ACCOUNTS PAYABLE WARRANT: FEBRUARY 28, 2026 $18,350,771.87 MARCH 10, 2026 $648,328.25 6. CONSENT AGENDA a. Consideration to approve the third quarter financial report ending January 31, 2026. (As part of the financial software system, staff has created quarterly financial reports comparing year to date numbers to the prior year. (The Director of Finance recommends approval.) b. Consideration to grant special permission authorizing outdoor seating at Pies of London located at 1071 Rohlwing Road in conjunction with the seating plan approved by the Department of Community Development. (Pies of London submitted a request to the Village seeking approval to place a total of nine (9) tables, each with two (2) or three (3) chairs, on the sidewalk in front of the restaurant and on a newly constructed patio area to accommodate outdoor seating from April to November each year. (The Village has authorized similar requests for food establishments provided that there are no detrimental effects on the area. (Pies of London has agreed to maintain the area with respect to cleanliness and trash. (The Director of Community Development recommends approval.) Page 2 of 5 c. Consideration to increase the maintenance service contract with H&H Electric Co. of Franklin Park, IL for annual arterial and Business Park street light maintenance contract by $55,000. for a total contract amount of $231,468.46 from the Business Leaders Forum Fund. (On April 8, 2025 the Village Board awarded a contract to H&H Electric Co. of Franklin Park, IL for the annual arterial and Business Park street light maintenance. (The increase is due to the large number of insured repairs resulting from vehicle accidents and semi-trucks clipping poles while turning (Adequate funds are available in the Business Leaders Forum Fund. (The Director of Public Works has recommended approval.) d. Consideration to award a professional design-build service contract to V3 Companies of Woodridge, IL for the Landmeier Road intersection portion of the Tonne Road I improvements in the amount of $1,893,240 from the Business Leaders Fund and the Capital Projects Fund. (A proposal for professional design-build services was solicited from V3 Companies of Woodridge, IL for the reconstruction of the Landmeier Road and Tonne Road intersection. (V3 Companies has managed several construction projects for the Village and is overseeing the Tonne Road Reconstruction project. (Adequate funds are available in the Business Leaders Forum Fund and the Capital Projects Fund. (The Director of Public Works recommends approval.) e. Consideration to adopt Ordinance No. 3932 granting a Special Use Permit to Elk Grove Pet Clinic to operate a veterinary practice located at 1524, 1528 and 1532 Nerge Road, Elk Grove Village, Illinois. (This item was discussed at the February 24, 2026 Village Board Meeting and currently appears under Unfinished Business.) f. Consideration to adopt Ordinance No. 3933 granting a Special Use Permit to Schaumburg Bank & Trust Company, N.A., operating as Wintrust Community Bank, to operate a financial institution with a drive-thru at the real property located at 900 East Higgins Road, Elk Grove Village, Illinois. (This item was discussed at the February 24, 2026 Village Board Meeting and currently appears under Unfinished Business.) g. Consideration to adopt Ordinance No. 3934 amending Section 2-2 Definitions of the Zoning Code to Revise the Definition of Short-Term Rental for Residential Structures. (This item was discussed at the February 24, 2026 Village Board Meeting and currently appears under Unfinished Business.) h. Consideration to adopt Resolution No. 13-26 authorizing Release/Retention of Executive Session Minutes of the Village of Elk Grove Village (July 18, 2023 through December 12, 2023.) (As required by the Illinois Open Meetings Act, the Village has kept written minutes of all Executive Sessions. Page 3 of 5 (This Resolution allows the release of minutes from July 2023 through December 2023. (The Village Clerk recommends approval.) i. Consideration to concur with prior authorization and adopt Resolution No. 14-26 authorizing the Village Manager and Village Clerk to execute a Temporary Construction License Agreement between the Village of Elk Grove Village and Vue LA, LLC, a Delaware limited liability company, for property at 53 S. Arlington Heights Road and 111 E Higgins Road. (The Village and Developer entered into a Redevelopment Agreement on January 23, 2024, providing for the redevelopment of properties on the southeast corner of Arlington Heights Road and Higgins Road. (The Village is the owner of the property at 53 S. Arlington Heights Road and 111 E Higgins Road, which is currently occupied by a