"MuniciPaIity!": A City, Village or Fire Protection District having a recognized Fire Department; • B. "Mutual Aid": A definite and prearranged written agree- ment and plan whereby regular respon:;e and assistance is provided for in event of alarms ,from certain, boxes or locations in a Stricken Municipality by the Aiding Muni- cipality in accordance with the Box Alarm Assignments as developed by the Fire Chiefs of each Municipality; 2 - C. "Participatinq MuniciiDalities": A Municipality that commits itself to this Mutual Aid Agreement by adopting a resolution authorizing participation in the progran with another participating Municipality for rendering and receiving Mutual Aid in the event of a fire or other disaster in accordance with the Box Alarm Assignments; D. "Stricken Municipality': The Municipality in which fire other disaster occurs that is of such a magnitude that cannot be adequately handled by the local Fire Departs., E. "Aidinq Municipality": The Municipality furnishing fir,: equipment and manpower to the Sfricken Municipality. SECTION THREE - AGREEMENT TO EFFECTUATE THE MUTUAL AID PLAN The Village President, Mayor, or Board of Trustees of each participating Municipality is authorized on behalf of that „uric;: to enter- into and from time to time to alter and mend on the the Fire Chief and with the consent of the governing body of No- Municipality, and agreement with another Municipality for Mut.::! according to the following: 1 . Whenever a fire W disaster is of such magnitude and consequence that it is deemed advisable by the Sonicr present, of the Stricken Municipality, to- request as; ! - of the Aiding Municipality, he is hereby authorized to under the terms of this Mutual -Aid Agreement and the So: Officer present of the Aiding Municipality is authori __._ ' and shall forthwith take the following action. a. Immediately determine wh<,t equipment is required 3 to the Mutual Aid Box Alarm Assignment. b.- Immediately determine if the required equipment and personnel can be committed in response to the request from the Stricken Municipality. c. Dispatch immediately the equipient required to the Stricken Municipality, in accordance with the Box Alarm Assignments. 2. The rendering of assistance under the terms of this Mutual Aid Agreement shall not be mandatory in accordance with the Box Alarm Assignments if local conditions prohibit response. In that event it is the responsibility of the Aiding Munici - pality to immediately notify the Stricken Municipality of same . 3. Both of the participating Municipalities agree to waive all claims against the other party for compensation for any loss , damage, personal injury or death occurring in consequence of the performance of this Mutual Aid Agreement. General Liability Insurance , Personal Injury and Property Damage Insurance against loss or damage of equipment is the responsibility of each of the Municipalities as it applies to their o,:;n personnel and equipn;ent . All serN/ices perforr•.ed under this Mutual Aid Agrea„ nt shall be. rendered +:jithout reimbursement of either Municipality. 4. The Senior Officer present of the Stricken Municipality shall assume full responsibility and command for operations at the scene. He will assign Senior Officers and equipment of the Aiding Department to positions when and where he deems necessa',-y, 5. The Fire Chief, Officers and personnel of both Municipalities are invited and encouraged to frequently visit each others facilities for fari'iliarization tours, and to jointly conduct SECTION FOUR - INSURf,`!CE It is a requirement for each participating Municipality to be responsible for their own Comprehensive and Bodily Liability Insurance to cover all of their own manpower and equipment and apparatus k-,-h i 1 e operating in any Community. It is further the responsibility of each • participating Municipality to' proOide full and complete Liability Insurance, SECTION FIVE - TERH I t;,!1T 10'1 This 1'11utUal Aid Agreement may be terminated by either partici - pating Municipality notifying, in writing, the Fire Chief of the other Municipality of the teri:ination, 4lhereupon the ';-tutual Aid Agreemicnt shall be terminated 90 days after receipt of the t•:ritten notice to the Fire Chief, - SECTION SIX - ADOPTION This Mutual Aid Agreement shall be in full force and in effect with the passEgc and approval of a companion resolution by both participating 1-lunicipalities in the manner provided by la;: :nd the signing of this Agreement by the Village Presie::c,': , Mayor, or Trustees of a Fire Protection District.
