A RESOLUTION A24ENDING THE ANNEXATION
AGREEMENT BETWEEN THE VILLAGE OF
ELK GROVE VILLAGE AND FIRST ARLINGTON
NATIONAL BANK, AS TRUSTEE, UNDER
TRUST NO. A-243 (NOW TRUST NO. 638),
AS IT PERTAINS TO THE COMPLETION OF
BIESTERFIELD ROAD EXTENSION AND THE
PAYMENT OF THE DONATION TO THE
MUNICIPAL PURPOSE -TRAFFIC SIGNAL FUND
WHEREAS, the Village of Elk Grove Village and First Arlington
National Bank, as Trustee, under Trust No. A-243, entered into an
Annexation Agreement adopted by Resolution 32-1975; and
WHEREAS, First Arlington National Bank, as Trustee, under Trust
No. 638, is the successor -in -interest to Trust No. A-243; and
WHEREAS, said agreement required the completion of Biesterfield
Road and the payment of $7,600.00 into the Municipal Purpose -Traffic
Signal Fund by April 22, 1977; and
WHEREAS, due to circumstances beyond the control of the developer
and delays -in construction, the developer has been unable to meet the
above time deadline and has requested an extension thereof; and
WHEREAS, it is the opinion of the President and Board of Trustees
of the Village that such an extension does not materially alter the
above -referenced Annexation Agreement:
NOW, THEREFORE, BE IT RESOLVED by the President and Board of
Trustees of the Village of Elk Grove Village, Cook and Du Page Counties,
Illinois, as follows:
Section 1: That Paragraph 3A of the Annexation Agreement between
the Village of Elk Grove Village and First Arlington National Bank be
amended as it pertains to the completion of the Biesterfield Road
extension to the following time schedule:
A). The initial cut of the roadway has heretofore
been completed to the property grade.
B). The installation of eight inches of gravel on
or before July 22, 1977.
C). The required curbing on the north side of the road
shall be completed on or before August 21, 1977.
D). The first lift of asphalt surfacing shall be
installed on or before September 10, 1977.
E). The final lift will be installed immediately following
the completion of the last townhouse building, or earlier if
mutually agreed upon by the Village and the developer.
It is understood that all pledged security heretofore delivered to
the Village for public street improvement will be in full force and
effect and will be applicable and binding on the above schedule of
construction completion.
Section 2: That Paragraph 21 of said Annexation Agreement be
amended by providing that the payment of $7,600.00 to the Municipal
Purpose -Traffic Signal Fund be made no later than August 22, 1977.
Section 3: That this Resolution shall be in full force and
effect from and after its passage and approval according to law.
