PRE-ANNEXATION AGRf.E1 PHT
This Pre-Annexation Agrecm nt , made this _ day of
1969, by and between the VILLAGE OF ELK GROVE VILLAGE (a municipal corporation
of Cook County, Illinois, hereinafter referred to as "Village") and ELI: GROVE
VILLAGE VETERANS CLUB , INC. (an Illinois General Not For Profit Corporation,
hereinafter referred to as the "Club") .
WITNESSETH:
WHEREAS, Club is owner of real property in Cook County, Illinois,
legally described on Exhibit "A" hereto attached and hereof made a part
(hereinafter referred to as the "Read Estate") ; and
WHEREAS, said Real Estate,, is not incorporated within the Village; and
WHEREAS, it is the desire of the Club to have said Real Estate annexed
to nhe Village, subject to provisions of this Agreement and the Village
Mires to annex said Real Estate in accordance with the provisions of this
Agreement and in accordance with the provisions of Chapter 24, Sections
11-15. 1-1 through 11-15. 1-5 of the Illinois Revised Statutes; and
WHEREAS, the Club has filed with the Village a Petition to Annex said
Real Estate in accordance with requirements of Section 7-1-5 of the Illinois
Revised Statutes;
NOW, THEREFORE, for and in consideration of the mutual covenants
contained herein and other good and valuable considerations, it is hereby
agreed by and between the parties hereto:
1 . That the Village will annex the said Real Estate, subject to the
provisions hereof, and will adopt an Ordinance of Annexation of said Real
Estate into the, Village and will take such further action as is hereinafter
set forth.
2. That promptly upon adoption of said Ordinance of Annexation, the.
Viilage will adopt an appropriate Ordinance granting the Club a special use
of c :d Peal Estate as will effectively allow the erection thereon of a so-
ca` " VFW Post Clubhouse" including the sale and dispensing of food and
be es.
3. Fences shall be constructed of materials designed to prevent

automobile traffic lights from reflecting onto adjoining privately owned
residential property as deemed sufficient by the Village Engineer, the sae-,,
to be constructed prior to the issuance of e certificate of occupancy.
4. That upon application of the Club for a building permit to construct
a clubhouse on the real estate, the Village will make sewer and water
facilities available to the real estate and permit the Club at its cost and
expense to connect to said facilities.
The Club will pay the Village Five Thousand and No/100 ($5,000.00)
Dollars toward the Village's construction of necessary available sewer and
water facilities proximate to the praperty, said amount to be paid at the
time of application for the building permit , The Club will make available
to the Village Manager such easements and bills of sale for the public
utilities as he shall deem necessary to construct the aforementioned connections.
5. That this agreement shall be binding upon the parties hereto as
well as their respective successors.
IN WITNESS WHEREOF, the parties hereto have caused this agreement
to be duly executed as of the date hereinbefore written.
