Village reserves the right to review applications and render its approval or disapproval based on the information provided. How the neighboring businesses will benefit from the proposed improvements. �n?.rrr i Elk Grove Village Class 6B Property Tax Terms and Agreement The APPLICANT shall perform the WORK upon the SUBJECT PROPERTY located at 1301 Jarvis Avenue in accordance with the PLANS and in full compliance with all applicable codes, ordinances, rules, regulations, permits, and plans as outlined in Attachment A, imposed by the VILLAGE, and shall complete the WORK in a good and workmanlike manner or risk voiding this agreement. The WORK shall include all building and landscaping alterations as proposed by the APPLICANT in exchange for the VILLAGE'S approval of a Cook County Class 613 Property Tax Abatement. The APPLICANT, will be issued a Letter of Receipt upon submission of a completed Elk Grove Village Class 6B Application Packet. This letter may be used to inform the Cook County Assessor's Office that the Village of Elk Grove is in receipt of the Applicant's request for a Cook County Class 6B Property Tax Abatement. The Letter of Receipt is not a guarantee of final approval and the Applicant may move ahead with their project at their own risk. The Letter of Receipt will serve as official notice that the APPLICANT is eligible for the incentive; however, final approval is not complete until there is an official Resolution passed by the Village. The Resolution will not be executed until such time all proposed work is complete. The APPLICANT has 365 days from taking ownership or tenancy to complete all proposed alternations and submit a full accounting of costs. If costs are not consistent with promises made in the original application, the APPLICANT may not be granted a final resolution of 6B approval.
