AN ORDINANCE AMENDING VARIOUS SECTIONS OF THE ELK GROVE
VILLAGE CODE AS IT RELATES TO THE REGULATION OF PUBLIC
PASSENGER VEHICLE DISPATCHERS AND PUBLIC PASSENGER
VEHICLES
WHEREAS, the Mayor and Board of Trustees of the Village of Elk Grove
Village, sitting as a Public Vehicle Commission, heard evidence and testimony
concerning the need to amend various sections of the Public Passenger Vehicle
Regulations of the Village; and
WHEREAS, the amendments contained in this Ordinance more accurately reflect
the conditions of the taxicab industry as it exists today, and the adoption of same are
deemed to be in the best interest of the Village.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees
of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois as follows:
Section 1: That Article A, Public: Passenger Vehicles, of Chapter 7, Motor
Vehicle Related Businesses, of Title 3 of the Village Code be amended as set forth in
Exhibit A attached hereto and incorporated herein.
Section 2: That any person, firm or corporation violating any of the provisions of
this Ordinance shall be subject to such fines and penalties as are set forth in Section 3-
7A-10 of the Village Code.
Section 3: That the Village Clerk is hereby authorized to publish this Ordinance
in pamphlet form.

3 -7A -3B INSURANCE Applicants for a license or renewal of a license to operate a
public passenger vehicle dispatcher business in the Village shall produce a copy or copies
of an insurance policy, or certificates of insurance, with public liability insurance
coverage available for personal injuries in an amount not less than two hundred fifty
thousand dollars ($250,000.00) for each person and five hundred thousand dollars
($500,000.00) for each accident and coverage for property damage in an amount not less
than fifty thousand dollars ($50,000.00) for each accident for each public passenger
vehicle owned by the dispatching company or any public passenger vehicle owned by a
third person which has an agency agreement or contractual relationship for dispatching
services with the applicant.
3 -7A -3E-5. Only public passenger vehicles affiliated with an Elk Grove Village
licensed dispatcher may be dispatched for service originating in Elk Grove Village.
3 -7A -3E-6. (New) The provisions of this Article shall not prevent taxicabs licensed by
other municipalities from entering the Village of Elk Grove Village for the purpose of
depositing passengers who are legally picked up outside the Village.
3 -7A -3E-7. (New) Every vehicle which is not licensed in Elk Grove Village but which
is dispatched to the Village should be clean, comfortable and safe and shall be operated in
accordance with the standards and regulations for vehicles which are licensed in Elk
Grove Village.
3 -7A -4D INSURANCE It shall be the responsibility of the owner to insure that each
licensed taxicab has a policy of insurance or certificate of insurance indicating coverage
for personal injury in an amount of not less than two hundred fifty thousand dollars
($250,000.00) per person, five hundred thousand dollars ($500,000.00) per accident and
not less than fifty thousand dollars ($50,000.00) for property damage in full force and
effect during the licensing period or a portion thereof subject to notification of renewal.
In the event that such policy or certificate of insurance becomes ineffective or expires or
in the event a licensee has failed to deposit a currently valid certificate or policy of
insurance, the license herein provided for the operation of the taxicab shall automatically
terminate without further notice.
3 -7A -4G TAXI METER Each taxicab shall be equipped with an approved, accurate
and inspected taxi meter to register, in plan view of the passenger and with proper
illumination, the fare as accumulated while said cab is in operation.
3 -7A -4H-1. INSPECTION REQUIRED The owner of a taxicab must submit his
vehicle for inspection to an authorized inspection station prior to the issuance of a taxicab
license or the renewal thereof and shall also submit said vehicle for reinspections during
the licensing year. The frequency of reinspections shall be within the discretion of the
Chief of Police provided that each taxicab will be inspected no less than one (1) time per
year. Upon notification from the Chief of Police or his designated agent, the owner of a
licensed taxicab shall submit said cab to an approved inspection station within seven (7)
days from the date of notification.
3 -7A -4H-2. INSPECTION STATIONS a. The inspection station shall be an official
State of Illinois testing station or such other facility approved and authorized by the Chief
of Police. The inspection station shall comply with established procedures and criteria
for the conducting of inspections and minimum standards in order that a vehicle be
approved, a copy of said criteria incorporated into the provisions of this Section by this
reference and copies of which shall be on file in the Police Department and the inspection
stations authorized by the Chief of Police:.
3 -7A -5D ESTABLISHED RATES AND CHARGES All rates and charges for
taxicab service in the Village of Elk Grove Village provided by licensed dispatchers and
licensed taxicab vehicles shall be fair, reasonable and competitive. The licensed
dispatcher shall provide the Village with a schedule of its rates including meter rates and
fixed rates for trips to O'Hare and Midway airports. The Village shall be notified of any
change in the designated rates in writing thirty (30) days in advance of the date the
change occurs. The Village shall have the right to publish the rates to its residents in
such form or manner as deemed appropriate by the Village.
3 -7A -5F Repealed
3 -7A -5M EXCLUSIVE PERMISSION GRANTED/INTER-URBAN
OPERATIONS: Subject to the conditions and limitations of this Article, exclusive
permission and authority are herby granted to the licensees hereunder to operate a taxicab
as licensed hereunder upon the public streets and other public ways within the corporate
limits of the Village unless suspended or revoked as hereinafter provided.
It shall be unlawful and the Village will not permit any public passenger vehicle not
licensed by the Village to solicit business or to post within the Village.
Only public passenger vehicles dispatched by a licensed dispatcher may be used for
service originating in Elk Grove Village.
Nothing in this Section shall be construed to prohibit any public passenger vehicle from
coming into the Village to discharge passengers accepted for transportation outside the
Village. While said vehicle is in the Village, no roof light or other special light shall be
used to indicate that the vehicle is vacant or subject to hire and a visible card or flag shall
be displayed at the windshield of the vehicle bearing the words "Not For Hire". No
person shall be solicited or accepted in said vehicle for transportation from any place
within the Village.
3 -7A -6D INSURANCE(LIVERY) It shall be the responsibility of the vehicle owner
to insure that each licensed livery has a policy of insurance or certificate of insurance
indicating coverage for personal injury in an amount of not less than two hundred fifty
thousand dollars ($250,000.00) per person, five hundred thousand dollars ($500,000.00)
per accident and not less than fifty thousand dollars ($50,000.00) for property damage in
full force and effect during the licensing period or a portion thereof subject to notification
of renewal. In the event that such policy or certificate of insurance becomes ineffective
or expires or in the event a licensee has failed to deposit a currently valid certificate or
policy of insurance, the license herein provided for the operation of livery shall
automatically terminate without further notice.
3 -7A -8B APPLICATION Any person desiring to secure a chauffeur's permit or
renewal thereof shall make application in writing therefore to the Chief of Police or his
designated agent. The application for the permit shall contain the name of the applicant;
his residence and employment history; driver's license number and current status thereof,
information as to whether the State's driver's license has ever been suspended or revoked
and if so, when and for what cause; a list of all convictions, if any, for violation of
Federal, State or Municipal laws; and such other information as deemed appropriate by
the Chief of Police, including results of a medical examination conducted within twelve
(12) months from the date of the application and a photograph of the applicant. In
addition, the applicant must submit to a fingerprint examination in order to further verify
the information contained in the application.