vacant retail strip center and related infrastructure and improvements. (The Village and the Developer are finalizing the closing for the property. (In order to meet critical timelines, the Developer is seeking to begin remediation and demolition prior to closing. (Approval of this license would authorize the Developer to utilize the property for these activities prior to closing.) j. Consideration to adopt Resolution No. 15-26 amending Resolution No. 61-96, 6-09, 60- 09, 16-11, 5-12, 4-14, 50-14, 53-19, 67-20, and 2-22 and authorizing the Mayor and Village Clerk to execute a Fifth Amendment to the Ground Lease Agreement between the Village of Elk Grove Village and SBA Towers X, LLC. (This amendment replaces a former amendment approved by R2-22, providing for SBA Towers X, LLC to sublease a portion of the leased premises at 813 Willow Lane to T- Mobile. (Although SBA Towers X, LLC agreed to the terms of the amendment approved by R2- 22, they never executed the amendment and currently owe the Village back rent. (This new amendment reflects the same terms as R2-22, but also requires the payment of past due rent for the subtenant. (All other terms and conditions of the Ground Lease remain intact. (The Village Attorney has reviewed this amendment and recommends approval.) k. Consideration to adopt Resolution No. 16-26, amending Resolution 36-98 and 31-17 and authorizing the Mayor and Village Clerk to execute a Second Amendment to the Lease Agreement between the Village of Elk Grove Village and New Cingular Wireless PCS, LLC at the property located at 1141 Hawthorne Lane. (New Cingular Wireless PCS, LLC leases space on the Village's water tower at 1141 Hawthorne Lane to place cell tower equipment. (This amendment provides for four additional five (5) year extension terms following the expiration of the current term on August 30, 2028. (The amendment also adds provisions allowing the Village to require relocation of the tenant, subject to certain conditions. (All other terms and conditions of the Lease remain intact, including the annual 4% rent escalator. (The Village Attorney has reviewed this amendment and recommends approval.) Page 4 of 5 l. Consideration to adopt Resolution No. 17-26 authorizing the Mayor to execute a Letter of Receipt stipulating the terms of an agreement for an application seeking a Cook County Class 6B Property Tax Exemption status pursuant to the Cook County Real Property Classification Ordinance as amended July 27, 2018 for certain real estate located at 1700 Estes Avenue. (The Law Offices of Holland Hicks Law, on behalf of their client 1700 Estes LLC (Applicant) is seeking a Cook County Class 6B property tax exemption for property located at 1700 Estes. (The Applicant purchased the 51,064 square foot industrial facility and plans to lease out the space to suitable industrial tenants in the warehousing/distribution/manufacturing sectors. (Depending on the type of user, it is estimated that the tenant will employ about 12-15 full- time employees at this facility. (Bratt Capital Partners is a commercial property management company that owns multiple commercial properties. (The Applicant will refurbish the building to increase its functionality and improve the building at an estimated cost of $1.188 million. (Improvements will include the replacement of the existing loading dock, the removal and replacement of landscaping, resurfacing the existing parking lot, removal of the existing monument sign and pole sign, new EIFS paneling, new windows, repair and installation of sidewalks to man doors on the building. (The eligibility requirements for 6B status are new construction, substantial rehabilitation or buildings that have been vacant for a period of time. This site qualifies based on the Reoccupation of Abandoned Property with greater than 12 months vacancy with a Purchase for Value, Substantial Rehabilitation and Special Circumstances. (Property approved for Class 6B status allows the owner of the property to have the assessment level lowered for a period of twelve years. The assessment schedule is 10% of fair market value for ten years, then 15% in the eleventh year and 20% in the twelfth year. Industrial property is currently assessed at 25% of fair market value in Cook County. (Upon approval, the Director of Business Development & Marketing will issue a Letter of Receipt to the Applicant. The Letter of Receipt will allow the Applicant to file an application with Cook County. Final approval is at the discretion of the Village Board and contingent on the Applicant completing the improvements stated in their application. Third Quarter Ending January 31, 2026 BACKGROUND: The third quarter financial report ending January 31, 2026 