HomeMy WebLinkAboutRESOLUTION - 45-76 - 7/13/1976 - PRE ANNEX AGRMT/RAZIM PROPERTYRESOLUTION NO. 45-76 A RESOLUTION AUTHORIZING A PRE -ANNEXATION AGREEMENT/ RAZIM PROPERTY NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois, as follows: Section 1: That the Pre -Annexation Agreement, a copy of which is attached, relating to the annexation of property known as the Razim property and referred more specifically therein is hereby approved and the Village President and the Village Clerk are authorized to execute same and the Village Clerk is authorized to record same with the Recorder of Deeds of Cook County, Illinois. Section 2: That this Resolution shall be in full force and effect from and after its passage and approval according to law. PASSED this 13th day of July , 1976. APPROVED this 13th day of July , 1976. VOTE: AYES 5 NAYS 0 ABSENT 1 ATTEST: ��� VILLAG C ERK 4 ANNEXATION AGREEMENT - CHARLES RAZIM Southwest Corner of Biesterfield Road and Leicaster Road THIS AGREEMENT made and entered into this 13th day of July 1976, between the Village of Elk Grove Village, a municipal corporation of the State of Illinois ("the Village") and Charles Razim, 555 West Biesterfield Road, Elk Grove Township ("the Owner"). WHEREAS, the Owner is the owner of record of certain real estate which is located in the unincorporated portion of Cook County contiguous and entirely surrounded by the Village and is legally described as follows: THE EAST 170.71 FEET, AS MEASURED ALONG THE NORTH LINE, OF THE NORTH 315.37 FEET, AS MEASURED ALONG THE EAST LINE THEREOF, OF THE SOUTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 32, TOWNSHIP 41 NORTH, RANGE 11, EAST OF THE THIRD PRINCIPAL MERIDIAN, EXCEPT THE NORTH 60.0 FEET THEREOF, IN COOK COUNTY, ILLINOIS. WHEREAS, the owner is desirous of annexing said property to the Village, and WHEREAS, the parties hereto desire to enter into an agreement to con- clude the annexation, and WHEREAS, the Owner has filed with the Village Clerk a duly executed petition for the annexation of said property, and WHEREAS, the Corporate Authorities of the Village have considered the annexation of said property and have determined that the best interests of the Village require that the property be annexed to the Village. NOW, THEREFORE, in consideration of the foregoing, it is mutually agreed, by and between the parties, that: 1. The Owners and/or their heirs and assigns do hereby agree: (a) To install at their own expense any and all distri- bution mains and other necessary equipment needed to connect said property to the Elk Grove Village water system in accordance with the directions of the Village Engineer and the Ordinances of the Village. It is understood that the existing private well on the property may be used for human consumption and for yard irrigation purposes until the water supply fails, or until the subject property is sold or leased to another party, whichever first occurs. (b) To install at their own expense any and all sanitary sewer lines and other necessary equipment needed to connect said property to the Elk Grove Village sanitary sewer system in accordance with the directions of the Village Engineer and the Ordinances of the Village at such time as the septic system fails to function or at such time as the subject property is sold or leased to another party, whichever first Bccurs. this VILL (c) To construct at the owner's expense a five-foot wide public sidewalk adjacent to Biesterfield Road and one foot into its Right -of -Way as required by the Elk Grove Village Sub- division Control Ordinance at such time as a sidewalk is constructed across the property west of the subject property or when the subject property is sold or leased to another party, whichever first occurs. (d) To waive refund of all taxes previously paid pursuant to Tax Bills prepared by the Cook County Collector. 2. The Village of Elk Grove Village does hereby agree: (a) To enact an ordinance in the form required by law annexing said property upon the terms and conditions set forth in this agreement. (b) To rezone the property to R-3 residential zone, and that said property shall be subject to all general restrictions of said zoning district presently in effect. (c) To waive all annexation and zoning fees and all charges for the privilege of connecting to the Village's water and sewer lines. 3. In the event the owner shall not perform all of the conditions noted above, then the Village shall have the option to disconnect said property from the Village and not furnish water, sewer and/ or any other services. 4. This agreement shalt be binding upon the successors in title of the Owner and upon successor corporate authorities of the Village and successor municipalities. The agreement shall be valid and binding for a period of ten (10) years from the date of its execution. IN WITNESOHEREOF, the parties have affixed their hands and seals 13th day—sf July , 19 76 .
