A RESOLUTION AUTHORIZING THE SIGNING OF AN INTER-GOVERNMENTAL AGREEMENT
BETWEEN ELK GROVE TOWNSHIP AND THE VILLAGE OF ELK GROVE VILLAGE FOR
RE-SURFACING OF OAKTON STREET BETWEEN SHADYWOOD LANE AND SEEGARS AVENUE
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, State of
Illinois:
Section 1 . That the Village President be and is hereby authorized to
sign the attached document marked ''Inter-Governmental Agreement'' between Elk
Grove Township and the Village of Elk Grove Village, a copy of which is attached
hereto and made a part hereof as if fully set forth and the Village Clerk is
authorized to attest said document upon the signature of the Village President.
Section 2. That this resolution shall be in full force and effect from
and after its passage and approval according to law.

INTER-GOVERNMENTAL AGREEMENT
THIS AGREEMENT made and entered into this 12th day
of September 1 1977 by and between the Village of Elk Grove
Village, a municipal corporation, and Elk Grove Township, a munici-
pal corporation, for the purpose of necessary repair work to Oakton
Street between Shadywood Lane and Seegers Avenue.
W I T N E S S E T H
1. WHEREAS , the north one-half of Oakton Street between the
intersections of Shadywood Lane and Seegers Avenue is in unincor-
porated Cook County under the jurisdiction for road maintenance
purposes of Elk Grove Township; and
2 . WHEREAS , the south one-half of said street is in the
village limits of Elk Grove Village and under the jurisdiction for
road maintenance purposes of the Village; and
'3 . WHEREAS, said road is in need of repairs and the Township
and the Village of Elk Grove Village agree that it is in the best
interests of both parties to jointly undertake and contract for the
necessary materials to effectuate such repair work.
IT IS HEREBY AGREED by and between the parties hereto as
follows :
1. That the Village of Elk Grove Village will purchase , pur-
suant to bids , the following materials :
a) Approximately 728 tons of asphalt.
b) Approximately 300 tons of stone.
c) Approximately 500 gallons of emulsion.
2 . That the Village will proceed to cause the repaving of
Oakton Street between Shadywood Lane and Seeger Avenue and the
Township will make available such equipment and man power as is
necessary for assistance in hauling the above material.
3 . That upon payment by the Village of the material cost of
the asphalt, stone and emulsion, the Township agrees to reimburse
the Village fifty (50%) percent of said cost as evidenced by a
bill of sale or a paid receipt therefor. All payments will be made
by the Township Dept. of Highways and all equipment and man-power
furnished by the Dept. of Highways will be under the jurisdiction of
the Township Hishway Commissioner.
4 . That each party will hold the other harmless for any
damages as the result of the negligence of either party in the
performance of their obligations under this Agreement.
