RESOLUTION NO. �/ 1
A RESOLUTION AUTHORIZING SNOW REMOVAL AGREEMENT
NOW, THEREFORE, BE IT RESOLVED by the President and
Board of Trustees of the Village of Elk Grove Village, Counties
of Cook and DuPage, Illinois:
Section 1. That the Village of Elk Grove Village does
he eby award its snow removal contract to Milburn Brothers, Inc.,
Central Road, Mount Prospect, Illinois, contractor, for the
removal of all snow on streets lying within the following de-
scribed area:
All streets within the Village limits as specified and/or
requested by the Street Department Foreman.
Work to be done at prices in accordance with the bids
submitted by said contractor and in accordance with agreement at-
tached.
Section 2. That the President and Village Clerk of the
Village of Elk Grove Village are hereby authorized to enter into
and sign an agreement between the Village of Elk Grove Village
and Milburn Brothers, Inc., contractor; which agreement is at-
tached hereto and made a part of this resolution as if fully set
forth.
Section 3. That the Village Clerk is hereby authorized
to send a signed copy of said agreement to the contractor for its
signature, together with a copy of this resolution, and request
the contractor to sign a copy of said agreement and remit same to
the Village Clerk for her records. The Village Clerk shall indi-
cate in a letter of transmittal that the foregoing agreement shall
not become binding upon the Village unless it is signed and re-
turned within five (5) days from the date from which it is sent,
which condition shall constitute a restriction upon the effective-
ness of the attached agreement.

AGREEMENT
Agreement between the Village of Elk Grove Village,
Counties of Cook and DuPage, Illinois, a municipal corporation,
hereinafter designated at Village, and Milburn Brothers, Inc.,
hereinafter designated as Contractor, for the purpose of snow re-
moval, agree as follows:
1. That the Contractor shall remove from all streets
within the Village limits as specified by the Street Department
Foreman.
2. That the Contractor shall use in said operation ten -
cubic -yard dump trucks with plows, except upon request of the
Street Department of the Village.
3. That the Contractor shall use its own discretion as
to when trucks are to be put to work unless the Street Department
of the Village makes special request that work commence, in which
event work shall commence within two hours after the request is
made.
4. That the Contractor shall supply a certificate of
insurance naming the Village as one of those covered by the in-
surance, to protect the Village and its residents against per-
sonal injury and property damage occasioned by the Contractorts
equipment or drivers; said insurance to be in the amount of
8100,000 to ;;1300,000 public liability and ';150,000 property damage.
5• That the Contractor shall supply the Village a per-
formance bond in the amount of $51000, and in a form acceptable
to the Village attorney.
6. That the price to be paid for snow removal shall be
based on those contained in quoted bids contained in letter of
October 190 1962 to the Village from the Contractor heretofore
filed with the Village Clerk; that payment shall be within four-
teen days from the time a statement is rendered to the Village.
7. That in the event the Contractor fails to remove
snow from all streets in the above sections within twenty-four
hours from the time the snow fall stops or from the time the
Village Street Department notifies the Contractor to clean the
streets, whichever is earlier, that the Village at its option
shall have the right to hire additional snow removal equipment
and the use thereof from another contractor so as to complete the
job, in which event the difference in cost over what to be paid
to the Contractor hereunder will be chargeable to the Contractor
and said difference may be deducted from the Contractorls bill.
8. That this agreement shall be in full force and ef-
fect upon its signing by both parties.
