RESOLUTION AUTHORIZING VILJAGE OF ELK GROVE VILLAGE
TO INDEHNIFY CENTEL CONSTRUCTION CCHPANY AGAINST
CLAIM ARISING FROM SIDEWALK AND CURB DAMGE IN THE
VICINITY OF 86 EVERGREEN STREET, VILJAGE CF ELK
GROVE VILLAGE
WHEREAS., the President and Board of Trustees of the Village
of Elk Grove Village., Cook Countyp Illinois., believe it to be to the
best interests of the Village of Elk Grove Village that an indemnity and
held harmless agreemsnt� attached hereto and made a part hereofj, be
goto"d into.
N(N� THEREFORE3 BE IT RESOLVED by the Village of Elk Grove
Village$ Cook Countyp Illinois:
Section 1 That the indemnity and hold harmless agreement.,
gt#tached hereto and made a part hereof., whereby the Village of Elk Grove
Vil.Uge agrees to indemnify Centex Construction Company against claims
arising against it arising out of sidewalk or curb damage caused by its
tru#ks or the dwaping of dirt on or over sidewalk and curb off of Oakton
5Uest there Oakton Street intersects the easement located at the rear
lot line of premises commonly known as 86 Evergreen Street, Village of
Elk Grove Village., be entered into.
Section 2 That the President of the Village of Elk Grove
Village be and is hereby authorized and directed to execute said agreement.
Section 3 That this resolution shall be in full force and
effoet from and after its adoption and approval.

AGREEMENT
WHEREASs the Village of M Grove Village, a municipal
corporation., County of Cook andState of Illinoiss deems it to be to the
best interests of the Village of Elk Grove Village that certain drain
tiling be installed in the easement area located at the rear lot line of
promises commonly known as 86 Evergreen Streets Village of Elk Grove
Village, and
WHEREAS, the installation of said drain tile will require
the mowing of large quantities of soil by heavy trucking vehicles over
the public sidewalk and curb on Oakton Street where Oakton Street inter-
sects the easement located at the rear lot line of premises commonly known
as 86 Evergreen Street, Village of Elk Grove Village; and
WHEREAS2 the particular sidewalk and curb affected will lie
within a distance of twenty-five (25) feet to either side of the center
line of said easemnt; and
WHEREASp the Centex Construction Company has agreed to in-
stall said drain tile provided the Village of M Grove Village agrees
to indemnify it and hold it harmless from any claims arising against it
because of sidewalk and curb damage in the area referred to above and
resulting from its trucks crossing said sidewalk or curb or dumping soil
therecu;
NOW3 THEREFCRE, in consideration of the abovep namly the
installation of drain tile in the area designated above., the Village of
Elk Grove Village agrees to indemnify and hold harmless the Centex Con-
struction Company from any and all claim against it arising out of
sidewalk or curb damage caused by its trucks or the dumping of dirt on
or over said sidewalk and curb off of Oakton Street and such portions
of said sidewalk and curb lying within a radius of twenty-five (25) feet
from the center line of the easement aforementioned*
THIS AGREEMENT sball be null and void if the aforemntioned
work to be done by Centex Construction Company is not completed on or
before the 30th day of September, 1960, and shall be its terms not ex-
tend beyond said date.
