A RESOLUTION OF INTE14T BY THE VILLAGL OF ELK GROVE VILLAGE TO ACQUIRE THE WATER AND
SANITARY PROPERTIES OF THE %LK GttOVE WATER AND SLWER COMPANY, INC..
WHEREAS, the Village of Elk Grove Village has heretofore granted an exclusive
franchise to the Elk Grove mater and Sewer Company, Inc. to provide the Village
with water and sewage disposal facilities, said exclusive franchise being contained
in Ordinances No. 5 and 6, and
WH&KEAS, said ordinances hereinbefore referred to provide the Village of Elk Grove
Village with the option of acquiring said properties, and
WHEREAS, the Village of Elk Grove Village deems it to be to the best interests of
said Village that it acquire the properties of said Company and operate same for
the benefit of the Village of Elk Grove Village and its residents, provided. same
can be acquired at a reasonable price and also provided said price is within the
financial capabilities of said Village,
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees i1 the Village
of Elk Grove Village, Cook County, Illinois:
Section 1.
1. That it is the fixed intention of the President and Board of Trustees of the
Village of Elk Grove Village on behalf of the Village that the Village acquire the
properties of the Elk Grove Water and Sewer Company, Inc.p provided same can be
acquired at a price which is both reasonable and within the financial capabilities
of said VillageA
2. That the President and Board of Trustees of the Village of Elk Grove Village
do hereby designate its President, James R. Gibson, and Trustees, Robert E. Hartshorn
and Charles P. Smith, to be its duly authorized agents for the purpose of opening
and conducting negotiations with the Elk Grove Water and Sewer Company, Inc. for
the acquisition of the Company's properties; that in this connection said officials
are hereby authorized to utilize the services of the Village Attorney, the Village
Engineer, the Municipal Finance Consultant and the engineering film of Alvord,
Burdick and Howson, to such extent as they may deem necessary.
3. That the immediate objective of said negotiations shall be the working out
of a voluntary tentative agreement between the Village and the Elk Grove Water and
Sewer Company, Inc. providing for the acquisition of said Company's properties by
said Village; it being understood that said tentative agreement shall in no way
commit the President and Board of Trustees or the Village of Elk Grove Village to
acceptance of same until and unless said tentative agreement has been presented to
the President and Board of Trustees at a regular or public meeting called for said
purpose, at which time said tentative agreement together with all reports upon
which said tentative agreement is premised shall be submitted to the Board for
examination.
Section 2. That a certified copy of this resolution shall be sent to the Elk Grove
Water and Sewer Company, Inc. by the Village Clerk.
Section 3. That this resolution shall be in full force and effect forthwith upon
its adoption and approval according to law.
ADOPTED this 18th day of September, 1961.
