A RESOLUTION EXTENDING TO AMERICAN NATIONAL
BANK AND TRUST COMPANY OF CHICFG Oa, AS
TRUSTEE, UNDER `.CRUST NO. 28833 AND JAMES L.
CARROLL, SOLE BENEFICIARY THEREUNDER (OWNER) ,
AN ADDITIONAL NINETY(90) DAYS IN WHICH TO
COMPLY WITH PARAGRAPH ONE (1) OF THE PRE-
ANNEXATION AGREEMENT ENTERED INTO BETWEEN
SAID OWNERS AND THE VILLAGE OF ELK GROVE
VILLAGE ON MAY 12, 1970.
WHEREAS, on May 12, 1970, the President and Board of
Trustees of the Village adopted Resolution No. 52-70 entitled,
" A Resolution Authorizing the Village President and the Village
Clerk to Sign a Pre-Annexation Agreement between the American
National Bank and Trust Company of Chicago, as Trustee under
Trust No. 28833, James L. Carroll, sole beneficiary thereunder,
a,-.d the Village of Elk Grove Village" ; and
WHEREAS, subsequent thereto, the Village President and
Village Clerk did execute, on behalf of the Village, such
Pre-Annexation Agreement, and said Agreement provides inter
al.ia:
1. The Village of Elk Grove Village does hereby
agree to annex the real estate described above within
thirty (30) days from date Of this Agreement; provided,
however, that it has been paid the sum of Five Thousand
and N0/100 ($5, 000. 00) ' Dollars as a donation towards
its traffic signal light: fund and the sum of Twenty-
Five Thousand and No/100 ($25, 000. 00) Dollars as a
donation towards the open and recreational space program
contemplated by the Village in its Sub-Division
Control Ordinance. It is understood that in the event
that said sums are not paid the Village Treasurer as
provided, that the Village shall be under no obligation
hereunder to annex and zone the property or to do any
other act whatsoever and this Agreement shall be null
and void. Time is deemed to be the essence of the
understanding hereunder ..
and
WHEREAS, on June 23 , 1970, James L. Carroll, requested that

the Village allow him an additional thirty (30) days in which
to comply with the terms recited in Paragraph 1 of the Agreement,
said Paragraph being recited above, which request was granted
by the Village; and
WHEREAS, on July 28, 1970, James L. Carroll, requested an
additional ninety (90) days in which to comply with the terms
of Paragraph 1 of the said Agreement, said Paragraph being
recited above,
NOW, THEREFORE, BE IT RESOLVED by the President and Board of
Trustees of the Village of Elk Grove Village, Counties of Cook
and DuPage, Illinois :
Section 1 : That the Village of Elk Grove Village does
hereby agree to extend an additional ninety (90) days up to and
including October 15 , 1970, in which James L. Carroll is to comply
with Paragraph 1 of the Pre-Annexation Agreement authorized by
Resolution Number 52-70 ,
Section 2 . : That this Resolution shall be in full force and
effect from and after its passage and approval as provided by law.
PASSED this 4th day of August , 1970.

Preannexation Agreement
War Sir and Gentleman:
It is hereby requested that the Pre.nnncxntion Qreemant
relative to the above WILD OAK Subdivision annexation be
amended as follows:
That the tima in which the u;ir..^_r shall deliver the monies
in the amount of Thirty Thousand Dollars ( $ 30,000 ) be
extended and additional Ninety lays ( 90 ) from the date
of this request. This request is made in view that the:
owner is noy working with an architect to preserve the
Wooded Area of the land as a na_urnl pork area.
A plan will be submitted to the villn3e for its approval
at the earliest possible tate outling the above proposed
wooded area in a planned development.
The above refers to Resolution No. 52 - 70 passed and
approved May 12, 1970 and tha above Pre - Annerati-on agreement
of May 26, 1970. and letter dated June 22, 1970.
