RESOLUTION DECLARING A PUBLIC NUISANCE ON THE
PREMISES AT 111 ARLINGTON HEIGHTS ROAD, ELK
GROVE VILLAGE AND DIRECTING THE BUILDING DE-
PARTMENT TO ABATE SAME.
WHEREAS, it has come to the attention of the corporate
authorities that on premises hereinafter legally described and
commonly known as 111 Arlington Heights Road, Elk Grove Village,
there exists an open foundation for a building in the process of
construction:
Lot 840 except the Northeasterly 18.33 feet as
measured at right angles to the Northeasterly line
thereof and the Northeasterly 50.02 feet as measured
at right angles to the Northeasterly line thereof
of Lot 841 in Elk Grove Village Section 1 South
being a subdivision in the North Half of Section
28, Township 41 North, Range 11, East of the Third
Principal Meridian in Cook County, Illinois.
and
WHEREAS, it appears that completion of construction
has been abandoned by the owner of the premises and the contractor
of the building, namely, Sam Pezzette, and
WHEREAS, the open foundation permits large amounts of
stagnant water some three feet in depth to accumulate, and
WHEREAS, there is a threat that small children living
in the nearby residential area may be drowned by falling into the
excavation or as a result of playing near there, and
WHEREAS, numerous efforts by telephone and in writing
have been made to contact Sam Pezzette at the addresses and tele-
phone numbers provided the Village in the building application as
well as other places, and
WHEREAS, it is felt that the continuance of the situa-
tion as described constitutes a threat to public safety and gen-
eral welfare which must be abated by prompt action.
NOW, THEREFORE, BE IT RESOLVED by the President and
Board of Trustees of the Village of Elk Grove Village, Counties
of Cook and Du Page:
Section 1: That the premises at 111 Arlington Heights
Road, Elk Grove Village, Illinois, owned by one Sam Pezzette con-
stitute a public nuisance and a threat to the safety and welfare
of the children and other persons in the community.
Section 2: That the Building Department is hereby
directed to cancel any and. all permits heretofore issued on the
basis of abandonment on the part of the owner and contractor and
are directed to fill the basement excavation so as to eliminate

the hazard described herein.
Section 3: That the Building Department is further
directed not to re -issue any building permits until and unless
the Village is compensated for all expenditures resulting from
the filling, and the providing of a completion bond with the
Village named as party thereto..
