HomeMy WebLinkAboutRESOLUTION - 68-88 - 10/25/1988 - REZONE 955 BIESTERFIELD RD/BEAUPRE RESOLUTION NO. 68-88 A RESOLUTION DIRECTING THE COUNTY OF COOK AS TO NO OBJECTIO14 BY THE VILLAGE OF ELK GROVE VILLAGE WITH RESPECT TO REZONING, SPECIAL AND UNIQUE USES FOR 955 BIESTERFIELD ROAD, UNINCORPORATED ELK GROVE TOWNSHIP (BEAUPRE) WHEREAS, Mr. and Mrs. Robert G. Beaupre and Robert E. Beaupre are the Owners of the property known as 955 Biesterfield Road in unincorporated Elk Grove Township; and WHEREAS, the Owners have petitioned the Cook County Zoning Board of Appeals to consider an application to rezone 955 Biester- field Road from the R-4 Single Family Residence District to the C-4 General Commercial District; and WHEREAS, the Owners have also petitioned the Cook County Zoning Board of Appeals to consider an application for a Unique Use for a landscaping business and a Special Use for proprietor' s residence; and WHEREAS, a public hearing before the Cook County Zoning Board of Appeals was held on September 9, 1988 at the Elk Grove Village Hall; and WHEREAS, a representative of Elk Grove Village was present and heard the testimony offered at the public hearing; and WHEREAS, the owners held a meeting with their neighbors in the Itasca Meadow Farms Subdivision subsequent to the public hearing; and WHEREAS, the Owners requested an opportunity to appear and did appear before the Elk Grove Village Board of Trustees to explain their petition for rezoning and Special Use; and WHEREAS, the owners indicated that they are willing to place conditions on their petitions in order to protect the village of Elk Grove; and WHEREAS, the Village of Elk Grove Village feels that it is in the best interests of the Village to not object to the Owners rezoning and Special Use petitions subject to the condi- tions stated herein and as agreed to by the owners . NOW, THEREFORE, IT IS HEREBY RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows : Section 1: That the Village of Elk Grove Village does not object to the petitions for rezoning and Special Use subject to the following conditions : A. That the propert, be zoned in the C-4 General Commercial District with a Special Use which shall limit the permitted uses on the property to only the following uses : (i ) The C-4 uses consistent with and contained in the O/T Office Transitional District of the Elk Grove Village Zoning Ordinance; and (ii ) The C-4 uses set forth on Exhibit A attached hereto; and (iii ) The Special. Use for a landscaping business and proprietor' s residence as applied for in Cook County Docket No. SU-88-29 ; B. That there be no further construction upon the property for the existing operation without the consent of the Village of Elk Grove Village during the time that the Special Use Permit is in full force and effect. -2- C. That in the event any redevelopment upon the pro- perty is planned, then and in that event the Owners shall negotiate the terms of an Annexation or Preannexation Agreement with the Village to obtain Elk Grove ' s prior approval of the redevelopment. D. That in the event of an abandonment of the present use, as "abandonment" is defined in the Cook County Zoning Ordinance, the owner at the time of abandon- ment or new Owner shall abide by those uses referred to in Paragraph A. above, exclusive of the landscape business. Section 2: That a copy of this Resolution shall be forwarded to the Cook County Zoning Board of Appeals. Section 3: That this Resolution shall be in full force and effect from and after its passage and approval according to law. VOTES : AYES: 4 NAYS: 0 ABSENT: 1 ABSTAIN: APPROVED: Charles J.
