HODES C CKPANY FOR CALENDAR YEAR 1961 WHEREAS, the Village of Elk Grove Village deems it to be to the best interests of said Village that a trenching and backfilling contract be entered into with W. L. Hodes Company for the calendar year 1961, a copy of which contract is attached hereto and made a part of this resolution; NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees of the Village of Elk GroveVillage, Cook County, Illinois, as follows Section 1 That the Village of Elk Grove Village by its Presi- dent and Beef Trustees kereby agrees to enter into a trenching and backfilling contract with W. L. Hales Company, a copyof which is attached hereto and made a part of this resolution; and that its President and Clerk are herely authorizes' to sign said contract for and on behalf cf said Village. Section 2 That this resolution shall be in full force and ef- fect upon Me adoption and approval according to law. ADOPTED this 9th day of January, 1961, APPROVED this 9th day of January, 1961. CONTRACT FOR TRENCHING AND BACKFILLING THIS CONTRACT made this 9th day of January, 1961, by and be- tween W. L. Hodes Company hereinafter called the contractor, and the Village of Elk Grove Village, a municipal corporation, Cook County, Illinois, hereinafter called the Village, WITNESSETH: That the contractor and the Village, for the consideration stated, agree as fellows: ARTICLE I - SCOPE OF WORK: The Contractor shall perform every- thing to be performed and shall provide and furnish all labor, neces- sary tools and machinery, expendable equipment, and all utility and transportation services required for the trenching and backfilling, in strict accordance with the contract drawings prepared by the Public Service Ccmpany of Northern Illinois, for the installation of street lighting. This contract to cover Section 7 and all subsequent sections requiring trenching and backfilling during the calendar year 1961. Trenching will be done by machine; will be thirty (30) inches deep from the existing point of connection to the base of the poles. Backfilling shall be completed immediately after installation of the cables. The contractor shall be responsible for contacting the Public Service Company of Northern Illinois and the Illinois Bell Telephone Compare* for the location of their underground facilities and the scheduling of the work. Responsibility for damage to existing under- ground facilities shall be with the contractor. ARTICLE II - CONTRACT PRICE: The Village shall pay to the con- tractor for the performance of this contract, subject to any additions or deductions and upon the written acceptance thereof of the Villa Engineer, the contract price at the rate of thirty-five cents (35¢r per lineal foot; said price shall include tunneling under sidewalks, curbs or streets. It is understood and agreed that the payment will be made only cn the actual quantities of work completed, measured by the Village Engineer and at the unit price stated. ARTICLE III - STARTING AND COMPLETION: The work to be per- formed under this contract is to commence at the contractorts discre- tion, provided, however, that in the event lawn or parkways have been installed prior to the commencement of the contractor's work the con- tractor shall beer the responsibility of restoring lawns to the same condition as they were prier to the commencement of his work, except where the fault for the delay lies with the Public Service Company ani except for Section 7. The contractor shall furnish to the Village sat- isfactory evidence of insurance coverage prior to the cammencement of any work done under this contract. IN WITNESS WHEREOF, the Village of Elk Grove Village has caused this contract to be signed by its President and Village Clerk in ac- cordance with action duly taken by the President and Board of Trustees of the Village of Elk Grove Village, and W. L. Hodes Company has signet this contract by its duly authorized officers, pursuant thereto granted by their Board of Directors. W. L.
