RESOLUTION N0, 34-76
A RESOLUTION AUTHORIZING A CERTIFICATE OF AUTHORITY AND THE ISSUANCE
OF LICENSES TO THE ELK GROVE VILLAGE CAB COMPANY AND T & D CAB SERVICE INC.
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of
the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois:
Section is That the President and Village Clerk are hereby authorized
and directed to sign the certificate of authority attached hereto and made
a part hereof.
Section 2: That the President and Village Clerk shall issue, upon
payment of the proper fees, the licenses set forth in the accompanying
certificate of authority.
Section 3: That this resolution shall be in full force and effect from
and after its passage and approval according to law.

CERTIFICATE OF AUTHORITY ISSUED PURSUANT TO
SECTION 18.4205 OF THE MUNICIPAL CODE OF ELK
GROVE VILLAGE, ILLINOIS
WHEREAS, the President and Board of Trustees of the Village
of Elk Grove Village, sitting as a vehicle commission, did conduct
a public hearing for the purpose of ascertaining the public need
for taxicab service within the Village of Elk Grove Village, in
accordance with its ordinances and the laws of the State of
Illinois, and
WHEREAS, the ELK GROVE VILLAGE CAB COMPANY and T & D CAB
SERVICE, INC. are presently engaged in the taxicab business and
are desirous of servicing the Village of Elk Grove Village and
its residents with taxicab service, and have presented convincing
evidence to the authorities of the Village of Elk Grove Village
of their ability to provide suitable and adequate taxicab service
for the residents of the Village.
NOW, THEREFORE, IT IS CERTIFIED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook and
DuPage, Illinois, acting in the capacity of a vehicle commission:
1. That there is an immediate public need for taxicab
service in the Village of Elk Grove Village and that the issuance
of licenses for ten taxicabs to the ELK GROVE VILLAGE CAB COMPANY
and ten taxicabs to the T & D CAB SERVICE, INC. would satisfy
said immediate need for benefit to the public.
2. That in the event that sufficient taxi service is not
provided by said ELK GROVE VILLAGE CAB COMPANY and T & D CAB
SERVICE, INC., the President and Board of Trustees will conduct
a public hearing and, if at that time, in its sole discretion the
ELK GROVE VILLAGE CAB COMPANY and/or T & D CAB SERVICE, INC. have
not kept up with the need for taxi service, the President and
Board of Trustees shall have the right to terminate the franchises
plus the right of the ELK GROVE VILLAGE CAB COMPANY and/or T & D
CAB SERVICE, INC. to have future requests for taxicab service and
licenses, if the additional service deemed necessary by the
President and Board of Trustees is not provided within thirty
days after written request.
3. Nothing in this certificate of authority shall prevent
or be so construed to prevent the Village of Elk Grove Village
from issuing such additional licenses, as it may deem necessary
in accordance with its ordinances and the laws of the State of
Illinois, to any person or corporation whatsoever.
4. That the Village President in accordance with this
certificate shall be and is hereby authorized to issue ten licenses
to the ELK GROVE VILLAGE CAB COMPANY and ten licenses to the
T & D CAB SERVICE, INC.