is attached. This report itemizes the General Fund, Business Leaders Forum (BLF) Fund, and the Water/Sewer Fund year-to-date actuals in comparison to the prior year-to-date actuals as part of the features of the software reporting system. General Fund The General Fund received $59.00 million in revenues at the end of the third quarter of fiscal year 2026. General Fund revenues are primarily comprised of property taxes, sales taxes, business licenses, and building permits. General Fund revenues are down $1.85 million, or 3.04% from the prior year, largely due to a decrease of $3.01 million in licenses and permits for construction of new data centers. Interest income generated $405,598 less revenue than FY25 Q3 due to investments performing in a declining rate environment. Expenditures in the General Fund totaled $59.15 million in FY26 Q3, representing a decrease of $2.67 million, or 4.32% from the previous year. A $7.19 million decrease in Non-Operating expenses is mainly what contributed to the decrease in General Fund expenditures. Business Leaders Forum (BLF) Fund Effective July 1, 2021, the Natural Gas Use tax increased from $0.02 per therm to $0.05 per therm. The BLF share of the revenues increased from $0.01 per therm to $0.03 per therm. In the third quarter of FY26, the BLF portion of the tax generated $2.04 million, which is down $58,356, or 2.78% from the third quarter of FY25. BLF Fund expenditures in total decreased $15,579, or 0.41% from the third quarter of FY25, primarily due to the timing of when business marketing campaign costs were recorded. Water/Sewer Fund Water/Sewer Fund revenues are down $5.71 million, or 25.54% from FY25. An interfund contribution of $5.0 million revenue was received during Q3 of FY25, and no interfund Page 2 of 2 transfer transpired during FY26. Other sources of revenue included charges for service, which decreased $492,753, and interest income which decreased $217,428 due to a declining interest rate environment. Water/Sewer Fund expenditures are down $1.29 million, or 5.93% from the previous year. This is due in part to lower expenditures on construction and infrastructure in the third quarter of FY26 compared to FY25, which is shown through a $1.96 million decrease in fixed capital expenditures. Property tax receipts decreased $0.33 million, or 16.34% from FY25 Q3, which can be partially attributed to the Village lowering the tax levy. Commercial Real Estate Transfer Tax increased $0.45 million, or 294.82%, due to the sale of 200 Innovation Drive, operated by T5 Data Center. Revenue received from the State of Illinois has experienced an increase over the past five years, with the exception of use tax revenues. The decrease in use tax revenues is associated with the 2021 sales tax law described below, as certain out–of-state transactions are now collected as sales tax instead of use tax. Municipal Sales Tax/Home Rule Sales Tax increased a combined $2.32 million, or 34.63% from FY25. The Village issued several large building permits for the construction of new data centers during FY25, whereas in FY26 there were less permits issued. Crime free housing decreased $137,250, or 335.35%, as a result of a change to a calendar year from the previous license period of October 1 – September 30. In 2024, licenses were extended to December 31, 2025 as a result of this change. Charges for Service decreased by $0.25 million, or 10.16% from FY25. Ambulance fees, which increased $0.24 million or 11.45% from the prior year, comprised a majority of this difference. Ambulance fees are impacted by the timing in which the Village is reimbursed by the state for emergency ambulance services. Through participation in the Ground Emergency Medical Transportation (GEMT) program, the Village receives revenues from the state to cover the costs of ambulance services not covered by Medicaid. Interest Income decreased $0.41 million, or 22.93% from the previous year due to a declining interest rate environment. Federal interest rates remained at or above 4% during the first and second quarter of FY26, however slightly dipped below during the third quarter being reduced down to 3.75% in the month of January 2026. Non-Revenue Receipts are up $0.58 million, or 26.91% from the previous year as a result of netting all interfund transfers from the Water Fund into the month of May instead of throughout the year or a monthly basis. Personnel changes since the previous fiscal year that contributed to this increase include the following: • Fulfillment of a Management Analyst in the Human Resource Department. • Fulfillment of public works, police, and fire vacancies. • Cable personnel are now recorded in the general fund since the elimination of the