A RESOLUTION DIRECTED TO THE COOK COUNTY BOARD.
OF COMMISSIONERS, COOK COUNTY BOARD OF APPEALS,
AND THE COUNTY CLERK FOR TRANSMITTAL TO COOK
COUNTY BOARD OF CONMISSIONERS PROTESTING THE
RE -ZONING OF PROPERTY ON THE NORTH SIDE OF DEVON
BISECTED BY BISNER (IF EXTENDED)
WHEREAS the Petitioner and Owner of the property,
Exchange National Bank of Chicago, Trustee, under Trust No.
14893 is the owner of property legally described as follows:
LEGAL
That part of the South half of fractional Section 31,
Township 41 North, Range 11, East of the Third Principal Meridian,
described as follows:
Beginning at the South East corner of said Section 31,
and thence North 20 chains (1320.20 feet) thence West
8.25 chains (544.5 feet), thence South 20 chains,
thence East 8.25 chains to the place of beginning.
ALSO, the South West quarter of the South West
quarter of Section 32, Township 31 North, Range 11,
East of the Third Principal Meridian, except the
East.981.93 feet thereof in Cook County, Illinois.
and has petitioned for the re -zoning of the Easterly 10 plus
acres of same from R-3 to R-4 Single Family Residence and the
Westerly 16 acres thereof from R-3 to the R-6, General Residence
District (Multi-Family),.and.
WHEREAS the Village of Elk Grove Village is within 1-1/2
miles of the subject property and is legally entitled to file
objections thereto, and
WHEREAS said case 'has been docketed as Docket No. 1384
by the Cook County Zoning Board of Appeals,
NOW,THEREFORE BE I7' RESOLVED by the President and Board
of Trustees, of the Village of Elk Grove Village, Counties of
Cook and DuPage, Illinois:
Section 1: That the Village of Elk Grove Village does
hereby object to the re -zoning of said property as petitioned
for the following reasons:
(a) That it opposes the re -zoning of any portion of the
above described property to the R-6, General Residence District
-1-
(Multi -Family) since said re -zoning would constitute spot
zoning in that there are no uses within 3,000 square feet
of subject property which is other than single family residence,
schools, churches or related uses and that the intrusion of
multi -family would be disruptive of the pattern of development
of the area which is established as single family residence.
(b) That the re -zoning of the property will create a
bad precedent for future zoning and cause additional multi-
family re -zoning in other directions around it; that the area
in question does not have the street or public utility facilities
to support such intense use as R-6.
22nd (c) That the Village of Elk Grove Village did on the
day of October , 1968 adopt a comprehensive plan
heretofore recommended to it for adoption by Tec Search, its
planning consultants and its Plan Commission. That said com-
prehensive plan, which has been in study for 2 1/2 years,
identifies subject property and designates it for single family
use only. That there is in existence extensive single family
new development both to the East and North and new single family
residence development to its immediate East.
(d) That the Village of Elk Grove Village is the owner
of public utilities as to sanitary sewer and water, which facilities
are the only such facilities; in the vicinity, and refuses to make
same available to the subject property if subject property is to
be used for other than single family use. That in the evidence
produced by petitioner, he indicated possible connection with
Metropolitan Sanitary District sewer to be installed 2,000 feet
North of subject property by the Metropolitan Sanitary District
of Chicago, that petitioner has no easements by which he could
connect subject property to said sanitary district line and that
as a practical matter, subject property can and should only be
served by public utilities available in the area by Elk Grove
Village; that Elk Grove Village agrees to make said facilities
available provided subject property is used for single family
purposes as detailed in the comprehensive plan of the Village.
(e) That the Village objects to the re -zoning of any
portion of the property from. R-3 to R-4, Single Family Residence,
since this would merely reduce lot size from 20,000 square feet
to 10,000 square feet and seek to provide sanitary sewage by
septic tank if developed in the County, which is neither desirable
nor healthy and that if the property is to be developed in the
County, it should retain its R-3 classification with 20,000 square
foot lots so as to provide adequate and sufficient septic fields;
that if petitioner desires inclusion in Elk Grove Village, he
would be afforded water and sewer in keeping with its standard
policies and procedures and could be developed on lots of 7,500
square feet.

M That the best use of the property, both from
the property owner's point of view and the community is its
development within the Village of Elk Grove Village as single
family residence and such could best be encouraged by denial
of the application.
Section 2: This resolution shall be in full force
and effect from and after its passage and approval according
to law.
