That the Village President be and is hereby authorized to sign the attached documents marked "Agreement", a copy of which is attached hereto and made a part hereof as if fully set forth and the Village Clerk is authorized to attest said documents upon the signature of the Village President. OF ILLINOIS, acting by and through its DEPARTnENT OF PUBLIC WORKS AND BUILDINGS, hereinafter called the STATE, and the Village of EER Grove, of the State of Illinois, hereinafter called the VILLAGE. WITNESSETH: WHERJsAS, the STATE, in order to facilitate the free flaw of traffic and insure safety to the motoring public, is desirous of improving approximately 4,03 Miles of Higgins 011. Rt.e.72) Road (FA Route 173), State Section 31 -R -pt. I, and 31-R--Pt,II: village Section TICS from F.lr,rhurst: Road to FAI -- Route 90, by widening the roadbed from its present typical_ pavement width of 22 fact, to a width of 60 feet and variable face to face of curbs (providing for four (4) twelve --foot traffic lanes, a 16 foot wide median and combination concrete curb and gutter), channo-lizing the intersection of Arlington Heights Road with Higgins Road, constructing storm sewers and appurtenances for highway drainage, modernizing and relocating the traffic control signals at: the intersection of Arlington Heights Road and Higgins Road and by performing all other work necessary to complete the i_mpr.ovcmcnt in accordance with the approved plans and specifications; and, WHERIAS, the VILLAGE is desirous of said improvement: in that same will be of immediate benefit to the VILLAGE residents and permanent in nature; NOW, TIIE1-tBPORr, in consideration of the mutual covenants contained herein, the parties hereto agree as follows: 1. The STATE agrees to make the surveys, obtain all necessary rights of way, prepare plans and specifications, receive bids and award the contract, furnish engineering inspection during construction and cause the improvement to be built in accordance with the plans, specifications and contract, 2. The STATE agrees to pay all rights of way, construction and engineering costs, ;.subject to rei.mbur_sement by the VILIAGE as hereinafter stipulated, -2- 3. Upon completion of -the improvement and so long as the route is used as a State Highway, the STATE agrees to maintain or cause to be maintained, the median, the four (4) through -traffic linos lying two (7.) on either side of the median, and the left --turn and right --turn lanes, each lane boi.ng twelve (12) feet and variable in width, and the curb and gutter adjacent to those traffic lanes to be maintained by the STATE. 4. It is mutually agreed by and between the parties hereto that the estimated cost of the improvement is as follows: WIDENING_ Construction Costs....................$6,000,000.00 (15%) Preliminary and Construction Eng-- inecring Costs ................. 900,000.00 Rights -of --Way Costs ................. „ 450 000.00 TOTAL $7,350,000.00 TRAFFIC SIGN_A_L UPGIu'1DING Construction Costs ...................$ 50,000.00 (15%) Preliminary and Construction Eng- ineering Costs .................. ^- 7-,500.00 TOTAL $ 57,500.00 5. The VILLAGE agrees to reimburse the STATE for 25% of all engineering and construction costs for Traffic Signal Upgrading. The total cost to the VILLAGE is estimated to be Fourteen Thousand Three Hundred Seventy --Five and no/100 Dollars ($14,375.00). 6. The VILLAGE has passed a resolution appropriating sufficient Motor Fuel Tax Funds to pay its share of the cost of this improvement, a copy of which is attached hereto as "Exhibit A." 7. The VILLAGE has adopted and will. put into effect, prior to the STATE'S ad- vertising for the work to he performed hereunder, an ordinance requiring that parking be prohibited within the VILLAGE limits, a copy of which is attached hereto as "Exhibit B" and will, in the future, prohibit parking at such locations on or immediately adjacent to this improvement as may be determined to be necessary by the STATE from traffic capacity studies. -3 8. The. VILIAGE has adopted and will put into effect, prior to the STATE'S ad- vertising for the wort: to be performed hereunder, an appropriate ordinance prohibiting the discharge of storm, sanitary and industrial waste water in- to any storm sewers constructed as a part of this improvement, a copy of which is attached hereto as "Exhibit G." 9. The VILLAGE agrees not to permit driveway entrance openings to be made in the curb, as constructed, without the consent of the STATE. 10. The STATE: shall cause private utilities to be relocated at no expense to the STATE. Village utilities will be relocated, if necessary, at no cost to the VILLAGE. 11. Upon completion of: the improvement, the VILLAGE agrees to maintain or cause to be. maintained, tl-ose portions of the improvement which are not to be maintained by the STATE including all curbs and gutter flogs not maintained by the STATE, sidewalks, manholes, catch basins, storm sewers, utilities and appurtenances. The VIZI-AGE will furnish*the en- ergy for the operation of as traffic signals. The STATE retains the right to control the sequence and timing of the traffic signals. (Within the Village.) 12. Prior to the STATE advertising for work to be performed hereunder, the dis- position of encroachments will be cooperatively determined with represent- atives from the VILIAGE, the STATE, and the United States Bureau of Public Roads. The Village has adopted and will put into effect, prior to the STATE'S ad- vertising for the work to bc: performed hereunder, an appropriate orelinance. relative to the disposition of encroachments and prohibiting, in the future, any new encroachments within the limits of the improvement, a copy of which is attached as "Exhibit D." 13. This agreement and the covenants contained herein shall become null and void in the event the contract covering the construction work contemplated herein is not awarded by January 1, 1972. 