Cable Fund in FY26. Maintenance Services consists of service agreements and contract maintenance for vehicles, equipment, and streets. FY26 increased by $0.41 million, or 21.47% compared to last year in part due to the timing of payments for Accela in community development and flock safety automated license readers for public safety. Operating Capital costs are up $0.13 million, or 18.58% since FY25. Capital obtained this fiscal year includes new computer equipment for the police and fire departments, new copiers for the village clerk and human resources, software for finance, and a new vehicle for community development, police, and fire departments. Fixed Capital expenditures are up $446,646, or 9,818.99% compared to last year, due to the timing of costs incurred for the Village Hall renovations. Non-Operating costs have decreased by $7.19 million, or 65.95% from the previous year as a result of $2.66 million of emergency relief contributions in the form of gift cards that were distributed to residents during FY25, whereas none were distributed during FY26. In addition, the prior year had an internal transfer to the Water/Sewer Fund of $5.0 million for funding projects that included the elevated water tank construction completion, pump house and well rehabilitations, rear yard drainage improvements, and Brantwood Avenue water main improvements, whereas no internal transfer was made in FY26. Operating Capital expenditures decreased $.70 million, or 82.12% mainly due to costs related to the purchase of two dump trucks with plows that were recorded during Q3 of FY25, whereas a backhoe loader was the only purchase during the third quarter of FY26. Fixed Capital costs are down $1.96 million, or 37.02% from the previous year. Construction infrastructure costs are lower than prior fiscal year due to the fluctuation with the timing of recording the costs. Expenditures related to ongoing projects such as the Brantwood Avenue Water Main Replacement, Manhole Rehabilitation Project, and the Rear Yard Drainage Program were incurred during the third quarter of FY26. Roan, Village Manager FROM: Jared Polony, Director of Community Development SUBJECT: Outdoor Seating Pies of London- 1071 Rohlwing Road BACKGROUND: We are in receipt of a request from Adedunke Sonaike, owner of Pies of London, seeking Village approval for outdoor seasonal dining. The outdoor seating will be located on the sidewalk in front of the restaurant and on a newly constructed patio area. There will be a total of nine (9) tables, each with two (2) or three (3) chairs and the outdoor dining will be offered from April to November each year. The Village has permitted similar requests for food establishments subject to meeting the criteria established for outdoor seating areas. As part of each of these approvals, Village staff has reviewed the requests to ensure that there will be no detrimental effects on the area immediately surrounding the seating area and that the petitioner will properly maintain the site for cleanliness and trash. We have reviewed this request and respectfully recommend that the Mayor and Board of Trustees grant the requested outdoor seating subject to the condition that the petitioner maintains the area with respect to cleanliness and trash. If at any time the petitioner fails to meet the requirements of the Village, the special permission will be rescinded. AN ORDINANCE AMENDING SECTION 2-2 DEFINITIONS OF THE ELK GROVE VILLAGE ZONING CODE TO REVISE THE DEFINITION OF SHORT-TERM RENTAL FOR RESIDENTIAL STRUCTURES_____________________________________________ WHEREAS, the Village of Elk Grove Village (the “Village”) is an Illinois home rule municipal corporation organized and operating under the Constitution and laws of the State of Illinois; and WHEREAS, pursuant to its home rule authority and the Illinois Municipal Code, the Village has adopted the Elk Grove Village Zoning Code (the “Zoning Code”), including Section 2-2 setting forth definitions applicable to land uses within the Village; and WHEREAS, the Mayor and Board of Trustees of the Village (the “Corporate Authorities”) have determined that it is necessary and appropriate to amend the definition of “Short-Term Rental” in Section 2-2 of the Zoning Code; and WHEREAS, the Corporate Authorities have determined that this amendment promotes the public health, safety, and welfare of Village residents and preserves the character and integrity of residential neighborhoods; and WHEREAS, on February 9, 2026, the Plan Commission held a duly noticed public hearing on the proposed text amendment and thereafter recommended approval of the amendment to the Corporate Authorities; NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows: