HomeMy WebLinkAboutRESOLUTION - 18-64 - 5/7/1964 - NEGOTIATIONS/METRO SANITARY DISTRESOLUTICN NO. 18-64 A RESOLUTION BY THE VILLAGE OF ELK GROVE VILLAGE AUTHORIZING NEGOTIATIONS WITH THE METROPOLITAN SANITARY DISTRICT OF GREATER CHICAGO FOR THE PURPOSE OF SERVING WITH SEWER SOME NINETY ACRES OF PROPERTY IN DU PAGE COUNTY WHEREAS, there are approximately ninety (90) acres of property South of Devon Avenue in DuPage County, which area is within the corporate limits of the Village of Elk Grove Village; and WHEREAS, the Village has the obligation to afford said area sewerage service; and WHEREAS, to properly do same it is necessary that agreements be had by and between the Village and the Metropolitan Sanitary District of Greater Chicago, hereinafter referred to as the Sanitary District; and WHEREAS, because said property is not subject to the regular taxes of the Sanitary District lying without its corporate boundaries; and WHEREAS, it is, therefore, necessary that payments be made by the Village to the Sanitary District so that the Sanitary District can afford sewerage service without expense to its other taxpayers; and WHEREAS, the Village is willing to undertake said payment: NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, State of Illinois: Section 1. That the President and Village Attorney are hereby authorized and empowered to draft a contract with the Sanitary District covering the following described property, to wit: The west half of fractional Northwest Quarter of Section 2, Township 40 North, Range 11, East of the Third Principal Meridian, also the North half of the Northwest Quarter of the Southwest Quarter of Section 2, Town- ship 40 North, Range 11, East of the Third Principal Meridian, also a part of the East half of fractional West half of Section 2, Township 40 North, Range 11, East of the Third Principal Meridian, described as follows: commencing at the Northwest corner of said East half of said fractional West half; thence South 38 chains and 162 links; thence East 5 links; thence North 38 chains and 162 links; thence West 15 links to the place of beginning, excepting therefrom such part or portion thereof as has here- tofore been dedicated to the State of Illinois, for highway purposes by instrument dated July 12, 1937, and recorded July 14, 1937, as Document tr381700 in DuPage County, Illinois, said contract to provide that the Village may discharge into the intercepting sewer of the Sanitary District, sanitary sewage and approved industrial waste originating in the above-described property, the Village to pay for such privilege -1- an amount based upon the following factors: the annual assessed valuation of the property at a rate to be One Hundred and Forty Per Cent (140%) of the rate as levied annually for the Sanitary District upon property within the territorial limits of the Sanitary District as said territorial limits existed on November 6, 1956, or in the alternative, at the option of the Sanitary District, the Village shall pay a lump sum to the end that the Village shall have reimbursed the Sanitary District for the share of the plant and equipment of the Sanitary District which the foregoing property would have paid had it been within the corporate limits of the Sanitary District. The final contract between the Village and the Sanitary District shall be submitted to the President and Board of Trustees for ratification. Section 2. That this resolution shall be in full force and effect from and after its passage and approval according to law. PASSED AND APPROVED this 7th day of May, 1964. ATTEST: Eleanor G.
