A RESOLUTION PROTESTING THE REZOYDTG OF PROPERTY
ON THE niCRTH SIDE OF DEVON AVENUE WEST OF TONNE
ROAD IN ELK GROVE TOWNSHIP FROM R-3 to B-5
WHEREAS, the petitioner and owner of the property,
Anastasia Berthold, seeks to rezone 4.82 acres of property
on the north side of Devon Avenue; 556 feet west of Tonne
Road, in Elk Grove Township, and legally described as follows :
Lot 27 (except portion taken for Commonwealth Edison
Company' s Right-of-Way) in William Lumpp's Devon
Avenue Farms, being a subdivision in the South Half of
Section 33, Township 41 North, Range 11, East of the
Third Principal Meridian, in Cook County, Illinois
from R-3 to Bj5 £dr the ostensible purpose of erecting a sign
thereon, which sign would advertise the existing greenhouse
which engages in the wholesale and retail. selling of greenhouse
merchandise] and
WHEREAS, the Village of Elk Grove Village is within one
and one-half miles of the property in question and islegally
entitled to file objections herein; and
WHEREAS, , said base has been docketed as Docket No. 882 by
the Cook County Zoning Board of Appeals :
NOW, THEREFORE, BE IT RESOLVED by the President and Board
of Trustees of the Village of Elk Grove Village,, Counties of
Cook and DuPage, Illinois :
Section 1. That the Village of Elk Grove Village does here-
by o'03;et to the rezoning of said property as petitioned for the
£o11owing reasons :
A - that it is not necessary to rezone the property from
R-3 to B-5 business to accomplish the purpose of
the petitioner. That same should be able to be
handled by variation or otherwise.
B - That the rezoning of the property in question will
create a bad precedent for future zoning of Devon
Avenue west of Tonne Road. That the only other
uses zoned business are a gas station and a proposed
A and P complex at Devon and Tonne Road. That the
balance of the area is zoned R-3 in the vicinity
of the property in question.
C - That the uses permitted in the B-5 zoning district
are so extensive and so varied that the zoning of
said property to B-5 would lead to a variety of
uses not compatible with either existing uses or
zoning.
D - That the good of the greatest number of people is
served by maintaining residential zoning in the area
and that same constitutes its highest and best use.

Section 2. This resolution shall be in full force and
effec r£rom an after its passage and approval according to law.
