HomeMy WebLinkAboutRESOLUTION - 44-64 - 12/3/1964 - PROTEST REZONING OF PROPERTY/EG TOWNSHIPRESOLUTION NO. %Y_ A RESOLUTION PROTESTING THE REZONING OF PROPERTY IN ELK GROVE TOWNSHIP FROM R-4 to B-4. WHEREAS, the petitioner in the above case seeks the rezoning of 9 1/2 acres on the west side of Elmhurst Road, approximately 541 feet North of Dempster Street, in Elk Grove Township, legally described as follows: That part of the Southeast Quarter of the Southeast Quarter of Section 14, Township 41 North, Range 110 East of the Third Principal Meridian. from R-4 to B-4 for the ostensible purpose of developing said property with a theater, restaurant and office building (with- out a cocktail lounge because of the proximity of the school, although one was first proposed); and WHEREAS, the Village of Elk Grove Village is within one and one-half miles of the property in question and is legally entitled to file objections herein: NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Counties of Cook and DuPage, Illinois: Section 1. That the Village of Elk Grove Village does hereby object to the rezoning of said property as petitioned, for the following reasons: A - The development of the property in question„ as proposed, would have a harmful affect on the use and occupancy of the Dempster Junior High School immediately to the west of the property. B - It would constitute spot zoning since the property immediately to the south, west and north is zoned single family residence either in the County of Cook or the Village of Mount Prospect. C - The rezoning of the property would constitute strip zoning and introduce traffic problems along and upon Elmhurst Road by introducing congestion of automobiles at such times as theater traffic left and entered the property in question. D - There is an abundance of commercially zoned property in the area available for the purpose proposed which has not been heretofore used. E - The evidence submitted as to the Developerts proceeding with the project was sketchy and uncertain. F - The highest and best use of the property is and should remain as zoned, namely, single family residence. G - The rezoning of the property in question would constitute both spot and strip zoning. Section 2. This resolution shall be in full force and effect from and after its passage and approval according to law.
