Zoning Variation — Docket #25-3, Hearing Continuance, 570 Rutgers Lane
Chairman Childress called the meeting to order at 7:00 p.m. and read a statement describing the hearing
notification procedure as well as the legal notice.
Section 3-3-B: (2) prohibits fences from being constructed beyond a line extended from the nearest front
corner of the principal building located on an adjacent single-family residential lot. The petitioner is
requesting to install a six (6') feet high fence which will extend approximately thirty-five (35') feet beyond
the nearest front corner of the principal structure on the adjacent single-family residential lot, to the
southwest at 567 Jersey Lane. The fence will follow the southwest lot line along the radius of Jersey Lane
and be constructed approximately four (4') feet from the lot line.
The petitioner, Monika Farfan (Owner of Record) was sworn in and asked to proceed with the continuance
of her zoning variation request.
The petitioner stated she has come to a compromise for the location of the fence with her neighbor Karen
Laper, 567 Jersey Lane. The new location of the fence will extend approximately thirty-one (31') feet
beyond the nearest front corner of the principal structure on the adjacent single-family residential lot, to
the southwest at 567 Jersey Lane. The fence will follow the southwest lot line along the radius of Jersey
Lane and be constructed approximately nine (9') feet from the lot line. The southwest corner of the fence
will not be squared off but will be on an approximate forty-five (45) degree angle at a reference point near
the neighboring property at twenty-five (25') feet from the sidewalk.
Chairman Childress opened the meeting to questions from the board.
Member Spragg commended the petitioner in compromising with the neighbor.
Member Latrofa asked the petitioner if she would remove the landscaping along the sidewalk and the
proposed fence.
The petitioner stated that she will be removing the landscaping in the future.
Members Childress, Garcia, Glimco, Fowler and Rawleigh had no questions.
Chairman Childress asked if there were any additional comments or questions from the Members or the
public.
Karen Laper, 567 Jersey Lane, stated that she has agreed to the compromise between her and the
petitioner. Karen stated that she would like to be clear on the diagonal portion of the fence starting at
twenty-five (25') feet from the sidewalk and heading on an angle towards the sidewalk to a point of nine
(9') feet from the sidewalk.
Member Fowler asked staff that the location of the proposed fence reference points will be adhered to
by the village inspectors and the fence location cannot be altered by the fence company.
Elk Grove Staff Member stated that all location points agreed on at this hearing will be adhered to and
no alteration can be done.
Robert Didomenico, 578 Jersey Lane, stated he objects to the new proposed fence location.
The Community Development Department stated they had received no additional phone calls or emails
and had no objection to the variation request.
Chairman Childress called for motion.
A motion to DO GRANT was made by Member Latrofa and seconded by Member Glimco, for the
petitioner to install a six (6') feet high fence which will extend approximately thirty-one (31') feet
beyond the nearest front corner of the principal structure on the adjacent single-family residential lot,
