HomeMy WebLinkAboutRESOLUTION - 37-63 - 11/14/1963 - OBJECT TO REZONE/NERGE & ROSELLERESOLMION NO. 37-63 A RESOLUTION DIRECTED TO THE COUNTY CLERK OF COOK COUNTY FOR TRANSMITTAL TO THE COOK COUNTY BOARD OF COMMISSIONERS 013-JECTING TO THE REZONING OF CERTAIN PROPERTY DESIGNATED BY THE ZONING BOARD OF APPEALS OF COOK COUNTY AS DOCKET 652 and 653. SAID PROPERTY BEING IN SCHAUMBURG TOWNSHIP NOW; THEREFORE BE IT RESOLVED by the President and Board of Trustees of the Village of Elk Grove Village, Cook County, Illinois. Section 1. The Village of Elk Grove Village does hereby object to rezoning of the following described property from its present classification of R-3 Single Family Residence District to B-4 General Service District for the development of a restaurant, cocktail lounge and meeting hall. Said property being approximately 10.15 acres located at the southeast corner of Nerge Road and Roselle Road in Schaumburg Township, legally described as follows: PARCEL A: The Northwest Quarter of the Southeast Quarter of Section 34, Township 41 North, Range 10, East of the 3rd Principal Meridian. PARCEL B: The East 50 feet of the West 388 feet, as measured on the north and south lines thereof, of the Northwest Quarter of the Southeast Quarter of Section 34, Township 41 North, Range 11 East of the Third Principal Meridian (except the North 1200 feet thereof, as measured on the East line thereof) in Cook County, Illinois. for the reasons: 1. That this parcel of property in question is just a portion of a forty acre tract that is under consideration for rezoning; that said applicants desire to construct a shopping center and residential dwellings on a piecemeal basis. 2. That said buildings in the shopping center are not to be built as a contiguous unit but singly, when and if tenants are available. 3. That said applicant, at the present time, has shown no letters of intent from any proposed tenants nor have any tenants evidenced any intent of interest in said shopping center. 4. That said applicant desires the property to be rezoned solely for profit without any consideration for the health, safety, morals and welfare of the general public. 5. The petitioner has failed to put forth a prima facia case, in that he has failed to show monetary loss resulting from the present zoning of the property's comparative values, and has failed to show the issuance of a certificate of convenience and necessity for the area to be developed and that as a consequence there is no guarantee of water or sewers for the area. 6. That said petitioner is not the owner of said property but only has an option to purchase the property which is contingent upon the property being rezoned by the Zoning Board of Appeals of Cook County. 7. That in the opinion of the President and Board of Trustees such rezoning, if granted, would be against public health, safety, morals and general welfare. Section 2. That the Village Attorney is hereby authorised and directed to transmit this resolution to the County Clerk of Cook County, Cook County Zoning Board of Appeals. Section 3. That this resolution shall be in full force and effect from and after its passage and approval according to law.
