A RESOLUTION DIRECTED TO THE COOK COUNTY ZONING BOARD OF APPEALS
REGARDING A PETITION BEFORE THE BOARD FOR A ZONING CHANGE FOR
PROPERTY LOCATED ON THE NORTH SIDE OF HIGGINS ROAD JUST EAST OF
THE COMMONWEALTH EDISON COMPANY RIGHT OF WAY
WHEREAS, the petitioner Matthew J. Berardi and the Owners, Palatine
National Bank as Trustee under Trust No. 941 of property legally described
as follows:
Legal Description: Of that part of the East one half of the Southeast
one quarter of Section 22, Township 41 North, Range 11, East of the
Third Principal Meridian; Commencing at the intersection of the center
line of Higgins Road as originally located with the West line of said
East one half, thence Southeasterly along said center line 213.8 feet
to the East line of a tract owned by Commonwealth Edison Company for
the place of beginning; thence North 208.70 feet, thence East 277.77
feet, thence South 261.76 feet to the center line of Higgins Road,
thence northwesterly along said centerline, 238.79 fee to the place
of beginning in Cook County, Illinois.
have petitioned for re -zoning of same from 1-1, Restricted Industrial District
to C-8, Intensive Commercial District under Cook County Zoning, to permit the
construction of a building for the operation of a Sporting Goods Store, Gun
Shop, Indoor Range, Instruction Classes and related needs; and
WHEREAS, said case has been docketed as Docket No. 2918 by the Cook County
Zoning Board of Appeals; and
Whereas, the subject property is within one and one-half miles of the
Village of Elk Grove Village.,
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of
the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois:
Section 1. That the Village of Elk Grove Village does hereby wish to
express its concern to the petitioner's request for re -zoning of the subject
property described above for the following reasons:
1. There is no water nearby for fire protection. Two recent fires -
one at Snacktime Restaurant and the other at the Hyatt Chalet,
as examples of the need of water for fire protection.
2. The pistol range and its store would be subject to break-in for
weapons and ammunition, and that only Cook County sheriff protection
is available for this location, and the response time normally is
long because of the vast areas that the sheriff has to patrol and
protect.
3. Concern with the traffic access to this property as displayed when
an aerial photograph was submitted as evidence because Higgins Road
turns 90o at this point, and in the middle of this turn would be
the entrance to Old Higgins Road. Within the past year there has been
a traffic fatality at this corner.
4. We are concerned that the building be properly constructed and inspected
for the type of hazard it would contain with the storage of weapons
and ammunition.
Section 2. That this resolution shall be in full force and effect from
and after its passage and approval according to law.
Section 3. That the Village Clerk's Office is hereby directed to submit
the foregoing resolution to the Cook County Zoning Board of Appeals.
