HomeMy WebLinkAboutRESOLUTION - 34-64 - 9/3/1964 - OBJECT TO REZONING BY COUNTY/DOC 757RESOLUTION N0, 34-64 A RESOLUTION BY THE VILLAGE OF ELK GROVE VILLACE OBJECTING TO THE REZONINC FROM R-4 SINCLE FAMILY RESIDENCE TO M-1 MANUFACTURING OF A FOUR ACRE TRACT IN ELK CROVE TOWNSHIP LOCATED 109 FT. SOUTH OF OAKTON STREET AND 2700 FT, WEST OF BUSSE ROAD DESIGNATED BY THE COOK COUNTY ZONING BOARD OF APPEALS AS LOCKET NO. 757 WHEREAS, Edwin C. Corra seeks the rezoning of four acres of property located 109 ft. south of Oakton Street and apprmcimately 2739 ft west of Busse Road from its present R-4 single family classification to the M-1 restricted manufacturing classification for the purpose of erecting thereon a warehouse for the storage and prefabrication of copper tubing, which was docketed by the Cook County Zoning Board of Appeals as Docket No. 757; and WHEREAS, the Village of Elk Crove Village is within one and one- half miles of the property sought to be rezoned; NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk (rove Village, Counties of Cook and DuPage, Illinois: Section 1. That the Village of Elk Grove Village does hereby object to the rezoning described above which relates to real estate legally des- cribed on Exhibit "A' attached hereto and made a part hereof, and requests the County Board to note its official objection and does hereby state the reasons for such objection to be as -follows: A - That the highest and best use of the subject property at this time is R-4 single family residence and not M-1 as requested by the petitioner since all property in the vicinity, both North and South of Oakton Street and adjacent to the property in question on all sides is zoned R-4 and used for agricultural purposes and that the rezoning of the property in question as requested would constitute spot zoning with all its necessary deterring affects. B - That the property has no frontage along and upon Oakton Street and must utilize a high line easement to gain contact to Oakton Street so that for all practical effect the property in question is land- locked and without proper access. C - The property in question can not or should not be developed without an adequate water supply, that no definite provisions have been made for same by the petitioner and that his request upon the Village of Elk Grove Village to serve said property with water has at this time been denied. As a consequence thereof the property cannot be developed in accor- dance with the plan proposed by the petitioner. D --That the Village of Elk Grove Village has hired a city planner to provide said Village with a master plan, which master plan will include the area in question and which Village has been advised by him to oppose the request in question until a master plan of all areas in the immediate vicin- ity has been undertaken. , .i .- .i.l if h E � That the granting of the request of the petitioner in question will result in breaking down the fabric of the Cook County Zoning Ordinance in the entire area and will be injurious to a well planned area, and consequently, is against the best interest of both the Village of Elk Grove Village and the County of Cook. Section 2. The Village Clerk is hereby authorized to submit certified copieshis resolution to the County Clerk of Cook County for transmittal to the County Board and such other agencies as are deemed appropriate. Section 3. This resolution shall be in full force and effect from and after 'Its passage and approval according to law. Turner Village Clerk Legal Description: That part of the North Half of the North Half of the East Half of the Northwest Quarter of Section 27, Township 41 North, Range 11, East of the Third Principal Meridian, described as follows: Beginning at a point on the West line of the East 99 feet of said Northwest Quarter which point is 109,81 feet South of the North line of said Northwest Quarter (as measured along the West line of the East 99 feet of said Northwest Quarter); thence Southwesterly along a diagonal line a distance of 864,52 feet to a point on the South line of said North Half of the East Half of the Northwest Quarter which is 576.26 feet East of the Southwest Corner thereof; thence Eastalong said South line a distance of 654.26 feet to the West line of the East 99 feet of said Northwest Quarter; thence North along the West line of said East 99 feet a distance of 557.03 feet to the point of beginning, in Cook County, Tllir..is.