14. Pahl, Village President EXHIBIT " A" RESOLUTION WHEREAS, the VILLAGE OF ELK GROVE VILLAGE has entered into an agree- ment with the State of Illinois for the improvement of (Illinois Rte. 72) Higgins Road (FA Route 173) known as Section 31 -R -Pt. I and 31 -R -Pt. II (Village Section 11 -CS) , and WHEREAS, in compliance with the aforementioned agreement, it is nec- essary for the VILLAGE to appropriate Motor Fuel Tax Funds to pay its share of the cost of said improvement, NOW, THEREFORE, BE IT RESOLVED, that there is hereby appropriated the sum of. Fourteen Thousand Three Hundred Seventy -Five and No/100 Dollars ($14,375.00), or so much thereof as may be necessary, from any money now or hereafter allotted to the Village under the provisions of the Motcr Fuel Tax Law, to pay its share of the cost of this improvement- as provided in the agreement; and BE IT FURTHER RESOLVED, that upon award of the contract, the State of. Illi- nois is hereby authorized and directed to deduct and pay over to the Department of Public Works and Buildings of. the State of Illinois in a lump sum from any of said money allotted to the VILLAGE under the Motor Fuel Tax Law, an amount equal to its obligation incurred under this agreement, and BE IT FURTHER RESOLVED, that the VILLAGE agrees to pass a supplemental Resolution to provide necessary funds for its share of the cost of this improvement if the amount appropriated herein proves to be insufficient to cover said cost. VILLP.GE hereinafter known as the VILLAGE, and the State of Illinois, acting by and through its Department of Public Works and Buildings, Division of. I?ighways, have entered into an Agreement rela- tive to the improvement of. (Illinois Rte. 72) Higgins Road, FA Route 173, State Section 31--R-Pt--I, 31 -R• -Pt. -II (Village Section 11 -CS) from Elmhurst Road to FAI- Routo 90; and WHEREAS, in order to facilitate said improvement, it is necessary for the VILIAC'J, to adopt an ordinance regulating encroachments on the right of way for said improvement in accordance with the following definition: Roadway _}Zight-of--Vday is defined as those areas existing or acquired by dedi- cation or by fee simple for highway pirposcs; also, the areas acquired by temporary easement during the time the easement is in effect; Pro�cct Right-of-_Wav is defined as those areas within the project: right of way lines established jointly by the VILIAGE, STATE, and the United States Bureau of Pub- lic Roads which will. be free of encroachments except as hereinafter defined; Encroachment is defined as any building, fence, sign or any other structure or object of any kind (with the exception of utilities and public road signs) which is placed, located or maintained in, on, under or over any portion of the project right-of- way or the roadway right--of-way where no project right-of--v;ay line has been estab- lished; Permissible E_ncrgachme_nt is defined as any existing awning, marquee, adver- tising sign or similar overhanging structure supported from a building immediately ad- jacent to the limits of the platted street where there is a sidewalk extending to the building line and which does not impair the free and safe flow of traffic on the high- way; the permissive retention of ovo;.hanging signs is not to be construed as being applicable to those signs supported from poles constructed outside the project right. - of. -way line and not confined by adjacent buildings; -2 -- Construction Fasomcnt_Area_ is defined as that area lying between the project right -of --way limits and the platted street limits within which the VILLAGE by concurrence in the establishment of the project right--of-way lines, will permit the STATE to enter to perform all necessary construction operations; and WHEREAS, representatives of the VILLAGE, the STATE, and the United States Bureau of Public Roads have, by visu,_il inspection, cooperatively established pro -- jest right -o£ --way lines and have mutually determined that no encroachments exist at the time of improvement; NOW, THEREFORE, BE IT ORDAINED, by the VILLAGI-: 01' ELK GROVE VILLAGE, COUNTIES OP COOK and DuPAGE, ILLINOIS: that, Section 1: It shall be unlawful for any person, firm or corporation to erect or cause to be erected, to retain or cause to be retained, any EVCROACIIMENT (hereinabove defined)., except as provided in Section 3, within -he limits of the pro- ject right-of-way or roadway right- of -way where no project right -of --way lines have been established. Section 2: Project right-of-way lines have been established by the plans and specifications for the improvement. Section 3: Revocable permits have been issued by the VILIAGE for the temp- orary retention of. the following PERMISSIBLE ENCROACHMENTS (hereinabove defined: No permits have been issued. Section 4: This ordinance is intended to and shall be it addition to all other ordinances, rules and regulations concerning encroachments ant shall. not be con- strued as repealing or rescinding any other ordinance or part of any ordinance unless In direct conflict therewith. Section 5: Any person, firm or corporation violating this ordinance shall be fined not less than Ten Dollars_ ($ 10.00 ) nor more than Two Hundred Dollars me ($ 200.00 ) for each offense and a separate offense shall be docci committed for each and every day during which a violation continues or exists.