Section 1: Incorporation of Recitals. The recitals set forth above are incorporated into this Ordinance as findings of the Corporate Authorities as if fully set forth herein. Section 2: Amendment to Section 2-2 – Definitions. Section 2-2 of the Zoning Code is amended by revising the Definition of “Short-Term Rental” as follows (deletions stricken and additions underlined): SHORT TERM RENTAL: A residential structure, offered for rent for a period which does not exceed thirty (30) ninety (90) consecutive days. The term Short-Term Rental shall not include hotels. All other provisions of Section 2-2 shall remain unchanged. Section 3: Publication. The Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form in accordance with law. Section 4: Conflicts. In the event of a conflict between the provisions of this Ordinance and any other ordinance, resolution, or portion thereof, the provisions of this Ordinance shall govern. Section 5: Severability. This Ordinance and every provision thereof shall be considered severable. If any word, phrase, clause, sentence, paragraph, provision, section, or part of this Ordinance is found by a court of competent jurisdiction to be void, unconstitutional, or otherwise unenforceable, all remaining portions of this Ordinance not so declared void, unconstitutional, or unenforceable shall remain in full force and effect. Section 6: Effective Date. This Ordinance shall be in effect immediately from and after its passage and approval in the manner provided by law. Roan, Village Manager FROM: Sue Dees, Director of Business Development & Marketing SUBJECT: Request for a Cook County 6B Property Tax Abatement - 1700 Estes Avenue BACKGROUND: The Law Offices of Holland Hicks Law, on behalf of their client 1700 Estes LLC (Applicant) is seeking a Cook County Class 6B property tax exemption for property located at 1700 Estes.The Applicant purchased the 51,064 square foot industrial facility and plans to lease out the space to suitable industrial tenants in the warehousing/distribution/manufacturing sectors. Depending on the type of user, it is estimated that the tenant will employ about 12-15 full-time employees at this facility. Bratt Capital Partners is a commercial property management company that owns multiple commercial properties. The Applicant will refurbish the building to increase its functionality and improve the building at an estimated cost of $1.188 million. The eligibility requirements for 6B status are new construction, substantial rehabilitation or buildings that have been vacant for a period of time. This site qualifies based on the Reoccupation of Abandoned Property with more than 12 months vacancy with a Purchase for Value, Substantial Rehabilitation, and Substantial Rehabilitation. Property approved for Class 6B status allows the owner of the property to have the assessment level lowered for a period of twelve years. The assessment schedule is 10% of fair market value for ten years, then 15% in the eleventh year and 20% in the twelfth year. The Property has experienced long-term vacancy and significant deterioration, resulting in the need for substantial capital investment to address deferred maintenance, code compliance upgrades, and modernization of building systems. Renovation work commenced on October 16, 2025, and is scheduled for completion by April 30, 2026, with an approximate total project cost of $1,188,000. The proposed rehabilitation and subsequent industrial use of the Property would not be financially feasible without the assistance of the Class 6b incentive. The extraordinary rehabilitation costs, when combined with prevailing market rental rates and operating expenses, create a significant financing gap that prevents the project from achieving a reasonable return on investment. The 6b incentive is therefore essential to offset these costs and make the redevelopment economically viable. Without this incentive, the Property would likely remain underutilized or vacant, and the community would not realize the associated economic, employment, and tax base benefits of the proposed industrial reuse. The Applicant created approximately 10 construction jobs during the property improvements. Once a tenant is secured, the property is expected to initially employ 12–15 full- time employees, with the potential to add up to 15 additional employees over the next 10 years. While the Class 6b incentive reduces the assessment level from 25% to 10% for an industrial property for the first ten years (15% in the eleventh year and 20% in the twelfth year), the Property has the potential to generate greater overall property tax revenue—even with the incentive—than it would if it were to remain vacant or underutilized.
