HomeMy WebLinkAboutRESOLUTION - 47-70 - 4/28/1970 - OBJECT CTY ZONING/N SIDE OF DEVONRESOLUTION NO. 47-70 A RESOLUTION DIRECTED TO THE COOK COUNTY BOARD OF COMMISSIONERS, COOK COUNTY BOARD OF APPEALS, AND THE COUNTY CLERK. FOR TRANSMITTAL TO COOK COUNTY BOARD OF COMMISSIONERS PROTESTING THE RE -ZONING OF PROPERTY ON THE NORTH SIDE OF DEVON WEST OF BISNER ROAD (IF EXTENDED) WHEREAS, the Petitioner and Owner of the property, PARKWAY BANK AND TRUST COMPANY, Trustee, under Trust No. 1037, is the owner of property legally described as follows: LEGAL That part of a tract of land in the South half of Section 31, Township 41 North, Range 11, East of the Third Principal Meridian, Cook County, Illinois (See Documents in Z.B.A. FILES - Dockets 1748 and 1749), said property consisting of 50.7 acres located on the North side of Devon Avenue 552 feet West of Bisner Road (if extended), and has petitioned for the re -zoning of same from R-4 Single -Family Residence District to the R-6 Multi -Family Residence District and for a Special Use Permit to permit the development of multi -family building under a planned development concept; and WHEREAS, the Village of Elk Grove Village is within 1'-z miles of the subject property; has adopted a Comprehensive Plan as provided by Statute, which Plan provides for the single-family use of the subject property; and is legally entitled to file objections to the Petitioner's re -zoning requests; and WHEREAS, said cases have been docketed as Docket Numbers 1748 and 1749 by the Cook County Zoning Board of appeals, NOW, THEREFORE BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois: Section 1: That the Village of Elk Grove Village does hereby register objections to the Petitioner's request for the re -zoning of the subject property described above for the following reasons: (a) That it opposes the re• -zoning of any portion of the above- described property to the R-6, Multi -Family District, since same would introduce a heavy concentration of multi -family uses despite the fact that there are no uses within 3,000 feet of the subject property other than single- family residences, schools, churches and related uses and that the intrusion of multi -family uses would be disruptive of the pattern and trend of develop- ment in the area which is established single-family residence in character. (b) That it admits that the: property immediately to the East was zoned R-6 by the County, but states that said property is not developed as such and in itself constitutes an intrusion of bad zoning in the area and that the re -zoning of the subject property would create an additional bad precedent for future zoning in the area and said re -zoning would not have sufficient nor adequate streets or public facilities to support the intensity of use thereby generated. - 1 - (c) That the introduction of 1300 apartment units and 34 homes on 50 acres constitutes exploitation of the land and contradicts the comprehen- sive planning done by the Village of Elk Grove Village; that the introduction of said multi -family development will generate thousands of automobiles using local roads not designed for, such traffic generation which will snarl local hospital traffic and nearby school traffic; that the only beneficiaries of said re -zoning would be the increased monies made by land speculators without suff- icient benefit to the public. (d) That the buildings contemplated are five stories in height and large in bulk and that the only fire protection available comes from a local fire district staffed with volunteer firemen and that there is no adequate fire protection facility available to serve the intense use of the land proposed. (e) That the best and most suitable use of the property is that of single-family residence, the development of which has not even been enter- tained by the owner; that the Village therefore requests the denial of the application. Section 2: That this Resolution shall be in full force and effect from and after its passage and approval according to law. Section 3: The Village Clerk is hereby directed to submit the foregoing Resolution to all governmental bodies having jurisdiction and an interest in the development of the premises as set forth above and as set forth in the caption thereto.
