HomeMy WebLinkAboutRESOLUTION - 27-67 - 5/23/1967 - TRANSFER OF TITLE/CERTAIN PARKSRESOLUTION NO. A RESOLUTION AUTHORIZING THE TRANSFERENCE OF TITLE OF CERTAIN PARKS TO THE ELK GROVE PARK DISTRICT. WHEREAS, the Elk Grove Park District was organized for the purpose of improving, developing and maintaining existing parks as well as establishing new parks; and WHEREAS, the Village of Elk Grove Village is the present owner of all parks in the village and has heretofore improved and maintained same but has determined that it is to the best interest of the Village and its residents that same be transferred to the Elk Grove Park District subject to the conditions hereinafter set forth so that henceforth the Elk Grove Park District may improve and maintain same; and WHEREAS, the territories of the Village of Elk Grove Village lie within the territories of the Elk Grove Park District in its entirely and both municipalities serve substantially the same citizenry; and WHEREAS, the Elk Grove Park District has heretofore passed an ordinance declaring a public need for the improving and maintaining of certain parks hereinafter described and requesting the transference of title of same to the Elk Grove Park District in accordance with the Statutes of the State of Illinois made and provided; and WHEREAS, the President and Board of Trustees of the Village of Elk Grove Village believe it to be the best interest of the citizens of Elk Grove: Village that said designated parks, the legal description of which is set forth on Exhibit 1 attached hereto and made a part hereof. NOW, THEREFOR Board of Trustees of of Cook and Du Page, , BE IT RESOLVED by the President and the Village of Elk Grove Village, Counties Illinois: Section 1: That the President and Village Clerk of the Village of Elk Grove Village, for and on behalf of the Village, be and are hereby authorized and directed to transfer title to all real estate legally described on Exhibit 1 attached, which exhibit is made a part hereof by reference, to the Elk Grove Park District for the sum of One Dollar ($1.00) subject to (1) restrictions and conditions of record, real estate taxes, if any, (2) an option back to the Village of Elk Grove Village to permit said village to repurchase at any time a one-half acre site for any municipal purpose on any parcel of real estate designated on Exhibit 1 attached, the exact location and dimensions of which to be designated by the Village after consultation with the Park District, together with necessary easements for ingress and egress, provided said site not be improved with buildings or permanent structures as defined in the Elk Grove Village Building Code as of date hereof, for the sum of $1.00 per site, and (3) a right of first refusal running to the Village of Elk Grove Village requiring the Elk Grove Park District to offer to sell back to Elk Grove Village any parcel on Schedule 1 or any portion thereof at a price equal to the original purchase price hereunder plus the cost of any capital improvement constructed thereon before same could be sold to any third party. Section 2: This resolution shall be in full force and effect from and after its passage and approval according to law.
