HomeMy WebLinkAboutRESOLUTION - 4-65 - 1/7/1965 - AGRMT/STATE OF IL/IMPROVEMENTSR E S O L U T I O N NO. 4-65 PROVIDING FOR A JOINT AGREEMENT BETWEEN THE STATE OF ILLINOIS AND THE VILLAGE OF ELK GROVE, INVOLVING PORTIONS OF TOUHY AVENUE (C.H. ROUTE 130) WOLF ROAD (C.H. ROUTE 016), MOUNT PROSPECT ROAD (C.H. ROUTE 082) ELMHURST ROAD (C.H. ROUTE 013),LANDMEIER ROAD (C.H. ROUTE 130) AND HIGGINS ROAD (S.B.I. ROUTE 63), STATE SECTION 3035 -15D -Z -Y & RS A PORTION OF WHICH IS IN THE VILLAGE OF ELK GROVE IN COOK COUNTY, ILLINOIS WHEREAS, as a result of the extension and improvement of Chicago O'Hare International Airport, the State of Illinois acting through its Depart- ment of Public Works and Buildings, the City of Chicago and Cook County propose to jointly widen and resurface approximately 17,863 lineal feet of pavement involving portions of Touhy Avenue, Wolf Road, Mount Pros- pect Road, Elmhurst Road, Higgins Road and Landmeier Road from their present widths of 20', 24', 40' and variable to widths of 56', 80' and variable, face to face of curbs, to provide for a basic cross section of six traffic lanes at 12' along Touhy Avenue and Higgins Road, a basic cross section of four traffic lane's at 12' along Elmhurst Road, together with curb and gutter, and a 4 -foot and variable curbed median, and necessary channelization at the intersections of Touhy Avenue with Land- meier Road, Elmhurst Road, Mount Prospect Road and Wolf Road, by con- structing a Portland cement concrete base course widening, Portland cement concrete curb and gutter, a surfacing of the Portland cement con- crete base course widening with 1-1/2 inches of bituminous concrete binder course and 1 inch of bituminous concrete surface course, fine - 2 - dense -graded aggregate Type, Class I, Subclass I-11, and a resurfacing of the existing bituminous concrete surfaced pavement with 1 inch of bitu- minous concrete surface course of the above Type and Class, together with any necessary storm sewer drainage and appurtenances or other items shown on the plans, and WHEREAS, since a portion of the improvement of Landmeier Road, Higgins Road and Touhy Avenue is within the Village Limits, a joint resolution between the STATE OF ILLINOIS, hereinafter called the STATE and the VILLAGE OF ELK GROVE, hereinafter called the VILLAGE, is necessary, and WHEREAS, the STATE is willing to participate in the improvement to the following extent, provided the VILLAGE will participate as provided in this resolution. 1. The STATE will make the surveys, prepare the plans and speci- fications, receive bids and award the contract, furnish engi- neering inspection during construction and cause the improve- ment to be built in accordance with the plans, specifications and contract, and 2. The STATE will pay all construction and engineering costs, and - 3 - 3. Upon completion of the improvement and so long as the streets are used as State Highways, the STATE will maintain or cause to be maintained the pavement structure, consisting of the central median and six traffic lanes each 12 feet and variable in width and lying three on Either side of and adjacent to the central median along Touhy Avenue and Higgins Road, and to the limits of the channelized intersection on Landmeier Road, all within the limits of this improvement. WHEREAS, the total estimated cost, including construction, engineering and right-of-way costs, is approximately $1,800,000. NOW THEREFORE BE IT RESOLVED, that if said improvement is constructed as heretofore stated, the VILLAGE will participate on the following basis. 1. Upon completion of the improvement, the VILLAGE will maintain or cause to be maintained, that portion of the improvement lying within the VILLAGE limits outside of that portion which is to be maintained by the STATE, together with all curbs,. gutter flags, manholes, catch basins, storm sewers, utilities and appurtenances as shown on the plans, and 2. The VILLAGE will adopt and put into effect, before the award of the contract, an ordinance prohibiting parking along that 2. (Continued) portion of the improvement ;vying within the VILLAGE Limits, a copy of which is attached hereto as Exhibit "A", and 3. The VILLAGE will adopt and enforce an appropriate ordinance prohibiting the discharge of sanitary sewage and industrial waste water into any storm sewers constructed as a part of this improvement, a copy of which is attached hereto as Exhibit "B", and 4. The VILLAGE will not permit driveway or entrance openings be made in the curb as constructed without the consent of the STATE, and 5. The VILLAGE will adopt, prior to advertising the work, a resolu- tion approving the plans and specifications as completed, a copy of which is attached hereto as Exhibit "C". BE IT FURTHER RESOLVED, that approval of this resolution by the STATE shall be considered as its concurrence in and acceptance of the terms contained herein and shall constitute an agreement between the VILLAGE and the STATE for the construction and maintenance of the improvement described herein, and - 5 - BE IT FURTHER RESOLVED, that the VILLAGE Clerk is hereby directed to tran- smit the executed, reproducible copy of this resolution and copies of all ordinances and resolutions requested by this resolution to the Division of Highways, through its District Engineer's Office, 300 North State Street, Chicago, Illinois 60610.
